OUTSIDE UTILITY AGP~EEMENT
THE UNDEr, SIGNED owner of the following described' real
property within Kitsap County, Washington, to wit:
he North half of Tmact 8; ALSO the West ]5 feet of the South half of Tract 8,
EXCEPT the South 5 feet of the West ]5 feet, all in Card's Acre Tracts Addition
to Decatur, as pem plat recorded in V0]ume 4 of plats, page 30 of Kitsap County,
Washington
has applied to the City of Bremerton, Washington for City sewer
services for said property and, in consideration of the
furnishing of such services by the City of Bremerton, the
undersigned does hereby promise and agree as follows:
1. The owner shall be liable for and shall pay when due,
all sewer charges assessed by the City.
2. The City shall install at owner's cost the in-street main sewer
portion, located on City's Side of the street. The owner shall install, at
owner's cost, all sewer pipe and appurtenances to the point of connection to
the main City sewer. The City will assume maintenance responsibility for the
in-street main sewer portion.
3. No alteration or modification of the terms or
conditions of this Agreement shall be valid and/or binding unless
made in writing and signed by the authorized representatives of
the parties hereto.
4. That payment of service charges, assessments and/or
additional charges required by City ordinances will, in no way,
relieve the above-described property from its share of any future
local improvement district payments assessed to pay all or a
portion of the expense of installing main or mains, necessary
pipe fittings and all other appurtenances which may be installed
to serve a district which includes the property described above;
provided, that a credit for payment heretofore made shall be
allowed toward a local improvement district assessment, when such
improvement is of the same character as the service granted under

5. The City shall have the right to inspect any structure
or building on the above-described property to determine whether
said buildings have any defects which are unsafe, unsanitary or
in any way are detrimental to the welfare of the general public
or to the owners and occupants of the buildings. Any future new
construction, alterations, additions or repairs shall meet the
requirements of the Uniform Building and Uniform Plumbing Codes
latest editions.
6. The owner agrees that this Agreement, and the promises
made herein, constitute a covenant running with the land and
shall be binding on the undersigned, his heirs, successors and
assigns, and that this Agreement shall be filed for record Sn the
office of the Kitsap County Auditor, at the expense of the
undersigned property owner.
7. The owner agrees to save harmless and to defend the
City from all claims and liability due to the negligent acts,
errors or omissions of themselves, their agents and/or employees
in Performing any part of this Agreement. The City shall not be
obligated or liable to owner or to any other party for any claim
whatsoever arising in connection with this Agreement unless the
claims and liability are due to the negligent acts, errors or
omissions of it, its agents and/or employees in performing any
part of this Agreement.
