WHEREAS the Bremerton Municipal Code requires property outside the city
boundaries to support annexation to the City of Bremerton as a condition for receiving City
utilities (BMC 15.02.040 and 15.03.040); and
WHEREAS the City of Bremerton has a primary obligation to its citizens to allocate
limited service resources for adequate growth and development within the City; and
WHEREAS the undersigned, as owner of a parcel outside the City of Bremerton, has
made application for city utilities;
NOW, THEREFORE, the undersigned owner (hereinafter "Owner") of real property
located at the 3800 mt'tX OF Rn',G~IAY ClliCI~
., Kitsap County, Washington, (hereinafter 'l>roperty'),

and thc City of Brcmcrton (hereinafter "City"), in consideration of thc mutual COVenants
set forth herein including thc furnishing of utilities services by thc City of Bremerton, do
hereby promise and agree as follows:
1. Services Provided. City of Brcmcrton shall provide utility services consistent with
service areas defined by the City comprehensive utility plans as amended, and terms and
conditions of a current Letter of ^vaiiability from thc Brcmerton Utilities Department.
2. Rates and Char§es. Owner shall pay when duc all connection charges,
assessments, and rates established for city utilities services by City ordinance for thc Owner's
useF class.
3. Use. Development of thc property described above shall comply with thc uses
and development standards of City of Brcmcrton comprehensive land usc plan adopted
pursuant to RCW 3$.13.1'7? and any adopted subdivision and street standards of thc City
of Bremerton.

5. Annexation. Owner, by signing below, g~ts to the Ci~ of Breme~on a Limit~
Power of Attorney to include this Agr~ment as Owner's con~nt to ~e ~nexafion of the
Pro~y as p~ of ~y Notice of Intent or Petition for Annexation pre~nt~ to the City of
Bremenon.
The ~nexafion ~tition sup~ by ~is Power may include pro~ffion~
assumption of ~e City indebt~ness by the ~m to be ~nex~. The ~fifion sh~l r~uire
the concu~ent adoption of l~d uses designat~ in ~y urb~ fringe mmprehensive pl~
approv~ for the ~nexafion ~m pursuit to RCW 35.13.177, or if none has ~n adoptS,

This Power of Attorney is nonrev~able.
6. Enforcement. Violation of ~is Agr~ment may result in ~e immolate
termination of utilities semites to the above-de~fib~ pro~y as well as o~er rem~ies
provid~ by law.
7. Coven~ts. The undersign~ fu~er agr~s ~at this Agr~ment ~d the promi~
made herein ~nstitute a coven~t running with ~e l~d ~d sh~l ~ binding u~n the
~ndersign~ ~d his heirs, successors, ~d assigns, ~d that this Agr~ment sh~l ~ fil~ for
