Re: City of Bremeton/Gordon
Property at 4318 "D" Street
Dear Ian:
Land Title Company has agreed to issue a title policy on the
Gordon property without the necessity of our going through a quiet
title action to clear off Exception No. 6 from the preliminary
title commitment (the Dollar and Robichaud Deed of Trust). The
title company has asked for a letter of indemnity from the City of
Bremerton and has asked us to prepare that letter.
I have prepared the enclosed proposed form of letter for you
to give to Land Title Company. I have not reviewed the form with
the title company, but it should satisfy their requirements.
The potential exposure to Bremerton as the result of giving
this indemnity should be minimal. Under the case authority JVakJrer
v.Benson&McLaughlin, 79 Wn. App. 739 (1995), enforcement of the deed
of trust should be barred by the statute of limitations.
Please call me with your comments.

quieltitle and restrain the trustee's sale, contending the
foreclosure is barred by the statute of limitations, The
Superior Cowt denied the Walckers' motion for
summary judgment and dismissed their action. The
cowt held that the secwity provided by a deed of trust
continues indefinitely, and that, while the statute of
limitations bars a judicial remedy on the underlying
note, it does not extinguish the debt.
[I] The sole issue in this appeal is whether the right
of nonjudicial foreclosure of a deed of trust extends
beyond the limitation period for enforcement of the
underlying debt.
[2] Where, as here, there are no disputed facts, the
issue on swmnary judgment is a question ofIaw, which
the appellate court reviews de novo, Rivell v, Tacoma,
123 Wash.2d 573, 578, 870 P.2d 299 (1994),
[3] A six-year limitation period applies to actions
based on written agreements, including demand notes.
RCW 4.16,040; Chatas v. Levas, 14 Wash,2d 317,
321,128 P.2d 284 *742 (1942). The period begins
to run at the time the note was executed, Chatas, 14
Wash,2d at 321, 128 P,2d 284, Here, Benson and
McLaughlin initiated its nonjudicial foreclosure more
than six years after the WaIckers executed the note; the
Walckers contend the six-year limitation period bars
the foreclosure,
At common law, a mortgage existed separately from
the obligation it secured; therefore, even when the
statute of limitations had run on an underlying debt, a
mortgagee still could foreclose on the mortgage, I
Grant S, Nelson & Dale A. Whitman, Real Estate
Finance Law ~ 6,11, at 523-24 (3d ed, 1993); see
Jardan v, Bergsma, 63 Wash.App, 825, 829, 822 P,2d
319 (1992), This was in part because the equitable
foreclosure action was not governed by the legal statute
of limitations defense, Nelson & Whitman, ~ 6,]] at
524, and in part because the expiration of the limitation
period "bars merely the remedy on the debt, not the
right.' Nelson & Whitman, ~ 6,11 at 525, At least for
mortgages, the Washinglon Legislature has abandoned
this common law rule in RCW 7,28.300, which
provides:
Quieting title against outlawed mortgage, The
record owner of real estate may maintain an action to
quiet title against the lien of a mortgage on the real
estate where an action to foreclose such mortgage
would be barred by the statute of limitations, and,
upon proof sufficient to satisfy the court, may have
judgment quieting title against such mortgage lien.
Page 2
The question in this case is whether this statute, or the
common law rule, applies to nonjudicial foreclosure of
deeds of trust, when the limitation period has expired
on the underlying debt.
Although the distinction between a [deed of trust] and
a regular mortgage is becoming increasingly less
significant, it has not been totally destroyed, One of
the most important persisting notions is that it, like
other trusts, continues until the performance of the
trust pUlpose, viz., the payment of the debt for which
the trust was created. One result is that there is no
time limit on it except as specifically provided by
statute, *743 Barring of the remedy on the debt has
no effect upon the trustee's power to sell the property
and pay the debt with the proceeds,
[904 P,2d 1178] Nelson & Whitman ~ 6,1], at
527-28 (Emphasis added) (Footnotes omitted), __
[4] Here, the Walckers make essentially two
arguments. First, they contend the deed of trust is
merely a device to secure payment of the underlying
debt; if collection of the debt is barred, they argue, the
agreement secwing it also must be unenforceable. This
argument ignores the common law rule, In addition, a
statute of limitation does not invalidate a claim, but
rather 'deprives a plaintiff of the opportunity to invoke
the power of the cowts in support of an otherwise valid
claim,' Stenberg v. Pacific Power & Light Co" 104
Wash.2d 7]0, 714, 709 P,2d 793 (1985), Here,
Benson and McLaughlin has invoked a nonjudicial
proceeding to enforce its deed of trust, and the statute
of limitations does not directly apply, because the
cowt's power is not being invoked, See Jordan v,
Bergsma, 63 Wash.App. at 829-30, 822 P.2d 319,
Second, the Walckers argue that RCW 61.24,020
abrogates the conunon law rule as it applies to deeds of
trust. The statute provides in pertinent part:
Deeds subject to all mortgage laws.... Except as
provided in this chapter, a deed of trust is subject to
all laws relating to mortgages on real property, A
deed conveying real property to a trustee in trust to
secure the performance of an obligation of the grantor
or another to the beneficiary may be foreclosed as in
this chapter provided, The county auditor shall
record such deed as a mortgage and shall index the
name of the grantor as mortgagor and the names of
the trustee and beneficiary as mortgagee,
Copyright (c) West Group 1997 No claim to original U,S, Govt, works
Washington's deed cftrust statute, RCW 61.24, does
79 Wn.App 739,904 P,2d 1176, Walcker v. Benson and McLaughlin, PS, (Wash App, Div, 3 1995)
not refer to any limitation period for nonjudicial
foreclosures. Thus, under the plain language of RCW
61.24,020, the limitation period for foreclosure of
mortgages should apply, See Department af Licensing
v, Lax. 125 Wash,2d 818, *744 822,888 P,2d 1190
(1995) (Court must give effect to plain meaning of
statutory language). RCW 7,28,300, which makes the
statute ofJimitations a defense in mortgage foreclosure
proceedings, therefore should apply to deeds of trust as
well, As Division One of this court noted in dictum,
"As a policy matter there appears to be no compelling
reason to distinguish deeds of trust from mortgages
insofar as the right to quiet title when the underlying
obligation is barred by the statute of limitations."
Jordan v, Bergsma, 63 Wash.App, at 831, 822 P,2d
3]9,
The Supreme Court has agreed that, for most
purposes, mortgages and deeds of trust should be
treated similarly:
[0 Jur fIrst inquiry is whether the deed of trust act
ereates a species of mortgage, The authorities are in
strong agreement that it does. I Glenn on Mortgages
g 20, at 123 (1943) states: "The trust deed was well
known at the beginning of the nineteenth centlU}', and
the courts had little difficulty in treating the device as
a mortgage in effect." Glenn characterizes the trust
deed as in effect a power of sale mortgage with the
power of sale resting in a third person, the trustee,
rather than in the mortgagee. G, Osborne, Mortgages
g 17, at 26-27 (2d ed, 1970), while noting the
obvious differences in the operation of straight
mortgages and trust deed mortgages, primarily in the
manner of foreclosure, often refers to a deed of trust
as a "trust deed mortgage." State courts have
concWTed.
Rustad Heating & Plumbing Co, v, Waldt, 91
Wash,2d 372,375,588 P.2d 1153 (1979),
However, Benson and McLaughlin argues that
because the deed of trust act specifically ereated a
separate, nonjudicial remedy procedure, the limitation
period for foreclosure of mortgages should not apply.
It relies on the following language from Rustad
Heating & Plumbing:
It should be clear we are not holding that in all
circumstances the word "mortgage" as used in every
statute is to include deeds of trust as well, Where a
statute using the teoo "mortgage' relates to remedies
specifically covered by the deed of trust act of ] 965,
the act would govern and the tenn *745 "mortgage"

