Home My WebLink About886100 QUIT CLAIM DEED FOR ROAD AND UTILITY PURPOSES Comes now PUGET SOUND POWER $ LIGHT COMPANY, a Washington corporation, and does herewith quit claim and convey, together with after acquired title, unto the CITY OF BREMERTON, for public road purposes, those portions of Wilkes Avenue and Kean Street, being two strips of land, each 30 feet in width, and being the west and the south- west 30 feet of the following described parcel of land, located in the County of Kitsap, State of Washington, to wit: That portion of Section 21, Township 24 north, Range 1 east, W. M., described as follows: Beginning at a concrete monument set on the northerly line of County Road No. 150, said monu- ment being set at the corner common to the southeast and southwest quarters of Section 16 and the northeast and north- west quarters of Section 21 in said Township and Range; thence along the northerly line of said road, north 89048'48'' east 85§.61 feet, to its intersection with the northerly prolongation of the center line of Wilkes Avenue; thence along said northerly prolongation and along said center line south 0°13'12'' east 306.01 feet, to. the true point of beginning; thence continuing along said center line, south 0°13'12'' east 77.68 feet. to the beginning of a curve to the right having a radius of 263.74 feet and a central angle of 25°37'58"; thence southwesterly along said curve a distance of 117.99 feet; thence continuing along said center line south 25°24'46'' west 364.20 feet, to its intersection with the center line of Keen Street; thence along the center line of Keen Street, south 64°35'14'' east 60.5g feet, to the beginning of a curve to the right having a radius of 621.3~ feet and a central angle of 24°52'06"; thence south- easterly along said curve, a distance of 269.68 feet; thence continuing along said center line, south 39043'08'' east 469.69 feet, to the beginning of a curve to the right having a radius of 492.45 feet and a central angle of 15°22'15"; thence southeasterly along said curve, a distance of 132.12 feet, to the east line of the tract of land conveyed to Arcair Company by. the United States of America, by quit claim deed dated October 6, 1958, and recorded in Volume 679, at page 366 of Deeds, records of said Kitsap County, Washington; thence along said east line, north 0°34'22'' east 160.04 feet; thence north 2°55'27'' west 4gl.~0 feet; thence north 89°47'00'' east 30.00 feet; thence north 0034'22'' east 125.00 feet; thence leaving said east line, south 89047'00'' west 175.00 feet; thence north 0034'22'' east 350.00 feet; thence north 78039'22'' west 296.57 feet to the true point of beginning. There is further conveyed all water lines and sanitary sewer lines within said streets. There is further herewith conveyed an easement for the main- tenanee of the existing sanitary sewer lines on what was heretofore known as Houle Street within the above described parcel; provided ~ however, that this easement shall be terminable by Grantor at any time by the recording of a written declaration thereof with the ~ Auditor of Kitsap County; provided however, that said G~antor shall be obligated prior to the discontinuance of said easement to install a connection for the sanitary sewer line between the existing sanitary sewer line at the intersection of Houle and Wilkes Streets, on Wilkes Street to its intersection with Kean Street. And there is further herewith conveyed the sanitary sewer line and an easement for the maintenance of said existing sanitary sewer line where it begins on the easterly line of the tract of land hereinabove described which was conveyed to Puget Sound Power $ Light Company by Warranty Deed dated December 26, 1961, and recorded in Volume 7~, pages 230 and 231 of Deeds, records of said Kitsap County. The location of said sewer line is described as follows: Beginning at a point on the east line of said property above referred to, said point being north 0034'22" east 160.04 feet, from the most southeasterly corner of said property, and hereinafter referred to as Point "A"; thence north 72035'57'' west, 170.35 feet, to intersect the existing sewer located in the center of Kean Street; ALSO beginning at said Point "A"; thence north 35059'27'' west 174.10 feet to intersect the existing sewer located in the street known as Houle Street, provided, however, that upon discontinuation of the use of the Houle Street sewer system this easement shall likewise cease. As a consideration for this conveyance the City of Bremerton shall maintain the water and sanitary sewer pipelines and service in connection therewith for the benefit of the portion of the parcel ~ above described remaining after this conveyance; and further, shall ~ maintain the Whole width of Wilkes Avenue and Kean Street as public i~ roads. Grantor shall have the right to enter upon Wilkes Avenue and excavate for the purpose of making alterations to the sanitary sewer line and the re-location of the connections therewith. As a further consideration, the Grantee does herewith waive any rights of any nature which it may have for water or any sewer. ___ lines or the maintenance thereof within that portion of the parcel above described; excepting however, its terminable easement upon Houle Street as above set forth.
