4A – ZONING CODE AMENDMENTS TO BREMERTON MUNICIPAL CODE SECTION 20.46.090
AND TEMPORARY ENCAMPMENT PERMIT: Planning Manager Garrett Jackson presented on
this item. The Bremerton Housing Authority (BHA) has made an application (file #BP26 00105) to
amend Bremerton Municipal Code (BMC) 20.46.090 which governs Temporary Encampment
Permits. The applicant requests an amendment to expand eligibility for a 3-year Temporary
Encampment Permit to the Multi-Use Zone of the Harrison Heights Subarea Plan, which includes
the property located at 1231 Sheridan Road. The Planning Commission held a Public Hearing on
August 17, 2026 and concluded that the proposed zoning code amendment does not meet Text
Amendment criteria of approval established per BMC 20.18.020(d), and therefore recommended
the City Council deny the application. Materials considered by the Planning Commission are
included in the August 17, 2026 Planning Commission Packet, and include a Staff Report,
submitted application materials, received public comments, and other documents.
Potential motions are as follows:
Planning Commission Recommended Motion: Move to accept the Findings and Conclusions of the
Planning Commission, which conclude that Application BP26 00105 requesting changes to
Bremerton Municipal Code (BMC) section BMC 20.46.090 Temporary Encampment Permits does
not meet the code amendment criteria established by BMC 20.18.020(d), and is therefore denied.
Alternative Motion: Move to reject the Findings and Conclusions of the Planning Commission for
Application BP26 00105 requesting changes to Bremerton Municipal Code (BMC) section BMC
20.46.090 Temporary Encampment Permits, and direct staff to perform SEPA review and prepare
an ordinance for future public hearing which adds the Multi-Use Zone of the Harrison Heights
Subarea Plan to zones eligible for a 3-year Temporary Encampment Permit per BMC
20.46.090(h)(1)(ii)(a).

Mayor Wheeler,Council members,
Please don’t rid this vitamin D starved town of our amazing patios that happen to be in a
part of street. So many folks love our small downtown hang outs.Dog Days went
away and this measure would leave us with hardly anything in the heart of downtown.
Please rethink this!

Dear City Council,
We are writing in regards to the removal of the streateries in downtown Bremerton and to
voice our strong opposition to this decision. We live in District 6 and moved to Bremerton
over 4 years ago from unincorporated Kitsap County.Bremerton’s community spirit and
support, exemplified by the streateries program, was one reason we chose to move inside the
city limits.
Without even getting into the economic benefit to the individual businesses, streateries and
sidewalk cafes provide much needed vibrancy in downtown Bremerton. We understand that
these were allowed in response to the COVID-19 pandemic. These type of activations were
utilized in cities and towns all over the country to support struggling restaurants -but also
provided a way for people to socialize in safe outdoor spaces during a time where social
interaction was limited.Although the initial justification for these streatery programs was tied
to the pandemic, many cities here in Washington learned that the streateries had benefits that
outlasted the pandemic and worked with their communities and business owners to formalize
these programs. It has always been our understanding that this has been the intention in
Bremerton,so we were shocked to hear that restaurants with streateries were given notice to
remove their outdoor cafe areas rather than the city establishing a clear program.
If the concern is on-street parking -we question why the city is once again prioritizing free
storage of vehicles over downtown vibrancy, small business support, and the community
interaction that comes with outdoor seating.
If the concern is not having an ordinance in place -there are multiple other cities with
ordinances, design standards, and engineered drawings in place to support attractive and
accessible streateries in their community that Bremerton could reference.
Ultimately, the loss of the streateries will be a huge loss to the vitality of downtown. We
would love to see the city enforcing and strengthening ordinances it already has on the books
-like the vacant building ordinance -rather than punishing small business owners who
contribute to the city's economy and culture.
On a personal note,we have had nothing but positive experiences with the streateries in
downtown. In fact, when we moved to Bremerton over four years ago,our first stop in our
new city after a day of unloading the moving van was to Local Boys downtown where we sat
Public Comment:Streateries
in their streatery to toast our new home and city.It is incredibly short-sighted for the city to
close these down without having a new program in place and providing transitional assistance
as the restaurants work to meet any requirements outlined in a formalized ordinance.
Please extend the temporary streatery program and commit to a firm deadline to
establish a formal program here in Bremerton.
Sincerely,
Darren and Katie Pratt

Dear Mayor Wheeler and the City Council of Bremerton,
I am writing in regards to the streeteries that are supposed to be removed by October 15th.
One of the things that I love about going out in my city is being able to walk downtown and
see friends out at Remedy, the Horse and Cow,South Pacific, and patronizing the other
businesses that make our town unique. One of my favorite things to do when I’m out at night
is to sit outside at remedy and play cribbage with friends.Removing the outdoor patios to
allow for a few more parking spaces will only take away spaces where the citizens of
Bremerton can come together as a community.
Mayor Wheeler, when you were on your most recent campaign, you stopped by my and my
boyfriend’s house. We were out,but you left a note saying we have lovely trees.A lot of
people might see the trees and think if we removed them,we would have more space for a
yard. But we love looking outside the window and seeing the trees, and to remove them
would take away from the character of the house. This is what the streeteries mean to the
people of Bremerton. Please don’t remove them.
Sincerely,
Morgan Colis

Dear Mayor and City Council,
Please leave the streateries on fourth street alone. The businesses on fourth with streateries
provide a valuable service to the community. It is lovely and healthy to sit outside.
The land area of the downtown core is roughly 50%parking.The last thing we need is more
parking spaces.The last thing!
This is not the first time the City has tried to eliminate the streateries.I know there was public
support to keep the streateries before. Why is the City doing this? Please find a more
productive way to improve the lives of Bremerton residents other than harassing a few
businesses who are doing something nice.
Thanks,

Hello,
Please take up a streatery program!I’m writing to request the Mayor leave the
existing streateries in place until an official streatery can be established.
Having a place to gather, outside such as at Local Boys and Remedy downtown is a
lovely option when you want to be out, with people, but also enjoying the sun &
fresh air breeze, and all that this lovely PNW has to offer.Frankly,it needs to be at
every eating and drinking establishment on 4th and surrounding blocks!

Y'all know there's gonna be riots if you shut down the streateries, right?Like, why would you
even risk that.Everyone loves them, they bring people downtown, they allow neighbors to see
and greet each other as they walk by,they bring in business for the shops, they allow folks
with dogs to grab a bite or a beer.I can't count how many times we've been walking through
and decided to grab a beer at Local Boys because someone we know was chilling outside and
we wanted to sit with them and catch up.
Adopt the program.Make streateries permanent.Stop trying to keep Bremerton in the dirty,
dangerous car-centric past.Aren't gas prices enough of a wake-up call?Cities should be
designed for people,NOT CARS.

Dear Mayor Wheeler and Bremerton City Council,
It has come to my attention that you are breaking your word and ordering two local
businesses:The Remedy Speakeasy Pub and Local Boys Tap Room, to remove their street
seating areas. This is after years of kicking the can down the road, after promising an
ordinance to allow regulated street eateries.
Let's prioritize street life and small business and make this happen!
Today, you need to make a choice:put this to a vote,as you promised,or else give that can
another kick.

Hi City and Greg -
I wanted to voice my support for keeping the streatery program in place that has been
informally setup with several downtown businesses such as Remedy and Local Boys. These
are clear positives from 2 key perspectives:financial and communal.
For the space of 1-2 vehicle spots apiece,we gain seating for dozens of people. This puts
community and energy in our core downtown which is critical in making it a "3rd place"at
which people want to spend money and time.
Secondly,we have to always consider trade offs in policies. In this case this would mean
reinstalling "free"street parking. "Free"is a loose term. As has been well documented in
research by Donald Shoup and others, generating no financial income on land requiring
building and maintenance is a negative ROI. Indeed nothing in life is free. Those costs then
get funded through higher rents, housing prices and costs of goods and services. From a
business perspective, they lose the revenue of that seating and in return they will likely have
to raise prices to offset the headwind while also facing higher building costs/fees from the city
to offset the loss in taxes the city must absorb now with the lost business.
Well in excess of 50%our core downtown land is used for parking, often free. If this
approach is such an attractive one for our city and local businesses why haven't these policies
resulted in an ever stronger downtown after decades of this strategy? Perhaps we can benefit
from more balanced approaches.
Thanks for your consideration and taking the time to read this.
All the best,

Hello and good morning!
It can be hard to fit into a short and to the point E-Mail just how important and excellent the
outdoor seating areas that are currently scheduled to be torn down are for local businesses but
I'm going to give it a go.
As both a small business owner and a kitsap county local I can honestly tell you that these
outdoor seating areas are a HUGE %of the reason people frequent that specific street these
days. Y'all have had to notice how there's always people using them?Looking to the other
side of the water in Seattle or Tacoma where some of these outdoor seating areas have been
covered and heated you'll see the outdoor seating fill up before the inside all the time!!We
live in the most beautiful county in the most beautiful state in the country!People here love to
spend their time outside whenever they can.
The impact from removing them will be immediate and significant.People will notice and
make plans to spend their money and their time elsewhere.I understand that the legal
framework for keeping these in place is complicated and difficult but from what I understand
most of it has already been created/presented.It's all just awaiting final approval. If a little
more time is the only thing needed to keep that street alive than it seems like an extention on
the outdoor seatings expiration or expedited the process in some way would easily be worth
the trouble.
To conclude, these outdoor eating areas have quickly become a part of Washington culture
that's become a core part of the experience. They allow us to enjoy our state's beauty in a way
that we've quickly become attached to.They should not only be saved, but expanded upon.