would refer to instruments other than deeds of trust.
[904 P,2d 1179] Rustad Heating & Plumbing, 91
Wash,2d at 376, (FN3) 588 P,2d I 153, Benson and
McLaughlin's argument that no mortgage rules will
apply to nonjudicial foreclosure of trust deeds is not
supported by other authorities, See Glidden v,
Municipal Authority of Tacoma, III Wash.2d 341,
347 n, 3, 758 P2d 487, 764 P.2d 647 (1988)
("[O]mitted junior lienor" rule of mortgage law may
apply to nonjudicial foreclosure of trust deed); Wyall
Stapper Architects, P,S. v. 1501 Pacific Assocs" 60
Wash,App. 842, 845, 809 P2d 206 (1991) (priority
questions under nonjudicial foreclosure of trust deed to
be decided by general mortgage law),
Benson and McLaughlin also argues public policy
supports an unlimited right to foreclose deeds of trust,
It points out that statutes of limitations are narrowly
construed, and that application of RCW 4, I 6,0.12
would discharge a valid obligation, not just a right to
sue, It also argues that a primary reason for statutes of
limitations is preservation of judicial resources, and
that nonjudicial foreclosure has no effect on court time
or resources; an unrestricted right of foreclosure would
encourage lenders and creditors to use deeds of trust
instead of mortgages, further conserving judicial
resources, Finally, it argues, there would be greater
certainty in the status oftilles.
We are unpersuaded by Benson and McLaughlin's
policy argument. It is unclear how an unlimited right to
foreclose on a deed of trust would provide greater
certainty of titles rather than the converse,
Fwthennore, the goal of statutes of limitations is to
force claims to be litigated while pertinent evidence is
still available and while witnesses retain clear
impressions of the occWTence, Summerrise v,
Stephens, 75 Wash.2d 808, 811, 454 *746. P.2d 224
(] 969), Our policy is one of repose; the goals are to
eliminate the fears and burdens of threatened
litigation and to protect a defendant against stale
claims, Ruth v. Dight, 75 Wash,2d 660, 664, 453
P,2d 631 (1969),
Stenberg v, Pacific Power & Light Co" 104 Wash,2d
at 714, 709 P,2d 793,
These goals are generally applicable in foreclosure
proceedings, whether based on mortgages or deeds of
trust, Nor is it clear that an unlimited foreclosure
period would conserve judicial resources, Indeed, the

