smrvi~ by ~h~ City of Bremerton, the undersigned does hereby promise
and agre~ as follows:
1. That pa~ent of service char~es, assessments and/or
additioRa~ charges required by City Ordinances to be paid for thc
service mentioned above will in no ~ay relieve the above-described ,
property ~rom its share of any future local i~provement district
pa~ents which may be assessed to pay all or a portion of the expense
of installing lain or mains, toRether with neceksary pipe fittings
and all other appurtenances which may be installed to serve a district
which includes the prbperty described above; provided that a credit
for pa~ent heretofore aade shall be allowed toward a local improve-
ment district assessment, ~hen such improvement is o~ the same
character as the service granted under this Agreement.
2. The City shall have the right to inspect any structure or
building on the above-described property to determine whether or not
said buildings have any defects ~hich are unsafe, unsanitary or
any ~ay are detrimental to the ~elfare of :he genoral public or
~he o~mers and occupants of ~he buildincs. Any future ne~v cons:rue-
Lion, alterations, additions or repairs shall meet the requirements
of the City codes ~or Buildings, Plumbing, i:lectrical and Zonin~ and
:he required City permits shall be obtained prior to starting any
3. The undersigned further agrees that he ~ill sign any
leading ~o ~he fu~ure annexation of said property to ~he City of
Bremer~on, when such annexation is deemed advisable by ~hc City, and
will actively pron~ote and participate in any su~ annexation proceedings;
and <hat he ~ill not objec~ to the future formation o{ a local ~mprovc-
m~nt district for se~er for any district wi{ich includes lhe above-
described property. The undersiRned further a~rees tha~ould he not
sign ~he above mentioned petition when required by lhe City, ~ha~ ~ho
City may ~ake whatever steps as are necessary to discontinue sewer
service to ~he proper~y above described, includinl permission to
co~e upon ~he proper~y for such purposes.
4. The undersigned aarecs ~hat in the event of a sale or transfer
of the above-described proper~y, he will, as a condition of such sale
or transfer, require the purchaser, or o~her nelv owner~ ~o si~n a
duplicate copy of this Outside U~ility Agreement. The undersigned
further a~rees ~hat this a~reemcnt, and the promises made herein, do
constitute a covenan~ runninR wi~h th~ land and shall be bindin~ on thc
undersi[ned, his heirs, successors and assigns, and that ~his
shall be filed for recora in ~he office of the Kitsap County Auditor,
and a~ ~he expense of ~he undersigned property
