It appearing to the Commissioner of Public Lands that Application
No. 34142 has been filed in this office by CITY OF BREMERTON for an easement
for right of way for a sanitary sewer over vacated oyster reserve in front
of Government Lot 5, Section 9 and Government Lot 2, Section 16, Township 24
North, Range 1 East, W. M., in Kitsap County; and
It further appearing that the applicant is proposing to construct
over said land covered by said application a sanitary sewer; that the land
within the right of way so applied for is limited to an amount necessary for
the purpose required, together with sufficient land on either side thereof
for ingress and egress to maintain and repair the same; and
It further appearing that there is no merchantable timber on the
area covered by said application; that the land required for the right of
way has a value of $100.00; and the Commissioner being fully advised and
believing that an easement for right of way should be granted, it is therefore
ORDERED and DETERMINED that the full value of the land included in
said Application No. 34142 be and the same is hereby fixed at $100.00; that
the total amount has been paid; and the right, power, privilege and authority
to construct, operate and maintain a sanitary sewer upon and over the land
hereinafter described may be exercised in accordance with the provisions of
Chapter 73, Session Laws of 1961; the land included within said right of way
being more particularly described as follows;
All tidelands including tidelands in Vacated State Oyster Reserve
Plats Numbered 59½ and 86, owned by the State of Washington, in front of
Government Lot 5, Sec_t~o_~9~and Government Lot 2, Sectio~ 6, Township 24
North, Range 1 East, W. M., included within the limits of a strip 15
feet in width, having 7½ feet of such width on each side of the
following described centerline:

Beginning at a point on the west side of said Government Lot 2,
said Section 16, which is S It° 11' 16" W 953.42 feet from the
west meander corner on the north line thereof, running thence

thence N 34° 36' 39" W 41.57 feet, thence N 0° 56' 46" E 281.81
feet, thence N 5° 10' 14" W 300.00 feet, thence N 4° 59' 26" E
300.00 feet, thence N 3° 53' 24" E 269.88 feet, thence N 1° 48' 55" E
98.25 feet, thence on the arc of a curve to the right, having a radius
of 200 feet, a distance of 301.88 feet, to the point of tangent to
said curve, said tangent bears N 88° 18' t7" E, thence N 88° 32' 10" E
60.38 feet, thence S 81° 18' 3~~ E 30.10 feet, thence on the arc of
a curve to the right, having a radius of 200 feet, a distance of
122.50 feet to the point of tangent to said curve, said tangent bears

a radius of 200 feet, a distance of 97.11 feet, to the point of
tangent to said curve, said tangent bears S 37° 49' 08" W, thence
S 37° 49' 08" W 18.99 feet, thence on the arc of a curve to the
left, having a radius of 200 feet, a distance of 115.60 feet to the
point of tangent to said curve, said tangent bears S 4° 42' 09I' W,
thence S 4° 42' 09" W 56.82 feet, thence S 15° 07' 43" W 136.35 feet,
thence on the arc of a curve to the left, having a radius of 200.00
feet, a distance of 66.52 feet, thence S 3° 56' 32" W 83.69 feet,
thence S 2° 54' 51" E 335.19 feet, thence S 13° 01' 38" W 160.65
feet, thence on the arc of a curve to the left having a radius of 200
feet, a distance of 69.56 feet, to the point of tangent to said curve,
said tangent bears S 6° 54' 32" E, thence S 6° 54' 37" E 345.46 feet,
thence S 15° 06' 28" W 224.28 feet, thence S 22° 52' 44" E 92.58
feet, thence on the arc of a curve to the rlght, having a radius of
200 feet, a distance of 51.52 feet, thence S 8° 07' 04" E 150.22
feet, thence S 6° 24' 24" E 202.28 feet, thence on the arc of a
curve to the right, having a radius of 200 feet, a distance of
125.69 feet, thence S 29° 35' 06" W 153.70 feet and thence on the
arc of a curve to the left, having a radius of 200 feet, a distance
of 103.84 feet to the termlnat point of this centerline description
which is S 0° 36' 50" W 1,263.78 feet from the east meander corner
on the north line of said Government Lot 2, Section 16, having a
total area of 0.36 acre, as shown on the plats thereof on file in
the office of the Commissioner of Public Lands at Olympia, Washington.
PROVIDED, however, that should the City of Bremerton ever abandon
the use of the right of way for the purposes for which it was granted, the right
of way shall revert to the State of Washin~n or its grantee. Dated this 9 ~
