WtlEREAS the Bremerton Municipal Code requires property 'Outside the city
bonndaries to support annexation to the City of Bremerton as a condition for receiving City
utilities (BMC 15.02.040 and 15.03.040); and
WIIEREAS the City of Bremerton has a primary obligation to its citizens to allocate
limiled service resources for adequate growth and development within the City; and
WIIEREAS the undersigned, as owner of a parcel outside tile City of Bremerton, has
made application for city utilities;
NOW,TIIEREFORE, tile undersigned owner (hereinafter "Owner")of real property

2. Rates and Charge~. Owner shall pay when due all connection charges,
assessments, and rates established for city utilities settees by City ordinance for the Owner's

and development standards of City of Bremerton comprehensive land use plan adopted
pursnant to RCW 35.13.177and any adopted subdivision and street slandards of the City
of Bremerton.

The annexation ~tition sup~rt~ by this Power may include
assumption of the City indebtedness by the ar~ to be annexed. The petition shall require
Ihe concurrent adoption of laud uses designated in any urban fringe compreheusive plan
approved for the annexation ar~ pursuant to RCW 35.13.177, or if none has been adopled,
the land uses for annexed property as set forth in the Bremerton Zoning Code a~ amende~.
This Power of Attorney is nonrevocable.
6. Enforcement. Violation of this Agr~ment may result in the immediate
termination of utilities semites to the above-described property as well as olher remedies
p~ovided by law.
7. Covenauts. The undersigaed further agrees that this Agreement and the promise
made herein constitute a covenant running with the land and shMl be binding upon the
uudersigned and his heirs, successors, aud assigns, and that this Agreement shall be ~led for
record in the or, ce of the Kitsap County Auditor. Owner agrees that any s~le or ~ransfer
o~ Ihe above-describ~ pro~rty will be conditioned ou execution a,d ~ling of
copy of this ontside utility agreement by the purchaser or transferee.
