The City Engineer has reported as folloas~ "The description furnished the city has a major weakness in that it describes the property being purchaoed as being *Chat por~ou lying westerly of the TracyCon Road right-of-way as the same existed on 5uly 17, 1974,' ~mpossible Co describe chis road rifht-of-wny because ic solely because of public use and not by dedication, purchase, or transfer of property. It is my opinion that to establish of right-of-way and hence the wast margin of Tracycon Road would require etcher deeding of the right-of-way to the County by the present .~Bsmo or court action b7 the County to establish the right-of-way, both as Co a~iSrdnent sndwid~h." I have discussed the City Engineer's memorend~mwiCh A88iaConC City Attorney John Jackson vho concurs in the opinion of the City Engineer. ?oasibly the County Engineer would be w~llin8 Co work up a legal descripC~on for the exiscin8 road for the purpose of a deed of dedication from ~he owner(s). Situate in Kitsap County, Washington. June 14, 1974 To: City Clerk From: City Engineer Subject: Scenic Drive - Tracyton Road Section 11, Twp 24 North, Range 1 East, ~'.M. The legal description which is the last page of the enclosure to your memorandum dated May 20, 1974 is the best available at this time. However, this description has a major weakness in that it describes the property being purchased as being "that portion lying westerly of the Tracyton Road right of way as the same existed on July 17, 1973." It is impossible to describe this road right of way because it exists solely because of public use and not b~ dedication, purchase, or transfer of property. It is my opinion that to establish the width of right of way and hence the '~est margin of Tracyton Road would reqtLi~e either deeding of the right of way to the County by the present owners or court action by the County to establish the right of way, both as to alignment and width. Jarstad ~ayor of City or Bremerton ity Hall 'emerton, Washington 98310 ear Sir: Jrsuant to your request that I inspect the waterfront abutting upon the following descrlbed property; Beginning at the NW corner or Sectiont~, ;ownship 24 N, Range 1 E, W.M., running thence E 657 feet~ thence S 647.5 feet; thence W 57.02 reef; thence S 72.42 feet; thence W 125.92 feet; thence N 72.42 feet; thence W 345 feet; thence S to tl~e meander llne; thence NW'Iy along meander llne to S llne or N 175 feet oK'Lot 9, Section 10, Township 24 N, Range 1 E, W.M.; thence E to the E liner'or said~^Lot 9; thence N 175 feet to the true point of beginning. Situate in Kitsap County, Washington. Subject property is in excess o£ 660 front reef. ~e Tracyton Road is so situated in its nearness to the bank or Dyes Inlet that fhere is no room Jildlng, and in portions there is not enough room to park a car orr the county right of' way. Water- ~nt properties on Dyes Inlet have been selling from $225.00 to $325.00 per front foot. All sales und had sufficient area to construct improvements upon. ,bject would have value to property owners across the County Road, but to expose the waterfront ,ly to the market a buyer desiring waterfront with all the red tape entailed in getting filling .~rmlts would not pay more than $25.00 per front foot for subject type or property. is my opinion that the Market Value of subject property would be; 660 front feet @ $25.00 per front foot or $16,500.00. Respectful ly submitted, B:ca June 26, 1973 The Bremerton City Council 239 Fourth Street Bremerton, Washington Gentlemen: We have been interested in the City's long range plans of developing the Tracyton Beach Drive as a publicly owned scenic beach drive, and as we are the owners of 660 feet frontage along this beach drive we would be interested in negotiating with the City of Bremerton so that you may obtain ownership of this particular beach frontage. Our proposal is one that will involve a cost factor related to installation of water service lines on adjacent property and this will be the basis of the price for the waterfront property. We feel that this can be a fine asset to the City of Bremerton, and we are interested in further discussing this proposal with you. S i~ac er e ly~.s, ~ / ~, ../