Dear Mayor and Members of the Bremerton City Council,
I am writing to respectfully urge you to preserve the downtown Bremerton 'streateries'and
outdoor dining spaces that have become an important part of our local business community.
While these spaces occupy a very small number of parking stalls, their value to downtown
restaurants, visitors, and the overall vitality of downtown Bremerton far outweighs the minimal
impact on parking availability.Downtown parking remains plentiful, with an estimate 134 off
street parking areas.Vibrant outdoor dining areas bring people onto the sidewalks, encourage
foot traffic, and create the kind of welcoming atmosphere that attracts residents and visitors.
Small restaurants operate on extremely thin margins.'Streateries'provide additional seating
capacity, increased visibility, and a more attractive customer experience without requiring
businesses to take on significant construction costs or expand their buildings. For many
establishments, these spaces are not simply a convenience but an important source of revenue.
Washington's Municipal Research and Services Center (MRSC)notes that many cities across our
state continue evaluating ways to retain parklets and 'streateries'because these spaces proved
popular with the public and supported local businesses.
MRSC also highlights that public spaces and gathering places serve as significant economic
catalysts, attracting people to downtown districts and helping support economic activity and
small business growth.
Downtowns succeed when they give people reasons to linger, socialize, shop, and dine.Every
thriving downtown has destinations that create energy and encourage people to spend time
there.'Streateries'do exactly that. They transform curb space into places where people gather,
support local restaurants, and contribute to the character and identity of the district.
At a time when small businesses face rising labor costs, inflation, and changing consumer habits,I
respectfully ask the City to stop making it harder for entrepreneurs to succeed.Instead of
removing or restricting 'streateries',I encourage the Council to view them as an investment in
downtown vitality,economic activity,and Bremerton's future.
Please work with restaurant owners, downtown businesses, and residents to preserve these spaces
and continue building a downtown that people want to visit, enjoy, and support.
Thank you for your consideration and for your service to our community.

Mayor Wheeler,City Council,
I am a resident of Bremerton and a supporter of streateries.Do not let these outdoor spaces go
away. The streateries on 4th street are a benefit to the community. They extend and enhance the
outdoor public meeting space that is centered around Quincy Square. As the city continues to grow
our neighbors demand more and more pedestrian friendly spaces not parking lots and traffic.
Streateries not only provide more dining space for businesses but also a safe and inviting location to
enjoy the good weather (which is lasting longer and longer).More positive draws to the city center
will create more and longer opportunities for consumers to spend money which is a win for both
small businesses and for the city in terms of increased the tax revenue. The risk/reward proposition
is surely on the side of streateries.
Please allow the streateries to remain open while the city develops a program to expand to other
areas.
Thank you,
Nicholas Wagner

Dear Mayor Wheeler and the Bremerton City Council,
One of the reasons I chose Bremerton to be my home was the ongoing effort
towards making Bremerton a great place for entertainment, dining, one of a kind
stores and a growing sense of community.
One of the positive steps to creating that community is the ability to dine outside. In
fact, outdoor dining not only boosts community vibrancy but it also helps ensure the
survival of local businesses (not just the restaurants.)Surveys show that up to 78%of
residents support permanent street-side setups.Spaces like the outdoor setups at
Remedy Speakeasy and Local Boys Taproom are perfect examples of how these
street-side options bring energy to our blocks and draw foot traffic to surrounding
shops.
I understand that the City Council has a complete draft ordinance and that it simply
needs to be passed into law.
Until that decision is made officially, please continue to allow the existing "streateries"
to stay in place.
It's good for the restaurants and the patrons visiting the many shops and restaurants
in Bremerton.
Respectfully,
Michele Troxel

Mr.Martin,
Thank you very much for reaching out and for taking the time to share this information.
You raise a legitimate concern about the use of taxpayer-supported financing for
professional sports facilities, particularly when the beneficiaries include extremely valuable
private sports franchises. We agree that public funds should be treated carefully and that
taxpayers deserve to know exactly where their money is going and who ultimately benefits.
We will take a closer look at H.R.2434,the No Tax Subsidies for Stadiums Act of 2025,as
well as the broader issue you raised regarding tax-exempt municipal financing for
professional sports stadiums.
Thank you again for bringing this to our attention and for staying engaged. We genuinely
appreciate constituents and community members who take the time to research an issue
and make sure candidates know what matters to them.

Good morning,
Good bill but does not go far enough. The role of government is limited. We have gotten far
a field when taxpayers are subsidizing sports stadiums in any manner. Government waste
should be cut out at all levels. This is a good example of waste. Time for taxpayers to stop
footing the bill for nice to dos. Certainly when I’m in office,I would poll the citizens in our

would support this bill. This is exactly the kind of waste that I am talking about when I talk
about ending frivolous spending, fraud, waste, and abuse, and having a healthy economy
during my campaign. John, please let folks know that this is an issue that I am running on and
would appreciate support getting to Congress!
The bill only targets the federal tax-exempt bond treatment.States and cities
could still offer direct cash subsidies, land giveaways,or other incentives if they
choose. It does not ban stadium construction—it simply stops the federal
government from making those projects cheaper via the tax code.
Thank you for contacting me.Please take a look at my campaign site and media area to keep

Two days later,Everett Mayor Cassie Franklin and the Everett City Council and County

MULTIPLER.
MULTIPLER is a term that is used to con the public.
What is an ECONOMIC MULTIPLER?
In February 1936,a similar time period,John Maynard Keynes published “The General Theory
of Employment,Interest and Money,”and formally introduced the concept of the multiplier
effect.
Milton Friedman,a leading figure of the Chicago School of Economics who won the Nobel
Memorial Prize in Economic Sciences in 1976,argued that the Keynesian multiplier was
incorrectly formulated and fundamentally flawed. The theory ignores how governments
finance spending by taxation or debt issues.Raising taxes takes the same or more out of the
economy as saving, while raising funds by bonds causes the government to go into debt. The
growth of debt becomes a powerful incentive for the government to raise taxes or inflate the
currency to pay it off, thus lowering the purchasing power of each dollar that workers earn.
NEGATIVE MULTIPLIER EFFECTS,such as athletes fixing games for gamblers, domestic
abuse,professional gambling websites,political corruption,and prediction market betting,
were not adequately taken into account by Community Attributes,Inc.
Chris Medfford,President &CEO of Community Attributes Inc.,John Stanton Seattle Mariners
Baseball Club chairman and principle owner, Pat Filippone,President of the Seattle Mariner
affiliated Aquasox,Thomas Volpe,principal owner,of the 7th Inning Stretch,LLC.,and
Charlton Volpe,AquaSox President on the Player Development League (PDL)License, all

multiplier effects, and increase government debt and taxpayer burden.

A 2024 Ticketmaster email to Everett Mayor Cassie Franklin from Peter Woodfork,Major

In a January 2025 email,Charlton Volpe,AquaSox PDL License President,facilitated additional

relationship with Oak View Group,a potential competitor-turned-partner that has described
itself as a “hammer”and “protect[or]”for Live Nation. In recent years,Oak View Group has

avoided bidding against Live Nation for artist talent and influenced venues to sign exclusive
agreements with Ticketmaster.
For example,Live Nation has scolded Oak View Group multiple times for trying to compete.
In one instance,Live Nation asked,“who would be so stupid to ...play into [an artist agent’s]
arms,”and on another occasion,Live Nation stated,“let’s make sure we don’t let [the artist
agency]now start playing us off.”"

