DIGITAL RECORDING UNCIL <br /> Mon <br /> CITY COUNCIL STUDY SESSION MINUTES MAR 18 2015 <br /> Wednesday, March 11, 2015 <br /> A Study Session of the City Council of the City of Bremerton was called to order in the Council <br /> Conference Room of the NORM DICKS GOVERNMENT CENTER, 345 6th Street, Bremerton, <br /> Washington, Wednesday, March 11, 2015, at 5:00 PM, with Council President Greg Wheeler <br /> presiding. Council Members present were Eric Younger, Roy Runyon, Dino Davis, Jerry <br /> McDonald, Leslie Daugs, and Mike Sullivan. Lori Smith, Legislative Assistant, was present to <br /> provide staff support. <br /> President Wheeler emphasized that the Study Session was open to the public but there would be <br /> no opportunities for input or participation except for Item B-6; and announced that approved items <br /> by Council will be placed on the March 18, 2015 Council Meeting Agenda; or as indicated. <br /> A. NO PRESENTATION PLANNED — The following items are budgeted items or subjects that <br /> have been raised with the appropriate Council Committee Members... <br /> 1. Construction Contract Award to Coatings Unlimited, Inc. for Interior Coating Replacement <br /> of Reservoir 10 North (located in Olympic View Industrial Park) Consent Agenda <br /> 2. Property Purchase Agreement with the Bowman Family Trust for 6.85 acres for Water <br /> Utility Consent Agenda <br /> 3. <br /> 31,201:7 Item Pulled <br /> 4. Ordinance to grant a 10-year Franchise Agreement with Cascade Natural Gas Consent <br /> Agenda <br /> B. BRIEFINGS AND FULL PRESENTATIONS <br /> 5. Proposed Public Hearing and ordinance to vacate alleys between Dr ML King Way and 8th <br /> Street, and between Warren and Park Avenues for the Marvin Williams Youth Center <br /> Public Hearing <br /> The following item was presented for formal action with a Council vote: <br /> 6. Professional Services Agreement with the Law Office of Kenneth W. Bagwell Inc. P.S. <br /> President Wheeler explained that the City Attorney's Office provided legal representation <br /> to the Kitsap Regional Coordinating Council (KRCC) from July16, 2013 to February 4, <br /> 2015. On March 4, 2015, the City Council moved to reject an amended Interlocal <br /> Agreement (ILA) proposed by KRCC and requested that KRCC amend other provisions of <br /> the ILA. This has created a potential conflict for the City Attorney's Office, so the City <br /> Attorney's Office cannot represent the City in issues related to KRCC. Section 23(a) of the <br /> City Charter authorizes the City Council to retain special counsel for specific assignments. <br /> The Council President seeks a motion to retain the Law Office of Kenneth W. Bagwell Inc. <br /> P.S. as special counsel to represent the City regarding issues related to KRCC. <br /> There were no questions or comments from the public... <br /> 05:14:00 Motion was made by Davis and seconded by Daugs; Comments were provided <br /> by Davis and Daugs;and questions were asked by Runyon, Davis, and Daugs with <br /> responses provided by City Attorney Roger Lubovich and Kenneth Bagwell... <br />