Under the case authority Wakker
v. Benson & McLaughlin, 79 Wn. App. 739 (1995), enforcement of the deed
of trust should be barred by the statute of limitations.
Please call me with your comments.

Court of Appeals of Washington, Division 3,
Panel Three.
Nov. 9, 1995.
Reconsideration Denied Dec. 6, 1995.
Makers of deed-of-trust note brought action to quiet title and to restrain
nonjudicial foreclosure sale of deed-of-trust property on theory that
foreclosure was barred by statute of limitations. The Superior Court, Chelan
County, Ted Small, J., denied plaintiffs' motion for summary judgment and
entered order dismissing their action, and plaintiffs appealed. The Court of
Appeals, Thompson, C.J., held that creditor had no right to nonjudicially
foreclose deed of trust once statute of limitations for enforcement of
underlying deed-of-trust note had expired.

Elmer and Stella Walcker appeal the Superior Court's order dismissing their
action to quiet title. They contend that, because the statute of limitations
has expired on enforcement of the underlying promissory note, *741 Benson and
McLaughlin, P.S., should not be permitted to proceed with its nonjudicial
foreclosure of a deed of trust. We agree.
On September 4, 1986, the Walckers executed a demand promissory note in favor
of [904 P.2d 1177] Benson and McLaughlin, apparently to settle an account for
professional services. (FN1) The Walckers also executed a deed of trust to
secure the note. The Walckers never made payment, and Benson and McLaughlin
never took legal action to obtain judgment on the note.
Benson and McLaughlin initiated a nonjudicial foreclosure proceeding (FN2) on
December 23, 1993, more than six years after the execution of the promissory
note. The Walckers then filed this action to quiet title and restrain the
trustee's sale, contending the foreclosure is barred by the statute of
limitations. The Superior Court denied the Walckers' motion for summary
judgment and dismissed their action. The court held that the security provided
by a deed of trust continues indefinitely, and that, while the statute of
limitations bars a judicial remedy on the underlying note, it does not