I encourage you to investigate the Oak View Group complaint emailed to Washington State
Attorney General Nick Brown. The State of Washington complaint includes Ticketmaster.
Attachments and additional information are available upon request and at the websites

Following the United States Department of Justice lawsuit that found Live Nation and

Re:Government subsidizing professional sports stadiums with direct cash subsidies, land giveaways,

Washington Public Records Act,RCW 42.56.080(2),indicates:
“Agencies shall honor requests received in person during an agency's normal office hours,or
by mail or email, for identifiable public records unless exempted by provisions of this
chapter."
Everett Public Facilities District (EPFD)is an agency and I again requested that the EPFD
honor my Public Records Request of April 27,2026.
1).Specifically,I requested all Public records of all training, including dates,of all Everett
Public Facilities District Public Records officers and records managers from April 10,2001,
through April 27,2026.
2).Specifically,I requested all Public records of the date that all Everett Public Facilities
District Public Records officers and records managers assumed responsibilities as a public
records officer or records manager at the Everett Public Facilities District from April 10,
2001,through April 27,2026.
Included is an attachment I received from the EPFD (719294B -Response.pdf -
correspondence from the Oak view Group)that included emails from Oak view Group
employee,Danielle Vaughn.
A May 26,2026,email from Oak View Group Deputy General Council Cait Burggraf to the
Washington State Attorney General is also attached.
According to Oak View Group (OVG)Deputy General Council Cait Burggraf:
"OVG is the contracted private party manager of Angel Of The Winds Arena (Arena)on
behalf of its client, the Everett Public Facilities District (EPFD). In that role,OVG provides
operational and administrative support to EPFD,which may include asisting with the
gathering, organization, and transmission of documents responsive to certain public recordss
requests.
That support does not constitue a delegation of EPFD's constitutional or statutory
obligations, nor does it make OVG the proper subject of a consumer complaint concerning
governmental public-records procedures."
Re:Government subsidizing professional sports stadiums with direct cash subsidies, land giveaways,
or other incentives.
It appears Oak View Group is in violation of Washington Public Records Act,§42.56 et seq.,
indicating "EPDF's public records officer is Danielle Vaughn"on the EFPD's Oak View Group
managed Angel of the Winds Everett Public Facilities District website (see print screen image
below)
Cait Burggraf is wrong. Oak View Group IS "...the proper subject of a consumer complaint
concerning governmental public-records procedures."
The Everett Public Facilities District is a local agency.
RCW 42.56.580 (1)indicates:"(1)Each state and local agency shall appoint and publicly
identify a public records officer..."
Oak View Group indicates on the Oak View Group managed Angel of the Winds Everett
Public Facilities District (EPPD)website:
"EPDF's public records officer is Danielle Vaughn."
Danielle Vaughn is an Oak View Group employee as evidenced by the email address:
Danielle.Vaughn@oakviewgroup.com.
Allie Lindert was an Oak View Group employee as evidenced by the email address:

Oak View Group Deputy General Council Cait Burggraf is wrong.
I emailed a complaint against Oak View Group to the US Department of Justice and the
Washington State Attorney General on April 2,2026,and a follow-up complaint emailed on
April 27,2026,against Oak View Group to the Washington State Attorney General
indicating:
"Specifically,I feel my rights under the Washington State Consumer Protection Act (RCW

I encouraged the Everett Public Facilities District to file a complaint against the Oak View
Group with the Washington State Attorney General's office.

Additionally, documentation of start dates or training of any of the EPFD's record officers
from April 10,2001,to April 27,2026,was not provided.
Only training documentation of Oak View Group employees was provided. (See Danielle

RCW 42.56.580 (1)indicates:"...local agency shall appoint..."
The appointment of the Everett Public Facilities District records officer is a matter of public
record and identifiable public records that contain non-exempt information exist.
For example, notes, minutes, and other identifiable public records from the meeting or any
other method that the Public Facilities District engaged in to appoint the Everett Public

As noted, Oak View Group replied (see attached May 20,2026,email from Oak View Group)

Good Morning,
I am reaching out about the program that allows both Local Boys and Remedy to have their
outdoor spaces.I was very disappointed to hear that the city is looking to withdrawl their use
of these spaces and as a part of the downtown community I'd like to request that the city
reconsider.
As the founder and director of the international West Sound Film Festival,I have had
hundreds of positive comments from filmmakers and festival attendees about how much they
enjoy the outdoor spaces between films.I have had attendees from Bulgaria,Canada,Italy as
well as states such as Virginia,North Carolina,Los Angeles and more sit outside in these
spots which encourage interactions with other filmmakers and attendees.Taking these spaces
away would affect the amount of people each space could serve and disrupt the friendly, open
vibe that downtown Bremerton has curated. We pride ourselves as an art community and
these spaces have contributed to that environment.
Bremerton is also known as a dog friendly space.I know multiple people travel from other
areas with their pet and utilitize these spaces especially since they are so close to GastroPup.
If you were to remove these spaces you've dropped two large draws to coming downtown for
pet owners with Remedy being the only restaurant open late that allows pets.
In closing, please consider that both of these outdoor spaces have contributed heavily to
activating the downtown area for visitors.By removing them you would also affect the other
downtown businesses that these customers would visit during their time downtown. It's often I
overhear someone come to one of these spots and realize there's an event on Quincy they
didn't know about and decide to attend.Or realize there's a bookstore or vinyl shop they'd like
to check out.I hope you can see the value that these spaces bring to the downtown community
and the city of Bremerton as a whole.
Thank you for your time,
Amy Camp

Mayor Wheeler,Christy Cammarata, and City Council as a whole,
Once again we are hearing that the City is planning to shut down the “Streateries”in
downtown despite years of being told a permanent solution was in the works.Listen to the
constituents. We want these to remain open, permanently. Why do we have to keep revisiting
this time and time again??
VIBES:These outdoor spaces allow local businesses to expand to outdoor spaces, which make
summer time enjoyment of the area amazing. They add to the overall energy of downtown
and make a day at a festival that much more exciting, drawing more people to downtown,
benefiting everyone.
PARKING IS NOT A REASON:the few spots these take up is not going to solve any parking
problems people might bring up.There is plenty of parking, even free parking in many cases.
ECONOMICS:When people enjoy being downtown,it benefits all the local businesses and
the city.
Pass the permanent streateries program you have already built but refuse to enact.

Dear Councilmembers and Mayor,
I urge you to continue Bremerton’s ad hoc streatery program (established during the pandemic)and
to adopt a permanent streatery program for Bremerton going forward.
I’m a downtown Bremerton resident and homeowner since 2018.I enjoy downtown Bremerton in
many ways, but one highlight for me is dining al fresco on its historic streets.Places with streatery
options like Remedy Speakeasy and Local Boys Taproom provide third spaces for people like me;
people who like to congregate in the open air, enjoy the services of a local establishment, and maybe
even bring a pet along.
There are many benefits to allowing streateries in Bremerton besides my personal preferences.
Streateries give our restaurants room to grow without the expense of a new lease or major
construction.By converting one or two curbside parking spaces into dining areas,a business can add
tables, serve more guests during peak hours, and increase revenue with a modest investment. Also,
guests enjoying a meal on the street demonstrate to passersby that a neighborhood is open, active,
and worth exploring. There is no better signal for a healthy downtown core.
For the City of Bremerton, streateries turn underused curb space into places where people want to
spend time.A single parked car may occupy a space for hours, while a streatery can welcome dozens
of residents, workers, and visitors throughout the day. This activity supports core revitalization goals,
including higher foot traffic, stronger retail spending, and more reasons to visit downtown after
working hours. These spaces make streets safer and more comfortable for people walking, rolling,
and biking.
There is no shortage of parking in our downtown area. Please continue and expand streateries in
Bremerton so our neighbors can connect and enjoy time outdoors together while patronizing local
businesses.
Sincerely,
Tony White

Dear Mayor and Councilmembers,
I’m writing in support of continuing Bremerton’s streatery program and making outdoor dining a
permanent option for downtown businesses.
As a downtown resident since 2018,I’ve seen firsthand how much these spaces contribute to the
experience of living in and visiting Bremerton.Streateries like those at Remedy Speakeasy and
Local Boys Taproom create welcoming places to gather outdoors while supporting independent
local businesses.
Their value, though, extends beyond the people sitting at the tables.
Seeing people eating, drinking, talking, and spending time outside is one of the clearest
signs that a downtown is healthy. To anyone passing by,a busy outdoor dining area says that
businesses are open, people feel comfortable being there, and there is something worth stopping
to experience. That visible activity helps turn a collection of businesses into a destination.
Streateries are also an efficient use of downtown space. One or two parking spaces can become
an extension of a restaurant, allowing it to serve substantially more people without the cost of
leasing or building additional space.Instead of accommodating a single parked vehicle for hours
at a time, that curb space can serve many customers throughout the day while contributing to the
energy and economic activity of the downtown core.
Downtown Bremerton has plenty of parking.Giving a small portion of curb space back to people
is a worthwhile investment in local businesses and the vitality of our city center.
Please continue the current program and establish a permanent streatery program for Bremerton.
A thriving downtown should look and feel alive, and people enjoying our streets together are one
of the best ways to make that happen.
Sincerely,
Erin Stuart

To whom it may concern,
Streeteries help keep our community connected and vibrant. They bring life to our streets and
give visitors a glimpse of what Bremerton has to offer. There’s nothing better than enjoying
an afternoon outside while sipping a crisp Washington-brewed beverage at Local Boys Tap
House or enjoying a handcrafted beverage and appetizers during happy hour with members of
your business at Remedy. As a community leader and business owner in Downtown
Bremerton I see first hand these spaces thriving and sometimes wishing they were bigger
because I missed getting a spot.
Streeteries create gathering spaces for community events, such as our St.Patrick’s Day and
Krampus parades, where dollars continue to be spent locally and support our small businesses.
Being a participant in both parades I’ve seen those spaces active and thriving.People smiling
and enjoying life.
If the city votes to eliminate these spaces,it will be yet another missed opportunity for our
Mayor and Bremerton City Council to recognize their value. It’s disheartening to
continuously have to fight for projects that positively impact local businesses and add value to
Bremerton.
Bremerton has the opportunity to create vibrant, welcoming spaces that support our local
businesses, bring people together, and contribute to the continued growth of our community.
Let’s not take a step backward.Let’s recognize what is working and find ways to build on it.

Without that patio in the street I would have never even known Remedy existed.

