WllEREAS the Bremerton Muuicipal Code requires property 'outside the city
bouudaries to support annexation to the City of Bremertou as a condition for receiving City
utilities (BMC 15.02.040 aud 15.03.040); and
WIIEREAS the City of Bremerton has a primary obligation to its citizens to allocate.
limited se~ice msoumes for adequate growth and developmeut within the City; and
WIIEREAS the uudersigned, as owner ora parcel outside the City of Bremertou, has
made application [or city utilities;

I. Se~ices Provided. City of Bremerton shall provide ulility services consiste,t with
service arms defined by the City compreheusive utility plans as amended, aud lerm~ aml
conditions o~ a cnrrent Letter of Availability [rom the Bremerton Utilities Department.
2. Rat~ and ~. Owner shall pay when due all connectiou charges,
asscssmeuts, and rates eslablished for city utilities services by City ordinance for the Owuer's
~tscr class.
3. Use. Developmeut of the property described above shall comply with the uses
aud development slandards of City,of Bremerton comprehensive land use plan adopted
pursuant to RCW 35.13.177and any adopted subdivision and street staudards of the City
of Bremerton.

5. Annexation. Owner, by signing below, grants to the City of'Bremerton a Limiled
Power of Attorney to include this Agreement as Owner's consent to the annexalion of the
Property as part of any Notice of Inlent or Petition for Annexation presented to the CRyof
Bremerton. F. t;

Tbe annexation petition supported by this Power may include proportional
assumption of the City indebtedness by the ar~ to be annexed. The petition shall require
Ihe concurrent adoption of land uses designaled in any urban fringe comprehensive plan
approved for the annexaliou ar~ pursuant to RCW 35.13.177, or if none has been adopled,
the laud uses for annexed property as set forth in the Bremerton Zouing Code as amended.
This Power of Attorney is nonrevocable.
6. Enforcement. Violatiou of lids Agreement may result in the immediale
termination of utilities se~ices to the above-described property as well as other remedies
provided by law.
7. Covenants. The undersigned further agrees that this Agreement and the promise
made herein constitute a covenant runniug with the land and sball be binding upon the
undersigned and his beirs, successors, and assigns, and that this Agreement shall be filed for
record in tbe office of the Kitsap Connty Auditor. Owner agrees that any sale or transfer'
of the above-described property will be conditioned on executiou and filing of a dnplicale
copy of tiffs outside utility agreement by the purchaser or transferee.
