WIIEREAS the Bre|nerton Municipal Code requires property ontside the city
bonudaries to support annexation to the City of Bremertou as a condition for receiving Cily
utililies (BMC 15.02.040 and 15.03.040); and
WIIEREAS the City of Bremerton has a primary obligation to its citizens to allocate
limited service resources for adequate growth and development wilbin the City; and
WIIEREAS the undersigned, as owner of a parcel outside the City of Bremerlon, has
made applicalion for city utilities;
NOW,TI1EREFORE, the undersigned owuer (hereinafter "Owner")of real property

legally described as:

and Ihe City of Bremerton (hereinafter "City"), in consideration ol tim mutual covenants
set forth herein including the fi~rnishing of utilities services by Ihe City of Bremetton, do
hereby promise and agree as follows:
1. Services Provided. City of Bremerton shall provide utility services consistent with
service areas defin~ by the City comprehensive utility plans as amended, and terms and
conditions of a current Letter of Availability from the Bremerton Utilities Department.
2. Rates and Char~es. Owner shall pay when dne all connection charges,
assessments, and rates es~blished for city utilities services by City ordinance for the Owner's
nser class.
3. U$e. Development of the property described above shall comply with the uses
and development standards of City of Bremerton comprehensive land use plan adopled
pnrsuant to RCW 35.13.177and any adopted subdivisiou and street standards of the City

5. Annexation. Owner, by signing below, grants to tile City ofBremcrton a Limiled
Power of Attorney to include this Agreement as Owner's consent to the annexation of the
Property as part of any Notice of Inleut or Pelition for Annexatiou presented to the City of
Bremerton.
The annexation petition support~ by Ibis Power may include proportional
assnmption of the City indebtedness by the area to be annexed. The petition shall reqnire
the concurrent adoption of land uses designat~ in any urban fringe comprebensive plan
approv~ for the annexation area pursuant to RCW 35.13.177, or if none has been adopled,
the land uses for annexed property as set forth in the Bremerton Zoning Code as amended.
This Power of Atlorney is nonrevocable.
6. EnforcemenL Violatiou of this Agreement may result in the immediale
termination' of utilities services to the above-described property as well as olher remedies
?. Covenants. The undersigned fl~rther agrees that this Agreement and tbe promise
made herein conslitute a covenant ruuning with Ihe land and shall be binding npou Ihe
nndersigned and his heirs, successors, and assigus, m~d Ihai tiffs Agreement shall be filed for
record in Ihe office of the Kilsap Connty Audilor. Owner agrees that any sale or trausFer
of lhe above-described property will b~ conditioned ou execuliou and filing of a dnplicale
copy of Ihis outs[de utility agreement by lhe purchaser or Iransferee.
