OUTSIDE UTILITIES AGREEMENT
WIIEREAS the Bmmcrton Municipal Code requires property '~ulside the cily
boundaries to snpport annexation to the City of Bre,nerton as a condition for receiving City
utilities (BMC 15.02.040 and 15.03.040); and
WIIEREAS the City of Bremerton has a primary obligation to its citizens to allocale
Ii,hired service resources for adequate growth and development within the City; and
WIIEREAS the undersigned, as owner of a parcel outside tim City of Bremerton, has
made application for city utilities;
NOW, TIIEREFORE, fl~e undersigned owner (hereinafter "Owner")oi'real properly
located at 776 NE MARRIC COURTt BREMERTON, WA 98310
, Kitsap County, Washington, (hereinafter "Properly'),
legally described as:
LOT 5, PHEASANT RUN, ACCORDING TO PLAT RECORDED IN VOLUME 27 OF PLATS,
PAGES 67 THROUGH 69, IN KITSAP COUNTY, WASHINGTON.
and Ute City of Bremertou (hereinafter "City"), in consideration of Ihe ,nutual covenanls
set forth herein including the furnishing of utilities services by the City of Bremerton, do
hereby promise and agree as follows:
· 1. Services'Providexl. City of Bremerton shall provide utility services cousistent with
service areas defined by the City comprehensive utility plans as amended, and lerms and
conditions of a current ~tier of Availability from the Bremerton Utilities· Department.
2. ~. Owner shall pay when due all connectiou charges,
assessments, and rates ~tablish~ for city utilities se~ices by City ordinance for the Owner's
user class.
3. Use. Devclopmeat of the property described above shall comply with Ihe uses
and development slandards of Cily of Bremerton comprehensive land use plan adopted
pursuant to RCW 35.13.177and any adopted subdivision and street slandards of Ihe Cily

5. ~. Owner, by signing below, grants to the City ofBremerlon a Limited
Power of Attorney lo inclu'de this Agree,neqt as Owner's consent to tile annexation of tile
Property as part of any Notice of Intent or Petition for Annexation presented to tile City of
Bremer[on.
Tile annexation petition supported by this Power may include proportional
assumption of the City indebtedness by tile area to be annexed. Tile petition shall require
the concurrent adoption of land uses designated in any urban fringe comprehensive plan
approved for the annexation area ptsrsuant Io RCW 35.13.177, or if none has been adopted,
the land uses for annexed property as set forth in the Bremerton Zoning Code as amended.
This Power of Attorney is nonrevocable.
6. Enforcement. Violation of Ihi' Agreement may result in tile immediate
termination of utilities services to the above-described property as well as other remedies
provided by law.
7. _~. Tile nndersigned further agrees that this Agreement and Ihe promise
made herein constitute a covenant atoning with the land and shall be binding upon the
undersigned and his heirs, successors, a,d assigns, and that this Agreement shall be filed for
record in the office of the Kitsap County Auditor. Owner agrees Ihat any saJe or transfer
of the above-described property will be condition~ on ex~ution and filing of a dnplicate
copy of this outside utility agreement by Ihe purchaser or transferee.