extinguish the debt.
[1] The sole issue in this appeal is whether the right of nonjudicial
foreclosure of a deed of trust extends beyond the limitation period for
enforcement of the underlying debt.
[2] Where, as here, there are no disputed facts, the issue on summary
judgment is a question of law, which the appellate court reviews de novo.
Rivett v. Tacoma, 123 Wash.2d 573, 578, 870 P.2d 299 (1994).
[3] A six-year limitation period applies to actions based on written
agreements, including demand notes. RCW 4.16.040; Chatos v. Levas, 14 Wash.2d
317, 321, 128 P.2d 284 *742 (1942). The period begins to run at the time the
note was executed. Chatos, 14 Wash.2d at 321, 128 P.2d 284. Here, Benson and
McLaughlin initiated its nonjudicial foreclosure more than six years after the
Walckers executed the note; the Walckers contend the six-year limitation period
bars the foreclosure.
At common law, a mortgage existed separately from the obligation it secured;
therefore, even when the statute of limitations had run on an underlying debt, a
mortgagee still could foreclose on the mortgage. 1 Grant S. Nelson & Dale A.
Whitman, Real Estate Finance Law ~ 6.11, at 523-24 (3d ed. 1993); see Jordan v.
Bergsma, 63 Wash.App. 825, 829, 822 P.2d 319 (1992). This was in part because
the equitable foreclosure action was not governed by the legal statute of
limitations defense, Nelson & Whitman, ~ 6.11 at 524, and in part because the
expiration of the limitation period "bars merely the remedy on the debt, not the
right." Nelson & Whitman, ~ 6.11 at 525. At least for mortgages, the
Washington Legislature has abandoned this common law rule in RCW 7.28.300, which
provides:
Quieting title against outlawed mortgage. The record owner of real
estate may maintain an action to quiet title against the lien of a mortgage
on the real estate where an action to foreclose such mortgage would be barred
by the statute of limitations, and, upon proof sufficient to satisfy the
court, may have judgment quieting title against such mortgage lien.
The question in this case is whether this statute, or the common law rule,
applies to nonjudicial foreclosure of deeds of trust, when the limitation period
has expired on the underlying debt.
Although the distinction between a [deed of trust] and a regular mortgage is
becoming increasingly less significant, it has not been totally destroyed.
One of the most important persisting notions is that it, like other trusts,
continues until the performance of the trust purpose, viz., the payment of
the debt for which the trust was created. One result is that there is no
time limit on it except as specifically provided by statute. *743 Barring
of the remedy on the debt has no effect upon the trustee's power to sell the
property and pay the debt with the proceeds.

[904 P.2d 1178] Nelson & Whitman S 6.11, at 527-28 (Emphasis added)
(Footnotes omitted).
[4] Here, the Walckers make essentially two arguments. First, they contend
the deed of trust is merely a device to secure payment of the underlying debt;
if collection of the debt is barred, they argue, the agreement securing it also
must be unenforceable. This argument ignores the common law rule. In addition,
a statute of limitation does not invalidate a claim, but rather "deprives a
plaintiff of the opportunity to invoke the power of the courts in support of an
otherwise valid claim." Stenberg v. Pacific Power & Light Co., 104 Wash.2d 710,
714, 709 P.2d 793 (1985). Here, Benson and McLaughlin has invoked a nonjudicial
proceeding to enforce its deed of trust, and the statute of limitations does not
directly apply, because the court's power is not being invoked. See Jordan v.
Bergsma, 63 Wash.App. at 829-30, 822 P.2d 319.
Second, the Walckers argue that RCW 61.24.020 abrogates the common law rule
as it applies to deeds of trust. The statute provides in pertinent part:
Deeds subject to all mortgage laws.... Except as provided in this
chapter, a deed of trust is subject to all laws relating to mortgages on real
property. A deed conveying real property to a trustee in trust to secure the
performance of an obligation of the grantor or another to the beneficiary may
be foreclosed as in this chapter provided. The county auditor shall record
such deed as a mortgage and shall index the name of the grantor as mortgagor
and the names of the trustee and beneficiary as mortgagee.
Washington's deed of trust statute, RCW 61.24, does not refer to any
limitation period for nonjudicial foreclosures. Thus, under the plain language
of RCW 61.24.020, the limitation period for foreclosure of mortgages should
apply. See Department of Licensing v. Lax, 125 Wash.2d 818, *744 822, 888
P.2d 1190 (1995) (Court must give effect to plain meaning of statutory
language). RCW 7.28.300, which makes the statute of limitations a defense in
mortgage foreclosure proceedings, therefore should apply to deeds of trust as
well. As Division One of this court noted in dictum, "As a policy matter there
appears to be no compelling reason to distinguish deeds of trust from mortgages
insofar as the right to quiet title when the underlying obligation is barred by
the statute of limitations." Jordan v. Bergsma, 63 Wash.App. at 831, 822 P.2d
319.
The Supreme Court has agreed that, for most purposes, mortgages and deeds of
trust should be treated similarly:
[O]ur first inquiry is whether the deed of trust act creates a species of
mortgage. The authorities are in strong agreement that it does. 1 Glenn on
Mortgages S 20, at 123 (1943) states: "The trust deed was well known at the
beginning of the nineteenth century, and the courts had little difficulty in
treating the device as a mortgage in effect." Glenn characterizes the trust
deed as in effect a power of sale mortgage with the power of sale resting in