Dear Council President Rebelowski and Councilmembers,
Attached is a timeline of what the City has said and done on streateries since 2020,drawn
from its own minutes, video and records. For years, the businesses were told they could stay
until a permanent program was in place. No program was adopted, and the administration has
now ordered Remedy Speakeasy and Local Boys Taproom to remove theirs by October 15.
You have a complete draft ordinance from the businesses and it appears the Public Works
Director also has a draft resolution ready for you as well. Please take up a streatery program,
and ask the Mayor to leave the existing streateries in place until you decide.
Thanks again for your service to and leadership of our city.

Streateries: what the City said and did, 2020–2026
Streateries are outdoor dining areas in street parking spaces. Bremerton first allowed them in 2020 under the Mayor's COVID emergency
order. In August 2026 the City told the three businesses still using them (Local Boys Taproom, Remedy Speakeasy and South Pacific) to
remove them by Oct 15, 2026.
Compiled Oct 1, 2026 by supporters of the streateries, from Council and committee minutes, Council video, the City website, and City records released under
the Public Records Act.
The short version
1. For years the City said the existing streateries could stay while it wrote a new policy. Four times it set an end date (Oct 2020,
June 2023, spring 2024, Nov 2024) and later pulled it back. No streatery policy or program has been adopted; on Sept 23, 2026 the
Public Works Director wrote that the City is “reviewing different approaches.”
2. The City treated them as real permits. It issued permit numbers, extended them in writing, billed Local Boys an annual permit fee
and leasehold tax (a state tax on using public property) into 2026, and in 2026 the Director wrote of “existing streatery permits.”
3. In letters on Sept 22 and 23, 2026, the City says the permits expired long ago, so there is nothing to appeal; it will not process
Remedy's Sept 4 appeal and keeps the Oct 15 removal date. Page 4 compares those letters with the City's own records.
Quotes are word for word, including the City's spelling. “...” marks words left out; bold and [brackets] inside quotes are added. Shaded entries are the key ones. Video
quotes are from a machine transcript of the meeting video. ROW means public right-of-way (streets and sidewalks); BMC is the Bremerton Municipal Code. Type A right-
of-way permits are short-term; Type C permits are long-term.

Mayor Greg Wheeler signs Executive Order 2020-03, allowing no-fee permits for dining in parking spaces.
“No fee will be charged for Type A right-of-way permits issued under this Directive. Further, the 4-week limitation of Type A
right-of-way permits as outlined in BMC 11.02.080(A)(1) is suspended.”
The order first said permits under it would end by Oct 15, 2020. An October amendment removed that date and kept the order
in effect until the Mayor ended the COVID emergency, effective Oct 31, 2022.

The printed expiration date is Feb 2, 2022. That is about six months (180 days), not four weeks.

Oct 21, 2022 Public Works Director Tom Knuckey emails the permit holders, including Remedy and Local Boys. The Mayor and City Council
are copied.
“I'm reaching out to you as your business has an active Type A right-of-way permit ...”
“This Executive order will be repealed at the end of October when the Covid Emergency officially ends. If you wish to
continue your current usage of the right-of-way, the City will extend your existing Type A permit for a period of time as we
work to establish a new ‘Streaterie’ policy. Once in place, your operations would need to comply with the new policy.”
The City's own call log records Remedy on Oct 24 (“Wants to continue program, wants more info on new requirements”) and
Local Boys on Nov 29, both marked in favor.

The City decides to end the program, then finds the permits are active and lets them run

different for the new streeteries, but we don't want to really pull the rug out from underneath the existing businesses.
And so we're going to try to work with them as we develop the policy and then move that forward.”

Apr–May 2023 Public Works recommends ending the program, the Mayor agrees, and Local Boys is told to remove it in 30 days and that
there is no appeal process.
Public Works Committee minutes, Apr 18: “The recommendation is to not continue this program ...”

Email to Local Boys, May 4: “I'm reaching out in regards to your temporary type ‘c’ row permit for dining in the parking
spaces adjacent to your business (aka ‘streateries’). ... With the temporary program expired and with the decision to not
create a permanent streateries program all remaining streateries must be removed within the next 30 days.”
Local Boys filed an administrative appeal anyway.

May 19, 2023 Director Knuckey's status memo on the program.
“The permits that were issued to businesses during the pandemic were Type A (Short Term) ROW permits with all fees and
the 4-week maximum duration waived, and as previously stated, the intent was for those permits to remain in effect until
the City developed new streatery policies.”
“However, since this was classified as a renewal, it didn't trigger logging a new Type C ROW permit into the City's SmartGov
permit tracking system, and so other staff working on the streatery program were unaware that any businesses had active
permits.”
The same memo lists South Pacific and Local Boys with active Type C permits and “Remedy Speakeasy – No permit,” says the
permits “will not be rescinded; however, they will not be renewed,” and says the program would end Apr 4, 2024.

May 22, 2023 Public Works answers Local Boys' appeal by dropping the 30-day removal.
“The city will be extending the Outdoor Dining in the Right-of-Way (ROW) Directive and the ROW permit for the Local Boys
Tap Room will remain active until the end of the current annual permit period.”
The email says the permit is valid to Apr 4, 2024 once Local Boys shows insurance, and offers to return the appeal fee.

Director Knuckey briefs the City Council.
Slide 5: “In November 2022, the City was audited and found not compliant for not charging leasehold excise tax for the
private use of the ROW. To correct this, the tax was collected from the businesses (approximately $100) following Type C
ROW permit procedures, which effectively issued Type C ROW permits. As this was unintended, the permit system wasn't
updated, and staff weren't aware of the active permits until notified at the May 17, 2023 City Council meeting.”
Slide 5: “Based on the issues identified while outlining a policy, the decision was made to terminate the streatery program;
however, given that permits were issued, the decision was made to continue the program until the spring of 2024 when the
permits expire, then terminate the program.”
Director Knuckey, same meeting: “there were two people two businesses that filed appeals and yeah we absolutely want to
refund your fees there's no reason to appeal we're continuing the program”

Nov 17, 2025 Public Works staff disagree about whether the permits are still in effect.
Permit Technician: “Unfortunately, since all 3 permits have already expired, extensions cannot be granted.”
Operations Manager Ron Moore: “I was under the impression we extended these three permits through 2025.”
City Engineer: “We have been waiting for direction on these. The plan has been all over the place and Tom [Knuckey] was
working at the Director level with Tim [Barker, Parks Director] and the Mayor.”
Staff then ask whether to send removal notices. The records released so far show none sent until Aug 24, 2026.

Sept 22–23, 2026: the City's letters, and what its own records say
The Assistant City Attorney (to Remedy, Sept 22) and Public Works Director Berthiaume (to Local Boys, Sept 23) say the permit ended, nothing was denied or
revoked, and so there is no appeal; removal is still due Oct 15. The Director apologizes for the City's conflicting messages, says the Sept 14 email “was sent
without my knowledge,” offers a refund of fees and tax paid “while you were in an unpermitted status,” and offers to review documents sent by Oct 8, while
saying that review “does not create an appeal right or, by itself, extend the removal deadline.” His cover email to Local Boys, copied to the Mayor and the
City Council, acknowledged Local Boys' and Remedy's Sept 22 proposal to the Mayor (a letter, more than 400 petition entries and a proposed ordinance):
“We are reviewing different approaches and will add your suggestions to our review. In the meantime, please see the attached notice that is our current
position.”
TH E LE T TE R SAYS
Under BMC 11.02.080, “Type A
permits expire no later than four (4)
weeks after issuance. Therefore, the
permit has expired.”
To Remedy, Sept 22
T HE C I TY ’S O W N RECOR D S S AY
The code does not say Type A permits expire after four weeks. It says they “may be used ... for up to
four (4) weeks” and that “Type A uses that exceed four (4) weeks duration will be treated as Type
C uses,” which are revocable (BMC 11.02.080(A)(1), (C)(1), (C)(5)). Remedy's permit printed an
expiration date of Feb 2, 2022, about six months out, and the Mayor's order had suspended the
four-week limit.
Days before the emergency ended, then-Director Knuckey told Remedy the City would extend its
permit “as we work to establish a new ‘Streaterie’ policy” (Oct 21, 2022). The City's log records a call
with Remedy on Oct 24: “Wants to continue program.”
Staff emails list a later Remedy permit, RW23 00098, as a Type A permit “expired 10.31.2024” (Nov
17, 2025). The Sept 22 letter discusses only the 2021 permit.
“The practical result is that the prior
authorization to occupy the right-of-
way has ended and no current, City-
approved permit authorizes the use.”
To Local Boys, Sept 23
The City extended RW23 00109 to Oct 31, 2024. Then it told the Council committee the streateries
“will not be removed in October and will be extend [sic] for 12-months,” and that staff would
“continue status quo until a parklet program is in place” (Sept 17, 2024). No parklet program has
been adopted.
The City kept billing, and Local Boys kept paying, an “ANNUAL RW PERMIT” fee and leasehold tax.
The letter itself acknowledges billing and payment in 2024, 2025 and 2026.
On Sept 14 the Director's staff wrote that Local Boys has “an active right-of-way permit” to Apr 4,
2027. The Director withdrew that on Sept 23.
“The payment of a fee or leasehold
tax to the Finance Department is a
separate matter that does not, by
itself, create, renew, or extend a
permit.”
To Local Boys, Sept 23
In 2023 Public Works told Council that collecting the tax “effectively issued Type C ROW permits,”
and its memo called the fee a “renewal.” (It also called this “unintended.”)
Leasehold tax is owed on an interest in public property held under “any lease, permit, license, or any
other agreement ” (state law, RCW 82.29A.020(1)(a), .030).
The City's own leasehold tax policy, signed by the Mayor, prices an “Annual Type C Permit Cost” as
the permit fee plus leasehold tax, the same two lines on Local Boys' invoices (Public Works Policy 6-
10-11).
“under BMC 11.02.100 a long-term
(Type C) right-of-way permit ...
cannot be renewed.”
To Local Boys, Sept 23
The Code does say Type C permits “can not be renewed” and that a new permit is needed (BMC
11.02.100). But the City extended this very permit in writing: “RW23 00109 has been extended until
10/31/2024” (Apr 8, 2024). It also told Local Boys, “you will be receiving your permit renewal soon”
(Feb 16, 2024).
The City's 2026 fee schedule charges a Type C “Annual Renewal $80.00.”
“a formal appeal under BMC
11.02.310 applies only to the denial
or revocation of a permit, so it is not
triggered by this letter.”
To Local Boys, Sept 23 (the Sept 22 letter says the
same)
The Code defines revocation as “the cancellation of a permit,” says notice of it “shall be by letter,”
and says “A revocation may be appealed” (BMC 11.02.040(U), .280(C), (D)).
The Aug 24 letters said the authorization “is being discontinued,” and the Director's own agendas
called them “existing streatery permits.” Under the Code's definition, ending them is a revocation.
In 2023 businesses appealed a removal order the City said could not be appealed. Then-Director
Knuckey told Council, “there's no reason to appeal we're continuing the program” (Jun 7, 2023).
“The City is evaluating standards for a
future streatery program ...”
To Local Boys, Sept 23
By Aug 12 Director Berthiaume had drafted a 24-month pilot using “the existing Type C right-of-way
permit framework,” and a Council resolution. No program date is given; removal is still due Oct 15.
The Director can adopt policies to carry out the right-of-way code: “Such policies do not require
approval by the City Council” (BMC 11.02.300).
What would resolve this: keep the three existing streateries in place under a written interim authorization, with upkeep,
insurance and a clear sidewalk, until the City finishes the streatery program it first said it was developing in 2022 and now says it
is evaluating.

