STORMW A TER EASEMENT
THIS EASEMENT, made and entered into this 13 day of oD~2000 by and between the
City ofBremerton, a first class municipal corporation, (hereinafter referred to as "Grantee"); and

(Hereinafter referred to as "Grantor")"
FOR AND IN CONSIDERATION of the mutual promises and benefits contained herein and for other
valuable consideration, the receipt of which is hereby acknowledged, the Grantor and Grante\l hereby
agree and covenant as follows:
1.
GRANT OF EASEMENT:
EXCISE TAX EXEMPl" JUN 28 200l
Grantor does hereby convey and quit claim to Grantee an easement for the purpose of
constructing, operating, maintaining, and repairing stoml lines across the property described as
follows:
See Attached EXHIBIT "A"
2" RESTORATION:
Upon entry into the property in the exercise of this easement, the surface ofthe
ground shall be substantially restored to it's condition prior to commencing work or
as nearly thereto as is reasonably possible.
STORM EASEMENT - 1 -
3" EASEMENT TO RUN WITH THE LAND
The Grantor and Grantee intend that tlus Agreement shall be a covenant running with the land
described above and shall be binding upon Grantor's and Grantee's successors in interest.
4" GOVERNING LAW:
The place of making this Agreement shall be deemed to be the State ofWashingtol1, and the
legal rights and obligations of the parties hereto shall be detennined in accordance with the
laws of the State ofWaslungton.
5" JURISDICTION AND VENUE:
In the event that any suit or action shall be brought in connection with any of the terms and
conditions of tlus Agreement, the parties hereto hereby agree that jurisdiction and venue of any
such suit or action shall properly lie in Kitsap County, State of Washington"
6" SEVERABILITY:
In the event that any section, or any part of any section, or this Agreement shall be declared
invalid by a court of competent jurisdiction, said holding shall have no effect upon the
remaining sections of this Agreement, which shall remain in full force and effect.
7. ENTIRETY:
This Agreement constitutes the entire agreement and understanding between the parties hereto"
There are no other agreements or understandings, either written or oral, which modifY or have
any effect upon this Agreement.

8" GRANTOR'S USE OF EASEMENT AREA:
Grantor reserves the right to use the Easement Area for any purpose not inconsistent with the
rights herein granted, provided, that Grantor shall not constmct or maintain any building,
stmcture or other object on the Easement Area.

as "Grantor").
FOR AND IN CONSIDERATION of the mutual promises and benefits contained herein and for other
valuable consideration, the receipt of which is hereby acknowledged, the Grantor and Grantee hereby
agree and covenant as follows:

1. GRANT OF EASEMENT:
Grantor does hereby convey and quit claim to Grantee a non-exclusive perpetual easement for
the purpose of constructing, operating, maintaining, and repairing storm lines across the
property described as follows:

STORM EASEMENT - 1 -
RESTORATION:
Upon entry into the property in the exercise of this easement, the surface of the Ground,
including all landscaping, shrubs, etc. shall be substantially restored to it's condition prior to
commencing work or as nearly thereto as is reasonably possible.
3. EASEMENT TO RUN WITH THE LAND:
The Grantor and Grantee intend that this Agreement shaI1 be a covenant rwming with the land
descnbed above and shall be binding upon Grantor's and Grantee's successors in interest.
4. GOVERNING LAW:
The place of making this Agreement shall be deemed to be the State of Washington, and the
legal rights and obligations of the parties hereto shall be detennined in accordance with the
laws of the State of Washington.
5. JURISDICTION AND VENUE:
In the event that any suit or action shall be brought in connection with any of the terms and
conditions of this Agreement, the parties hereto hereby agree that jurisdiction and venue of any
such suit or action shall properly lie in Kitsap County, State of Washington.
6. SEVERABILITY:
In the event that any section, or any part of any section, or this Agreement shall be declared
invalid by a court of competent jurisdiction, said holding shall have no effuct upon the
remaining sections of this Agreement, which shall remain in full force and effect.
7. ENTIRETY:
This Agreement constitutes the entire agreement and understanding between the parties hereto.
There are no other agreements or understandings, either written or oral, which modi1Y or have
any effect upon this Agreement.

8. GRANTOR'S USE OF EASEMENT AREA:
Grantor reserves the right to use the Easement Area for any purpose not inconsistent with the
rights herein granted, provided, that Grantor shaJI not construct or maintain any building,
structure or other object on the Easement Area.
9. GRANTEE'S USE OF EASEMENT AREA
It is the obligation of the City of Bremerton to promptly maintain, repair or replace all pipes,
culverts or any other equipment or fucilities installed in the easement area, upon notice from
BCI Coca-Cola Bottling Company of Los Angles.
It is the obligation of the City of Bremerton to pay for all damages to BCl Coca-Cola Bottling
Company of Los Angeles' property resulting from the City ofBremerton's use, maintenance or
repair of the stormwater fucilities installed.

VIREMENT FOR C
Mr" Charles Haselwood and Coca Cola Inc. have proposed the dedication of rights-of-way to the City of
Bremerton for two existing private streets. The streets are described legally in the attached dedications
documents but can be generally described as a portion of West Hills Boulevard approximately 700 feet long and
located north of Haselwood Street and a portion of Haselwood Street approximately 460 feet long and located
east of Union Avenue. The streets to be dedicated were constructed in accordance with the City Street Standards
and were inspected by the Department of Public Works and Utilities during their construction. Improvements to
the streets included paving, curb and gutter, sidewalk, street lighting and storm drainage improvements" The
storm drainage system for these streets will also be dedicated to the City of Bremerton along with the necessary
easements" A condition of accepting the proposed dedications is a Iequirement that the City of Bremerton agrees
to maintain and manage these rights-of-way pursuant to State law and City Code and policies. Staff recommends
passage of the proposed Resolution.

WHEREAS, all necessary utility easements have been prepared; and
WHEREAS, the adjacent property owners have agreed in writing to the on-street parking provided; and
WHEREAS, the streets have been properly signed per City of Bremerton standards and the Manual of
Uniform Traffic Control Devices; and
WHEREAS, the builder of the streets has posted a two-year bond for any maintenance or necessary repairs
during the first two years of operation; and
WHEREAS, the streets will be utilized by the public for access to the properties abutting these streets and
general traffic circulation in this area; and
WHEREAS, as a condition of accepting the proposed dedications, the City of Bremerton will agree to
maintain and manage these rights-of-way pursuant to State law and City Code and policies;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BREMERTON THAT:
