WHEREAS the Bt~merton Municipal Code requires property outside the ciiy boundaries to support
annexation to the City of Bremerton as a condition for receiving City utilities (BMC 15.02.040 and 15.03.040);
WltEREAS LI~ City of Bremerton has a primmy obligation to its citizcos to allocate limited sen, ice
r~ourcas for adecptnte growth and development within file City;, and
WHEREAS the undersigned, as owner of a parcel outside the City of Breme~ton, has made
al~lication for city u~lities;
NOW, 'rtlEREFORE, the undmigned owner (hemmfler "Owner") of real propeaty located at

and the City of Bremerton (hereinafter "City"), hi consideration of the mutual covenaras s~ for, h herein
including the furnishing of utilities serdces by the City of B~emerton, do hereby pmnUSe and agree as follows:
1. Services Provided. City of BremeCon shall prOWde ufih'ty servicea consistent with service areas
defn~d by the City cuuq~rehensive ufih'ty plans as amended, and terms and conditions of a current Letter of
A!rail mhth'ty from the Brcmcrton Utilities Deparanem.
2. Rates and Cha~es. Owner shall pay when due all connection charg~ assessments, and rates
established for city utilities serWces by City ordinanc~ for the Owner's user class.
3. U_~.~. Development of the property described above shall comply with the uses and development
sta~xlards of City of Bremetton compr~l~x~sive laml use plan adopted pursuant to RCW 35.13.177 and any
adopted subdivision and street .~anclards of the City of Bremerton.
4. Utility ~emeats,
Water and Sewer service for a two lot Short Plat.
5. Annexation. Owner, by signing below, grantg to the City of Bremerton a Limited Power of
Atlomey to include this Atg'esment as Owners consont to the annexaton of the PmDerty as part of any Notice of
Inlont or Petition for Annexation presented m the City of Breme~to~
The annexation petition supported by this Power may i~lade proportional assum~on of the City
indcbuM~ by the area to be annex~. The pedtion shall ~quire the concmi¢i,i adoption of land uses
designated in any urban fiSnge comprehensive plan apprc~ed for the annexation area ptasuant to RCW
35.13.177, or ff none has beon atklptad, the land usea for armexed property as set forth in the Bremerton Zonillg
6. Eoforc~ Violation of this Agreement may result in the immediate ~mfinafion of utilities
7. Cc~ts. The undersigned fm'ther agrees that this Ag~t and the promise made herein
constinite a covenant running with the la,x1 and ~hnll be binding upon the andc~sigaed and his heirs, successors,
and amigas, and ¢hat this Agreement shall be filed for r~cord in the office of thc Kitsap Co;mty Audtor.