Dear City Counsel Members,
My name is Lester Hill and I live at 1524 S Marine Dr,Bremerton.
I lived overseas and traveled extensively for roughly 20 years –Europe,Asia,
Africa,Middle East.In each of the hundreds of cities I visited,there was a
vibrant city center with outdoor patio areas where people congregate to
eat,drink and socialize.
Without their thriving streateries, every one of those cities would have been
less interesting, less vibrant and esthetically poorer –as will Bremerton if it
eliminates our patios.
Please work to create a viable streatery program and allow the existing ones
(Remedy Speakeasy and Local Boys)to remain.

To the Mayor and Members of City Council:
I was under the impression that in 2025 the Mayor set a goal for the city to finalize and
implement a permanent Streatery program,or a suitable alternative. It now appears that
little or nothing was done to achieve that goal.Last August,Mayor
Wheeler signed letters later sent to Remedy and Local Boys Taproom directing them to
remove their Streatery spaces by October 15,2026.
I believe this decision is short-sighted and harmful.Streateries are among the best things
to happen in downtown Bremerton. They bring people out to eat, meet friends, and
support local businesses. As a resident of Downtown,I clearly see that
they make downtown livelier, more welcoming, and safer.
This is a decision the Council should have a voice in,particularly since the promised plan
was never brought forward.
I respectfully ask that the Council be given the opportunity to do its job by taking up a
review of a Streatery program for Bremerton. In the meantime,I ask the Mayor to leave the
existing Streateries in place until the Council has made its decision.
Thank you for your time and your service to our community.
Sincerely,
Please Keep Bremerton's Streateries in Place Until Council Acts

Honorable Members of the City Council,
The outdoor dining areas or “streateries”breathe life into an otherwise dead section of downtown
Bremerton.Getting rid of those outdoor patios does way more harm than letting them stay.At best
you gain five or six parking spots while losing dining space for up to fifty people at a time.A plan to
keep that business would be much more preferable.
Very Respectfully,

needs to avoid COVID,I only eat out outdoors, and would absolutely love to see more

Hi Mayor Wheeler and Councilmembers,
My letter is first a request a pause the October 15 removal deadline for Remedy Speakeasy
and Local Boys Taproom’s streateries and leave them in place while the Council develops and
adopts a permanent program.
Mayor Wheeler’s 2025 initiative committed to “implement a permanent Streatery program or
suitable alternative.”That commitment appears under street improvements, business
opportunity, and economic growth. Business owners were told their streateries could
remain until a permanent program was in place.
Nearby cities provide workable models.Seattle renewable outdoor dining permits and
introduced assistance covering the first 100 seasonal café permits in 2026.Portland permits
seasonal and year-round dining in parking spaces, with standards for accessibility, emergency
access, and traffic safety.Bremerton has many successful examples to draw from.
Most residents want to continue seeing revitalization and a lively, thriving downtown.
This move seems to go against that desired universal goal.If reopening parking
spaces is the reason for removal,I would like to understand why that use outweighs
the existing dining spaces’value to businesses and downtown. What parking demand
or safety evidence supports requiring removal now?
Please suspend the removal deadline, put a permanent program on the Council’s
agenda, and establish an affordable path for existing streateries to comply.
Our small businesses should not lose customer seating while the City’s promised
program remains unfinished.
Thanks for listening,
Heather “Heddy”Pugh

Dear Bremerton City Councilmembers,
As someone who has lived in Bremerton for 26 years and deeply cares about the
community I call home,I’m writing because I’m increasingly concerned about the
direction of our city and asking the Council to take meaningful action on several
important issues.
My requests are:
-Sheridan Road/BHA Shelter:Please provide a clear update on the project, including
the specific zoning/permitting barriers, the status of previously committed funding,
and a concrete plan and timeline for moving forward.
-Homelessness:Pleaseprioritize meaningful shelter and housing solutions while
treating unhoused residents with dignity.Restrictions and displacement should not
move forward without realistic alternatives and resources.
-Local Businesses &Streateries:Please develop a permanent or pilot streatery
program for qualifying local businesses and ask the Mayor to allow existing
streateries to remain while the program is being considered, rather than removing
outdoor patios before a replacement policy is established.
-Quincy Square:Please provide greater transparency around decisions affecting
businesses, events, performances, and community use of the Square, with meaningful
opportunities for public input.

-Community &Economic Development:Please ensure zoning,permitting,and

investment.
These issues affect housing,homelessness,local businesses,downtown vitality,and
the future of Bremerton.I’m asking the Council to address them transparently, work
collaboratively with the community, and provide clear next steps.
Bremerton’s future is being shaped by decisions being made now. After 26 years of
calling this city home,I hope the Council will ensure residents, local businesses, and
unhoused community members have a meaningful voice in that future.
Thank you for your service and consideration.

Mayor Wheeler and Bremerton City Council Members,
I realize that this email is past the deadline, but I wanted to give some thoughts on the issue of
downtown “streeteries.”
I consider myself a “downtown person.”I’ve seen the downtown corridor grow and change in
many ways in the past six or so years. So many of the most positive changes have been the
direct result of the many small business owners that own and rent the buildings downtown.
Their direct efforts have helped to turn downtown Bremerton into a vibrant and thriving
community.Part of this is the effect of outdoor seating at several restaurants downtown.
When people see other community members sitting, eating, enjoying, they are more likely to
follow suit.
PEOPLE make community. And those people linger in that community by eating, drinking,
socializing, and sharing time together. This is made easier when eateries can offer seating to
suit all preferences, such as those who like to enjoy our glorious summer weather.
I recognize that these eateries were initially a stop-gap to allow restaurants to stay open during
the COVID lockdowns and social distancing rules. In my view, the fact that these outdoor
eating options has been one of the BEST changes that was made during that difficult time.
I’ve seen those areas morph from empty dining areas to crowded community meeting spaces.
Walking downtown around 5pm each day will show that these spots are a crucial part of the
success of the revitalization of downtown.
These streeteries and the business that run them deserve the support of the city government
and must remain open.If Bremerton is to continue to thrive, elected and appointed officials
have a duty to help small businesses to thrive and bring even more business downtown. If that
means that three cars have to park elsewhere,I think that price is a small one to pay.
Thank you,
Lynn Forster

Dear Mr Mayor,
This is Derek, one of the owners of a core downtown Bremerton business,Fingers
Duke, and one of the owners of the building at 523 4th St.
It has come to my attention that you have decided to abolish the much beloved out
door dining areas on 4th street, specifically those attached to Local Boys and The
Remedy.I am writing to tell you this is an overwhelmingly bad, maybe even stupid
idea, and I urge you to reconsider.
As one of the businesses directly impacted by the existence of an outdoor dining
space immediately outside my front door,we love it.These spaces bring a sense of
life and community to out downtown which was severely lacking prior to their
construction.Everytime I walk or drive down 4th in the evenings when these spaces
are in use,our city feels lived in and energized and always brings a smile to my face.
Sacrificing a couple parking spaces to provide gathering spaces for people is a small
price to pay.Too much of our downtown already feels like it is just a parking lot for
the shipyard and the ferry, not a community or business hub.Cars do not provide
anything to our downtown, people do,and people need places to exist together in
our town.
Another thing to consider is the safety of our downtown.Studies have shown that
outdoor dining areas actually cause cars to drive slower through the community,
making our streets safer for pedestrians. Also,we have witnessed several occasions
where people using these spaces have serves almost as a community watch, since
bringing more people out onto the streets puts more eyes on all the
activity happening on those streets, allowing the community to help keep a look out
for each other.
We Want Out Streateries
I urge you to reconsider your order to remove these spaces and instead work with the
community to put in a place a permanent program to ensure our streateries can
thrive long term. The business owners I have talked to are more than happy to invest
in improving the quality and aesthetics of their outdoor dining areas, but they need
assurances from you and the city that those efforts will not be in vane.
Thank you for time, and I trust that you will make the correct decision on this matter.

