THE UNDERSIGNED, owner of the following described real
, property within Kitsap County, Washington~ to-wit:
has applied to the City of Bremerton~ Washington ~or city sewer service
~or said property~ and in consideration off the ~urnishing o~ such
service by the City of Bre~erton, the undersigned does hereby promise
and agree as
1. That payment o~ service charges, assessments and/or
additional charges required by City Ordinances to be paid ior the
service mentioned above will in no ~ay relieve the above-described
property from its share of any future local improvement district
pa~ents which may be assessed to pa~ ail or a portion o~ the expense
off installing ~ain or mains~ together with necessary pipe ~ittings
and all other appurtenances which may be installed to serve a district
which includes the prbperty described above; provided that a credit
for pa~ent heretoffore made shall be allowed toward a local improve-
ment district assessment~ when such improvement is o~ the sa~e
character as the service granted under this Agreement.
2. The ~it~ sha~l have the riflht ~o inspect any structure or
building on the above-described property to de:ermine whether or no~
said buildings have any defects ~hiCh are unsa~e, unsanitary or
any way are detrimental to the ~e~fare o~ the general public or to
the o~ers and occupants o~ the buildings. ~y ~uture new construc-
tion, al~erations~ additions or repairs shal~ ~eet the requirements
off the City codes ~or Buildings~ Plumbing, E1ectrical and Zonin~ and
the required ~ity permits shall be obtained prior to starting an~
work.
3. The undersigned further agrees that he will sign any petition
leading to the futu~re annexation of said property to the City of
Bremerton, when such annexa:ion is deemed advisable by ~he City, and
will actively promote and participate in any su& annexation proceedings;
and that he will not object to ~he future formation of a local improve~
ment district for sewer for any district which includes the above-
described property. The undersigned further agrees tha~ould he not
sign ~he above mentioned petition when required by. the City, that the
City may take whatever steps as are necessary to discontinue sewer
service to ~he proper~y above described, including permission
come upon the property for such purposes.
~. The undersigned agrees tha~ in the event of a sale or transfer
of th~ above-d~scribed property, he will, as a condition of such sale
or transfer, require the purchasor, or other new o~er, to sign a
duplicate copy o~ ~his Outside Utility Agreement. The undersigned
further agrees tha~ this agreement, and the promises made herein, do
constitute a covenant running with the land and shall be binding on the
undersigned, his heirs, successors and assigns, and that this agreoment
shall be filed for record in the office of the Kitsap County Auditor,
and at the expense of the undersiRned property o~er.