a third person, the trustee, rather than in the mortgagee. G. Osborne,
Mortgages ~ 17, at 26-27 (2d ed. 1970), while noting the obvious differences
in the operation of straight mortgages and trust deed mortgages, primarily in
the manner of foreclosure, often refers to a deed of trust as a "trust deed
mortgage." state courts have concurred.
Rustad Heating & Plumbing Co. v. Waldt, 91 Wash.2d 372, 375, 588 P.2d 1153
(1979) .
However, Benson and McLaughlin argues that because the deed of trust act
specifically created a separate, nonjudicial remedy procedure, the limitation
period for foreclosure of mortgages should not apply. It relies on the
following language from Rustad Heating & Plumbing:
It should be clear we are not holding that in all circumstances the word
"mortgage" as used in every statute is to include deeds of trust as well.
Where a statute using the term "mortgage" relates to remedies specifically
covered by the deed of trust act of 1965, the act would govern and the term
*745 "mortgage" would refer to instruments other than deeds of trust.
[904 P.2d 1179] Rustad Heating & Plumbing, 91 Wash.2d at 376, (FN3) 588 P.2d
1153. Benson and McLaughlin's argument that no mortgage rules will apply to
nonjudicial foreclosure of trust deeds is not supported by other authorities.
See Glidden v. Municipal Authority of Tacoma, 111 Wash.2d 341, 347 n. 3, 758
P.2d 487, 764 P.2d 647 (1988) ("[O]mitted junior lienor" rule of mortgage law
may apply to nonjudicial foreclosure of trust deed); Wyatt Stapper Architects,
P.S. v. 1501 Pacific Assocs., 60 Wash.App. 842, 845, 809 P.2d 206 (1991)
(Priority questions under nonjudicial foreclosure of trust deed to be decided by
general mortgage law) .
Benson and McLaughlin also argues public policy supports an unlimited right
to foreclose deeds of trust. It points out that statutes of limitations are
narrowly construed, and that application of RCW 4.16.040 would discharge a valid
obligation, not j'ust a right to sue. It also argues that a primary reason for
statutes of limitations is preservation of judicial resources, and that
nonjudicial foreclosure has no effect on court time or resources; an
unrestricted right of foreclosure would encourage lenders and creditors to use
deeds of trust instead of mortgages, further conserving judicial resources.
Finally, it argues, there would be greater certainty in the status of titles.
We are unpersuaded by Benson and McLaughlin's policy argument. It is unclear
how an unlimited right to foreclose on a deed of trust would provide greater
certainty of titles rather than the converse. Furthermore, the goal of statutes
of limitations is to
force claims to be litigated while pertinent evidence is still available and
while witnesses retain clear impressions of the occurrence. Summerrise v.
Stephens, 75 Wash.2d 808, 811, 454 *746. P.2d 224 (1969). Our policy is one

Ruth v. Dight,
Stenberg v. Pacific Power & Light Co., 104 Wash.2d at 714, 709 P.2d 793.
These goals are generally applicable in foreclosure proceedings, whether
based on mortgages or deeds of trust. Nor is it clear that an unlimited
foreclosure period would conserve judicial resources. Indeed, the owner of
record facing nonjudicial foreclosure of a deed of trust may ask a court to
restrain the sale by "contest [ing] the alleged default on any proper ground."
RCW 61.24.030(6) (j); see RCW 61.24.130. Any such action certainly would expend
judicial resources, as this case has demonstrated.
The plain language of RCW 61.24.020 states that, " [e]xcept as provided" in
the deed of trust act, mortgage law applies to foreclosure of deeds of trust.
The act does not address the applicability of statutes of limitations.
Therefore, RCW 7.28.300, which expressly makes the statute of limitations a
defense in mortgage foreclosure proceedings, applies to foreclosure of trust
deeds as well. Because Benson and McLaughlin failed to initiate its foreclosure
within the applicable six-year limitation period, the foreclosure should be
barred.
We reverse the Superior Court's order and remand for entry of summary
judgment in favor of the Walckers.
MUNSON and SCHULTHEIS, JJ., concur.

Dear Jackie:
On November 12, 1996, 1 last corresponded with you regarding this matter. At that time, Mr.

Mr. Dollar tells me that the subject property has been tom down, I assume the City acquired it.

