CLIFFORD, NELSON J. CLAYTON, Executors of the Last Will and Testament of Joseph Henry Zerbey, Deceased, of the City of Pottsville, County of Schuylkill and State of Pennsylvania, parties of the first oart; -and- City of Bremerton .... of_ Bremerton~ Wash. __ County of Kltsap , State of Washington, party of the second cart: WITNESSETH, that the said parties of the first cart for and in consideration of the sum of__~_~. · ~ -' Dollars ($~500,oo~, lawful money of the United States, to them in hand paid by the said oarty of the second Dart, the receiot whereof is hereby acknowledged, do by these presents grant, bargain, sell, convey and confirm unto the said oarty of the second part, and to tt~ heirs and assigns, the following described tracts, lots and parcels of land situate lying and being in the County of Kitsap, State of Washington, and particularly bounded and described as follows, to wit: Lots numbered twenty, twenty-one and twenty-two (~0, Zl and 2B) of Block No. ZE of Charleston, as shown by the official clot thereof, recorded in the Office of the County Auditor of said County of Kitsao. Being the same property which by deed dated April E6, 189~ between Rees P. Daniels and Mary ~. Daniels, his wife, ~ranted and conveyed to J. H. Zerbey, said deed being filed for record at the request of Thomas Roes, on A~ril BT, 1895 and recorded on cage 5Z4, volume R in the County of Kitsao. AND BEING the same oremises which by deed dated October 17, 19~4, wherein the ~arine National Bank of Seattle, Washington, sold to the said J. H. Zerbey, which deed was filed for record at the reouest of I. W. Bennett on November 19, 1924 and recorded in Volume 145 of Deeds, page 566, in the County of Kitsao. AND WHEREAS, the said J. H. Zerbey, by his Last Will and Testament, duly proved snd recorded in the Register's Office of Schuylkill County, in Will Book ~33, page 577, provided in the tenth oaragraoh thereof ss follows:- "TENTH: All the rest, residue and remainder of my oroperty, whether real, personal or mixed, whatsoever or wheresoever situate, including my homestead Drooerty at 15th and Howard Avenue, Pottsville, Pennsylvania, the 4th and Market 9treet property, the 17th and ~ahantongo Street lot, the Yorkville lot, the Orwigsburg farm, the J. H. Zerbey Faraway Estates, my orooerty in the state of Washington, the stock in the Pen~ Land Company, all other stocks and bonds, I give, devise and bequeath unto my hereinafter named executors to convert the same into money, and for that purpose I hereby empower and dire~t my hereinafter named executors to sell and dis- Dose of the whole or sny part of my real and oersonal nrooerty so devised and bequeathed, either st public or private sale or sales, at such times, in such manner and for such price and upon such terms, ss to credit or otherwise, as they in their discretion may deem best, without any obligation on the part of the ourchsser thereof to see to or be resnonsible for the purchase money..." TOGETHER with the ap~]rtenances, to have and to hold the said premises with the appurtenances, unto said party of the second part, and to .... i~-s heirs and assiMns forever. And the said parties of the first Dart, for said parties and for themselves, their heirs, executors and administrators, do by these presents, covenant that they are lawfully seized in fee simple absolute of and in all and singular the above granted and described premises and appurtenances; that they have good and lawful right to sell and convey the same; that the same are free from all liens and incumbrances and that they hereby Warrant and will Defend the sam~ from all lawful claims whatsoever. OLI~?ORD, NEL$CN J. 0LAYTON, Executors of the Last Will and Testament of Joseph Henry Zerbey, Deceased, and in due form of law acknowledged the above Indenture to be their act and deed, and desired the same might be recorded as such.
