In consideration of the City's leaving a slot or opening in
the retaining wall located on the west side of Washington Avenue
between Sixth and llth Streets~ and more particularly that portion
of the retaining wall abutting the undersigned party's property,
which opening or slot is provided upon the request of the under-
signed for the purpose of future construction of a driveway or
other use.
It being further understood that the City has been requested
by the undersigned to slope the existing embankment within the slot~
on a 1/~:1 (one-half to one) slope from a line at least seven feet
west of the westerly or back side of the existing sidewalk; to
adjust the sanitary sewer connection to 653 and 649 Washington
Avenue~ pave the entrance sidewalk~ and pave a strip approximately
6 feet wide back of the public sidewalk and within the slot. The
Contractor to repair the water service line to 653 Washington.
IT IS AGREED that the undersigned will hold the City of ~:.~,~.
Bremerton~ its officers, employees and agents harmless from any
claiTM for damage to private property caused by failure of the earth
embankment supporting the homes west of the slot at any time and
the undersigned will hold the City its Officers~ employees and agents
harmless from any claim caused by loss of stability or any personal
injuries or other damage caused by the failure of said embankment.