Timeline Learning Curve / FoSC Submittals To City Gov. Re Evergreen Pointe / SMP Rigging
Initial Phase Of City Government’s Cover-Up Of DCD’s Rigging Of Wesley Larson’s $57 Million
Opportunity Zone Evergreen Pointe Project & Shoreline Master Program Malfeasance
_________________________________________________________________________________
Tawdry History Of City Scheme To Elevate Hucksters’ Marketing Over State Law, Smothering
The “Weak Voice” Of The Low-Income While Invoking Their Poverty For Funding
Before Andrea Spencer's tenure as Director of a corrupt Department of Community
Development (DCD) began, the agency was headed by Chris Hugo. He was terminated
suddenly by mayor Carey Bozeman in Bozeman’s drive for “revitalization.” Hugo was clear that
corruption was why he was fired:
"… When I arrived in 2000 … Frankly, it was the most dysfunctional planning
environment I had ever seen. ... I easily accept that the Mayor and I have
different perspectives on public service. I hold to the planning profession's
Code of Ethics that states that the long-term public interest takes precedence
over short-term and special interests . ..."
"Text of Chris Hugo's Farewell Letter , " Kitsap Sun, 9-14-06. After firing Hugo, Bozeman claimed
he had "hoped Spencer would apply for the job. He said she walked into his office the next
day ..." "Interim Bremerton Planning Manager Given Permanent Job ," Kitsap Sun, 10-26-06.
With private interests elevated over the public, DCD was approving high-rises and skyscrapers
right on the beach. The first iteration of the Evergreen Pointe project in 2009 brought by Mark
Goldberg involved Andrea Spencer simply, silently disregarding the “dimensional” variance
permit requirements of the Shoreline Management Act regulation WAC 173-27-040 so she
could side-step the 35-foot height limit DCD acknowledged to “allow” Goldberg 61 feet.
By October 2010, a Parametrix “technical memo” attributed to David Sharrard appears in the
record pointing to an “Isolated Shoreline” designation making “shoreline regulations generally
inapplicable.”
This gibberish demonstrates that Bozeman’s city attorneys resorted to cynical gaming of the
law to allow shoreline development by feigning authority (without basis) rather than
undertaking real analysis; the “shoreline regulations generally inapplicable ” is not explicated.
This is a culture of expedient deceit and simulacra in Bremerton’s planning leadership.
FoSC - 1 of 20.
3 Iterations Of The Evergreen Pointe Project 2008 To Present – all rigged by Andrea Spencer
1. Mark Goldberg’s 2-Building project was explicitly identified as a Shoreline Management Act
controlled project. Its illegal 61 feet in height achieved by simply side-stepping the variance
criteria. https://drive.google.com/drive/folders/1OPLGnbwU9CATDrLOj8lqK9dISSZZfYDe
https://drive.google.com/file/d/1EvFfNeZNXciAMXIXmJOwCHxZjfM0QPmJ/view
2. Trish Williams / Park Place 2-Building project, was a “revised” permit with lowered height
https://drive.google.com/drive/folders/1IDlFZtiO4NNBbVdhqljkmMKCznvLGvaC
3. Wesley Larson / SWG’s 1-Building project, 61 feet in height (piecemealing / spot zoning,
segmentation prohibited by Merkel v. Port of Brownsville, other ultra vires violations of SMA)
https://drive.google.com/drive/folders/1lziQcKlmgFjbV_O9lZEX5Al2zlyYOIuE
However, before DCD and Wesley Larson attempted to foist the current illegal one-building
design of his rigged Evergreen Pointe project on the public he simply sought to purchase and
sell the project with “entitlements” as they existed in the Park Place middle iteration (#2) as a
two-building project on two parcels divided by an old alley (BB13 0076, BB13 00762) to be
sold to Olympic College for $42 million. See Public Records Act Response From Olympic
Colleg e . The college balked, rejecting pressure from SWG to violate procurement ethics.
FoSC - 2 of 20.
Public Records Act Response From Olympic Colleg e .
The first known result of the close association between Larson and Spencer was the gift of
HUD CDBG monies directly to SWG without real competition for Larson B-Flats Apartment in
his Quincy Square development. And this was based on contractual promises of affordability
which never happened and are long forgotten because Wesley Larson acts with impunity in
Bremerton thanks to a suborned servile municipal government.
Soon after the time FoSC saw through city government’s fraud upon the public with the
Evergreen Pointe, using the testimony and definitions of planner Garrett Jackson , the Kitsap
Parcel Search mapping system showed 30 + shoreline parcels in which the mere existence of a
road abutting or in the shoreline parcel created faux “isolation” such that per Jackson, “it
doesn't seem appropriate to be having those properties meet shoreline code .”

FoSC - 3 of 20.
“Map E” of Ordinance 5417 was the deployment of the “Interrupted Buffer” artifice specifically
for Wesley Larson’s Evergreen Pointe project. But the “Interrupted Buffer” ruse also promised a
city-wide shoreline future with unauthorized discretion for DCD to suspend the Shoreline
Management Act throughout the city on the fake “criteria” of any road – unmapped parcel by
unmapped parcel.
FoSC - 4 of 20.
This background as well as state shoreline law was unknown to FoSC when we mistook this
notice sign (BB23 00621) for trash, face-down on the site of Wesley Larson’s $57 million dollar
Opportunity Zone Evergreen Pointe project site. It was our first “notice” the “Shadowcaster”
was being resurrected with SWG using the misleading moniker “Student Housing Owner, LLC.”
No lay person eyeing this “notice” would be apprised this was a shoreline jurisdiction project.
Eventually, in November 2023, FoSC and neighbors realized we had been outright gas-lighted
on the law for the entire continuum of the Evergreen Pointe’s arc by the DCD and the rest of
municipal government, and that construction was imminent. We still had a learning curve
ahead of us, but deduction from existing law meant the E.P. was an irremediably void sham.
Neither our Constitution, nor RCW 42.52.070 (adopted in Bremerton’s § 2.96.030) and certainly
not the Shoreline Management Act’s RCW 90.58.020 allow special piecemealing / spot zoning
enactments or land use treatment in the state’s shoreline jurisdiction, and this is what the ruse
of DCD’s “Interrupted Buffer” / “Map E” artifice was – a piecemealing regime, with the
concrete manifestation of this insupportable artifice uniquely concocted, and placed in an
official but sham decision of 10-11-22 (p.6) , for Wesley Larson. Later, a PRA request shook
loose a 6-4-24 “draft” "Type II Building Permit Decision" for BB23 00621. As explained by DCD,
such “Type II building permit” meant notice would not be given to the public in the future.
FoSC - 5 of 20.
In November 2023, we emailed city government and the Kitsap Sun with photos of road
warning signs which had appeared on Sheldon along Larson’s Evergreen Pointe site; within an
hour or two of that, the signs disappeared; city government has stalled the project ever since -
without a formal published decision, neither granting nor allowing the E.P., while claiming the
permit was “under review.” This three year decision-less stall, another special favor, prevents
appeal. Since 2023, city government, in collusion with SWG, and Larson’s government
sycophants and “influencers” has fled accountability to conceal this land use malfeasance.
Internal DCD memos and communications obtained via Public Records Act shows the bad
faith and artifice of the Shoreline Master Program provisions, “Interrupted Buffer” / “Map E” -
city government’s fraud benefited Larson, and this fraud fooled the Department of Ecology,
and not only as to one project, but the entire multi-year SMP periodic review process of 2019-
2021 defined by Washington state law to advance the mandates of the Shoreline
Management Act: RCW 90.58.080(4) and WAC 173-26-090. This process requires citizen
participation and input, but through planner Garrett Jackson’s deceit and omission of law in
the SMP periodic review process, citizens were misled and manipulated such that intelligent
meaningful participation was obstructed. With no one stopping this abdication of the state’s
public trust doctrine duty, city planners and those officers abetting them minimally committed
the crimes of false report, false statement, and official misconduct (RCW 42.20.040, RCW
9A.76.175, RCW 9A.80.010). This malfeasance has been hidden by city government and Larson.
FoSC - 6 of 20.
FoSC are the lay people responsible for grasping Andrea Spencer’s malfeasance and
favoritism. Our public comment speech was gagged and obstructed because of this. This
author is a Puerto Rican who lives in precarity, who has experienced homelessness, slept
outside including in parks, and whose people – like other colonized people of color - have
lived through generations of displacing gentrification, and the political marginalization of
corruption driven by gentrifying wealth hoarders and developers’ policies of greed branded
“revitalization..” This is literally my personal experience, my people’s history, and the cultural
knowledge and learning of Puerto Ricans, and my family, including on an academic level.
Our first engagement with city government was to object to harmful gentrification impacts of
the Opportunity Zone Evergreen Pointe project (here and here). This project represents the
abdication of the rule of law, including environmental law, and not only the abdication of
public trust doctrine duty, but the studied concealment of that abdication. After a year of
briefs, requests for accountability, and objection to government favoritism, this author came
to city council as a Puerto Rican whose people have historical and personal knowledge and
experience with “revitalization” corruption and the tampering of legal process not only by
developers but by corrupt, racist, aporophobic government officials. See Activists block £145m

