service areas dc~ncd by Iht City comprehensive ulility plans as amended, and terms and
couditions of a current l~tter of Availability horn the Brcmerton Utilities Department.
2. Rat~ and ~m~. Owner shall pay when due all connection charges,
asscssmcuts, and talcs established for city utilities services by City ordinance for Ihe Owner's
user class.
3. Use. Development or the property described above shall comply with the

5. A~!nexation. Owner, by signing below, grants to the City ofBremerton a Limited
Power of AIIorney to include this Agreement as Owner's consent to the annexalion of Ihe
Properly as part of any Notice of Intent or Petition for Annexation presented to ll~e Cily of
Brcmerton.
The annexation petition supported by this Power may inclnde proportional
assumption of the Cily indebtedness by the ar~ to be annexed. The petition shall reqnlre
the concurrent adoption of land uses designated in any urbaa fringe comprehensive plan
approved for the annexation ar~ pursuant lo RCW 35.13.177, or if none has been adopled,
the land uses for annexed property as set forlh in the Bremerton Zoning Code as amended.
This Power of Attorney is nonrevocable.
6. ~nforcement. Violation of this Agreement may result in Ihe immediale
terminafion of utilities services to the above-described property as well as other remedies
provided by law.
7. Covenants. The undersigned fl*rtl*er agrees that this Agreement and lhe promise
made herein constitule a covenant running with the land and shall be binding upon
undersigned and his heirs, successors, and assigns, and that tiffs Agreement shall be filed for
record in the office of the Kitsap County Auditor. Owner agrees that any sale or transfer'
of the above-described property will be conditioned on execution and filing of a d,plicale
copy of this outside utility agreement by the purchaser or transferee.