Re:
Dear Chris:
This letter will follow up our recent telephone conversations
regarding the above policy. Bremerton purchased the property from
Carol A. Gordon by Statutory Warranty Deed dated January 29, 1997,
recorded February 19, 1997 under Kitsap County Auditor's File
No. 3002435.
Nina at the City of Bremerton indicates that at closing it
paid Land Title the policy premium of $216.20 (including tax). We
would like to clear up the title issues prior to issuance of the
policy. There are two deeds of trust shown as special exceptions
5 and 6 of Schedule B-1 of the commitment which need to be removed.
The following are my comments on each:
a. Exception #5 refers to a Deed of Trust from Dollar
and Robichaud, as grantor, for the benefit of Gary B. Moe and
Iris E. Moe, as beneficiaries. Enclosed is the original Deed of
Trust referred to, on which the Moes' have signed a request for
full reconveyance. We do not know the whereabouts of the original
note. Land Title is the trustee, and we would ask that you execute
a full reconveyance to clear the deed of trust of record. If you
wish to contact Mr. and Mrs. Moe, the last address we have for them
is: 8309 - 189th Avenue E., Bonney Lake, Washington 98390.
Ms. Chris Mihulka
May 14, 1997
Page 2
b. Exception #6 refers to a Deed of Trust dated
September 20, 1983 in which Ralph Hanson and Sharla Dollar are
Grantor, Chicago Title is trustee, and Robert Dollar and Mimi
Robichaud are beneficiaries, to secure an indebtedness of
$4,811.58. Land Title supplemental #3 dated August 6, 1996 also
references the effect of claim of lien recorded under Auditor's
File No. 8512310221, which is a reference to the same deed of
trust. That "claim of lien" dated December 31, 1985, signed by
Mimi Robichaud states that ". . I have not received any monies
after Charla Dollar and Ralph Hanson quick (sic) claimed this
property back to Gary Moe in Luie (sic) of forecloser (sic)."
Absent any payment upon the note and deed of trust (which
presumably is the case), the deed of trust and the promissory note
which is secured are both barred by the six year limitation period
of R. C. W. 4.16.040. I am enclosing a copy of the State of
Washington Court of Appeals opinion in the case of Walcker v. Benson and
AfcLaughlin, 79 Wn. App. 739 (1995) which holds that the statute of
limitation defense may be asserted in nonjudicial deed of trust
foreclosure proceedings (judicial foreclosure of mortgages barred
by the statute of limitations previously were outlawed by
R.C.W. 7.28.300).
Based upon the fact that this Note and Deed of Trust were made
nearly fourteen years ago, it is almost certain that the statute of
limitations would bar any enforcement of this Deed of Trust. It
was for this reason that we asked if Land Title could insure over
the Deed of Trust, or issue an endorsement (i.e., Form 110.7)
affirmatively insuring against the enforcement or attempted
enforcement of the Deed of Trust.
You have asked that Bremerton indemnify Land Title as a
condition of not showing exception #6 in the title policy. We have
discussed the indemnity with Ian Sievers, the Bremerton City
Attorney, and he will consider having the City of Bremerton provide
such an indemnity. We would appreciate your providing us the form
of your requested indemnity and we will present it to Ian Sievers
for his approval.

Re: Robert Dollar
P.O. Box 703
Bremerton, WA 98310
Dear Ian:
My client, Robert Dollar, has brought me a copy of Jackie Cronk's letter dated June 18, 1996 and
the enclosures, Mr. Dollar is not going to accommodate Ms. Cronk's requesls. He has no legal
duty to reconvey a Deed of Trust that secures a Promissory Note that has neither been paid nor
foreclosed,
My understanding of the facts is that Robert Dollar and Mimi Robichaud purchased the Moe's
property in 1982, In 1983 they sold the property to Mr. Hanson and Ms, Dollar who assumed
the Moe obligation and gave Robichaud and Dollar a Promissory Note and Deed of Trust in the
amount of $4,811.58, Sometime thereafter, Hanson and Dollar gave the Moes a Deed In Lieu
of Forfeiture. The Moes took no action to foreclose or pay Robert Dollar or Mimi Robichaud.
The Moes then sold the property to the Gordons who are now trying to sell it to the City of
Bremerton, The absence of a foreclosure proceeding and Ms. Dollar and Mr. Hanson's failure
to satisfy my client's encumbrance leaves this property lawfully encumbered in favor of Dollar
and Robichaud, It appears to me that if the City wants to acquire lhe fee interest in the property
it needs to negotiate with Mr. Dollar and arrange 10 pay him and Robichaud,
~
-
If you have any questions regarding the status of this matter, or if you or anyone on behalf of
lhe City would like to make a settlement proposal, please leI me know, It appears to me that the
Moes should reduce the amount of any unpaid balance they are claiming from the Gordons by
the amount of the unpaid principal balance, together with interest, owing to Robert Dollar and
Mimi Robichaud.