were on Nov. 2023, Nov. 2024; Dec. 2024.
When this author identified and condemned corruption at council he also identified himself as
having experienced homelessness, pointing out how this government uses the homeless for
orchestrated PR stunts as with the much applauded yet fake $100K donation from Sound
West Group associate Chris Tibbs to the mayor “to combat homelessness” - staged right after
the cruel 2023 “sweeps” of tent communities and destruction of property condemned by
Joslyn and Robin.
We also decried and proved council’s mendacity and degeneracy. When we see a Denise Frey
berate fellow elected officials for espousing well known legal principles such as as planning
commissioners embodying conflict of interest (Jack Paauw) - "I will say once again, it bothers
me that the word 'development' and what it represents in this city is seen as some kind of a
foul word. Development is goood if it's for our city. It's for the people who live in our city. It's
necessary. If we don't develop, we stagnate and die" - we see stupidity or corruption. See “10-
9-24 City Bends The Knee: Sound West Group Installed In Planning Commission Via SWG's
Jack Paauw” https://youtu.be/ABerCusd3_c And she can’t be that stupid.
FoSC - 7 of 20.
Thus, city government has covered up this special favor for SWG for years. Yet, we’ve recently
learned that within three months of our first in-person council criticism Dec. 18, 2024 here,
council member Anna Mockler agreed with our key contentions about Spencer’s Evergreen
Pointe / SMP malfeasance. But SWG does not allow public candor and Mockler has been
utterly mute on this malfeasance while joining city hall’s sport of persecuting the homeless.
FoSC - 8 of 20.
Bremerton’s City Government Deception, Mendacity, Malfeasance & Abuse
The first lie we confronted – one DCD concocted in 2019 - has gone unacknowledged by city
government to this date: the lie goes that Smith Cove in Evergreen Park is “isolated” by
Sheldon Blvd such that the city can disregard and suspend state law, the Shoreline
Management Act of 1971 (SMA), and suspend it on a parcel basis.
This “separation” = “isolation” premise underlies DCD’s years of “planning,” permitting, and a
flight from accountability. Andrea Spencer has called our criticisms “slanderous, libelous, and
false” in her formal complaint against Jane Rebelowski when Rebelowski agreed in texts that
Spencer and SWG were a corrupt union or “scum” as she put it. See:
Corrupt Spencer Vs. Ethics – She Claims Defamation & Hostile Work Environment

FoSC maintained for years that DCD “planners,” intentionally mislead the public during formal
hearings in which they give presentations ostensibly to inform the public’s decision-making
and input before the action to be voted upon. The sabotage of the BHA shelter/housing
project is the latest example. But this conclusion was arrived at after reviewing the reality-
defying gas-lighting from DCD as to the Larson’s Evergreen Pointe project (proposed to be on
Sheldon facing Evergreen Park). Given the puerile personalities involve, the BHA sabotage may
have been inspired by retaliation for our critique of the Spencer’s E.P. fix for Larson.
FoSC - 9 of 20.
Governmental misleading the public in formal presentations and hearings is fundamental
malfeasance. Washington imposes a duty of candor upon our “public officers” to not lie to or
mislead us. One such statute is RCW 42.20.040 . It mandates that:
“Every public officer who shall knowingly make any false or
misleading statement in any official report or statement, under
circumstances not otherwise prohibited by law, shall be guilty of a
gross misdemeanor."
Official gas-lighting has been so routine in Bremerton that this author had to struggle with his
sense of reality as an ex-paralegal. We had to research to ask ourselves is this ok? Can this
wall to wall lying from local government be acceptable in our supposed democracy? The
answer is that the public has a First Amendment right to receive material information and
ideas which are not misrepresentations and/or omissions of applicable law. This official
mendacity is damaging to the lay public, especially to those who are already marginalized and
powerless. When a municipality’s government is merely an extension of the “marketing” of
powerful private interests, such official mendacity smothers our voices and agency - erasing
and disenfranchising us. As a Puerto Rican, I know a corrupt dishonest government leads
directly to abuse and suffering of ordinary citizens and the poor. It is why my first in-person
comment before council was this on 12-18-24: https://youtu.be/6V9MqEtOtVE
My “I am not safe” became true as the supposed danger we posed for our criticism of
corruption, and the threat of police intervention was invoked by Wesley Larson, his SWG
partners, by council, and by a police chief who calls the homeless “vagrants” Council members
were quite comfortable equating this author as a terrorist (Jennifer Chamberlin), while another
invoked active shooter training because “they’re going to be killing me” (Denise Frey).
The problem for Andrea Spencer, city officials, and Sound West Group – all now circling the
wagons - is that this author does not bother to speak or write unless our contentions have
the authority of law underlying our point. This is the result of my training and experience. This
is the intellectual labor of historical and evidentiary assessment, logic, and research. This is
simply the tradition of American legal rationality – in which in a tribunal there are
consequences for veering from the truth or from an objective assessment of law and how it
applies or does not to given facts. Debate in this tradition demands the explicit identification
and reasonable explication of supporting legal authority and rationales, including authorities
adverse to one’s position or advocacy. Such intellectual honesty is in most instances utterly
absent in city government discourse, hearings, and public processes. And this type of
malfeasance unfailingly inures to the benefit of dominant developers. A nation of laws not of
men is not the rule in Bremerton. Here, the caprice of prominent “developers” and their
government enablers holds democracy and the most powerless hostage.
FoSC - 10 of 20.
Context / Timeline Of FoSC Comments Submitted To City Government
The following is a chronology of FoSC submittals to demonstrate that this city government
had all the factual and legal information it needed years ago to come clean, and hold officials
accountable. The city planners and city attorneys are wedded to malfeasance and servility to
prominent developers; the rest of municipal government has steadily fallen in line such that
the entirety of city government leadership is now criminally complicit.
Backdrop Of Municipal Deceit Is Seen In Planner Garrett Jackson’s Public Lies
Planner Garrett Jackson’s Misleading Reality-Defying Presentations {here ), and the internal
DCD memos revealing DCD’s insupportable artifices ( here ) do not survive actual analysis .
Prohibited shoreline jurisdiction piecemealing / spot zoning just for Wesley Larson’s Evergreen
Pointe project was the first malfeasance FoSC discerned and this was accomplished via
planner Garrett Jackson’s nonsensical blather – in which the criteria of any road in a shoreline
parcel “separating” the shore from developments such that fictional “isolation” made it
“appropriate” to suspend the Shoreline Management Act and Shoreline Master Program.

Adoption of “Bremerton2044” On 6-4-25 Without Shoreline Management Act Consideration
This author’s comment: “Comp Plan Violates GMAs RCW 36.70A.480 By Erasing SMA To Hide
Evergreen Pointe Rig” https://youtu.be/6zXwTSV6TMw:
"Jose Camacho, Friends of Smith Cove. All of that has a big gaping hole and
that is the Shoreline Management Act. And that Act is required to be
considered, discussed, and voted upon by the Growth Management Act. The
Growth Management Act at RCW 36.70A.480 which I cited in June of 2024. It's
mandatory. They gotta consider it anew. No matter what DCD did before. That
statute says you must make sure that the SMP, any policy or criteria, any
development of the shoreline is treated in a special way. Not under general
dreams, or wishes, not under the 4th Action Stree - whatever. It is state law. It
comes from the constitution, and the public trust doctrine. The Growth
Management Act says this is distinct, independent, special. It's to prevent
piecemeal - uncoordinated piecemeal development, which is presumed
harmful to the shore. It's an environmental law. It hasn't disappeared. DCD is
making it disappear. The developer cartel wants to make it disappear because
once it is made to disappear, it's a cash cow. It's why from 35 foot the
proposed Evergreen Pointe is now at 61 foot, from $42 million to $57 million. I
am not saying that DCD is a maniac. They might be very fine people. But for a
particular focus, they decided to look the other way to subordinate
information, to create information silos, and basically eliminate shoreline law -
state law - Biggers versus Bainbridge - state law that is effective, that's
required. When I complained to the city at various points, the rigged
Evergreen Pointe, Map E, the shoreline master program, comp planning,
current comp planning, it was about the disappearance of the Shoreline
Management Act as a criteria. It's literally been disappeared. When I see
Garrett Jackson talking about the Evergreen Pointe project as part of comp
planning, it's disappeared. He made it disappear. We asked the mayor and
Coughlin to discuss Map E, and how that represented favoritism from DCD to
Sound West Group. It was silence. 'We can't talk about a pending permit.'
Guess what? 20 months later, that permit is still pending. You know why? Cuz
it's dirt. They're waiting for the comp plan. They're going to do something.
Saw a tractor at the E.P. site a few days ago. So they're turning the waterfront
into a cash cow by eliminating state law. It's a special favor. It's
unconstitutional. And it's also inconsistent with the Growth Management Act."
FoSC - 14 of 20.
FoSC participated throughout the “Bremerton2044” Comprehensive Plan starting on
November 2023; despite our comments and objections based on the Shoreline Management
Act as a required component of analysis in all comp plans, this process was without Shoreline
Management Act application as required by RCW 36.70A.480, RCW 36.70A.020(15), RCW
90.58.020, RCW 90.58.320, etc.
One month before the vote for and adoption of “Bremerton2044” (6-4-25) planner Garrett
Jackson presented that the city would revise its SMP starting in the “2nd half of 2025” to
“update allowed uses consistent with Comprehensive Plan update.”
Obviously, the city was avoiding facing up to its malfeasance and protecting Sound West
Group, whose director Jack Paauw had been made a sitting planning commissioner after FoSC
spent a year informing the city of its malfeasance in the rigging of Paauw’s Evergreen Pointe
and SMP periodic review process (2019-2021) to enable that rigging. City government rolled
out and voted on “Bremerton2044” such that it had zero SMA consideration. The current SMP
proposal cannot be made consistent with a comp plan which never addressed the SMA. "the
SMA trumps the GMA in this area ..." Biggers v. City of Bainbridge Island, 124 Wash. App. 858
(Ct. App. 2004), accord, Biggers v. City of Bainbridge Island, 162 Wash. 2d 683 (2007).
FoSC - 15 of 20.
As it turns out, the Department of Ecology had in fact admonished planner Garrett Jackson to
keep the SMP in mind throughout the comp planning for consistency between the SMP and
GMA:
Within two weeks, planner Jackson did the opposite; he stripped all of his presentation and
discussion as to the Evergreen Pointe project – as part of the comp plan presentation – of any
trace of the Shoreline Management Act. See 2-27-23 “DCD Cons Us, Erases Shoreline
Management Act, & Never Discloses E.P. Project's 35-Foot Height Limit ”
https://youtu.be/qqTznzYA9G4 The disconnect avoided admitting DCD’s malfeasance.
Demonstrating that evading accountability – covering up malfeasance and protecting Sound
West Group – is an all-of-city-government effort, is the unethical “attorney opinion” submitted
by city assistant attorney Brett Jette claiming FoSC’s argument was “inaccurate.”
FoSC explicitly cited RCW 36.70A.480 and the sham analysis of the city attorney assiduously
avoided addressing RCW 36.70A.480. It also avoided dealing with the fact that as laid out by
FoSC, DCD’s “Interrupted Buffers” was a city-wide artifice affecting shoreline parcels, with
“Map E” being concrete evidence of an “Interrupted Buffer” resulting in the site-based erasure
of the Shoreline Management Act. See written Comment No. 125.
FoSC - 16 of 20.
Rather than addressing citizen input, the city through its attorney engaged in misleading
obstruction of informed participation. The attorney memo is deceit itself - a violation of
attorney Rules of Professional Conduct 3.3, Candor To The Tribunal, and 4.1. Truthfulness In
Statements To Others:
Rule 3.3: “… Legal argument based on a knowingly false representation of law constitutes
dishonesty toward the tribunal. A lawyer is not required to make a disinterested
exposition of the law, but must recognize the existence of pertinent legal authorities.”
… Legal Argument
[4] Legal argument based on a knowingly false representation of law constitutes
dishonesty toward the tribunal. A lawyer is not required to make a disinterested
exposition of the law, but must recognize the existence of pertinent legal authorities.
Furthermore, as stated in paragraph (a)(3), an advocate has a duty to disclose directly
adverse authority in the controlling jurisdiction that has not been disclosed by the
opposing party. The underlying concept is that legal argument is a discussion seeking to
determine the legal premises properly applicable to the case.
Rule 4.1: “"A lawyer is required to be truthful when dealing with others on a client’s
behalf, ... Misrepresentations can also occur by partially true but misleading statements
or omissions that are the equivalent of affirmative false statements."
The city attorney’s bad faith memo facilitated and buttressed DCD’s misrepresentations,
erasure, and malfeasance – as it has continued to do for years.
The recent revelation during the current SMP review by Ecology that retired ecologist council
member Anna Mockler agreed with FoSC about DCD’s flouting of the SMA as to the Evergreen
Pointe project happened through our Public Records Act request to the Dept. of Ecology .
Mockler remained mute about her agreement with FoSC. This concealment was then followed
by the “One Voice” censorship of Anne Williams of Anna Mockler to hide Mockler’s agreement
with FoSC: https://drive.google.com/file/d/1uwtdC79veIhQV-vqk2tECIJTtoyi99GQ/view By
such censoring, city government maintained the public stance that the public was
uninterested in commenting on the current SMP proposal. This would again inure to Wesley
Larson’s benefit by hiding DCD’s piecemealing malfeasance. DCD’s current SMP proposal
continued the piecemealing / spot zoning malfeasance while attempting to hide it from
Ecology and the lay public, and attempting to hide FoSC’s continuing objections to this SMA-
flouting malfeasance.
In fact, FoSC had objected before the planning commission during an SMP presentation to the
continuation of Andrea Spencer’s rigging and of the resulting infirm SMP provisions on 10-20-
25 while we were gagged in the city’s so-called “pause” which was instituted 10-1-25 without
notice or resolution. We adopted our prior comments and strenuously objected to the SMP
FoSC - 17 of 20.
despite commissioner (now council member) Rick Tift’s overt aggressive and misleading
obstruction of our public comment objections, along with Andrea Spencer’s personal bad faith
interjection, which included the commission’s un-noticed on the spot ad hoc adoption of
council’s “pause” on our free speech as we walked into the commission forum. See 10-20-25
planning commission hearing on 2025-2026 SMP proposal.
Violating the public’s right to receive information material to the hearings / presentations
before the public, in public processes requiring citizen input, Bremerton’s municipal
government intentionally side-stepped law, misrepresented law, concealed and engaged in
calculated omissions including of actual applicable law:
Washington’s Constitution, Article 17, and the Public Trust Doctrine;
the Shoreline Management Act including but not limited to its piecemealing
prohibition RCW 90.58.020;
the need for the “Bremerton2044” comp planning process to address Shoreline
Management Act criteria pursuant to RCW 36.70A.480;
“Interrupted Buffer” / “Map E” ramifications;
Cumulative impact pursuant to Hayes v. Yount (87 Wn.2d 280, 1976);
Controlling WACs such as the 5,000 dollar threshold test of WAC 173-27-040;
The half-century jurisprudence of the SMA such as Biggers v. City of Bainbridge Island,
124 Wash. App. 858 (Ct. App. 2004); Biggers v. City of Bainbridge Island , 162 Wash. 2d
683 (2007); Merkel v. Port of Brownsville, 8 Wn. App. 844, 509 P.2d 390 (1973)
including the prohibition against segmentation; Sisley v. San Juan County, 89 Wash. 2d
78, 569 P. 2d 712 (1977), etc.
After its cover-up efforts, the city government attempted to conceal FoSC’s continuing
objections on 10-20-25 to the above and other malfeasance which continue to be embedded
in the new proposed SMP. Such years-long concealment and evasion evinces a commitment
to abdicate responsibilities to uphold the public trust doctrine. Other government officials
aside, it is impossible to conceive of Bremerton’s core planner team remaining in their
positions. The recent cynical manipulative city sabotage of the Bremerton Housing Authority
attests to the incorrigibility of this team. The massive waste of time, resources, and depth of
malfeasance by these developer operatives demands they be terminated and prosecuted.
They did not commit good faith error, but a betrayal of the state’s trust in delegating SMP
compliance to Bremerton – which abdicated the public trust, then concealed its abdication,
FoSC - 18 of 20.
gamed the legal process over years to that end, and gagged the citizen critics who discovered
the betrayal and malfeasance and sought accountability in briefs and at the public forum.
This is a fundamental issue of the nature of government itself, of protecting the common
good and our public natural resources as a duty of the sovereign towards We The People, and
the duty of every public official to protect and uphold duties to safeguard government from
the caprice and acquisitiveness of powerful private interests.
"Because of the doctrine's constitutional underpinning, any legislation that
impairs the public trust remains subject to judicial review. This includes the
SMA. ‘Holding otherwise [would] elevate [] an exercise of the legislative power
above the constitution, which is anathema to our system of law.’ ... "[W]e have
always embraced our constitutional responsibility to review challenged
legislation, including legislation encompassed by the SMA, to determine
whether that legislation comports with the State's public trust obligations." …
“we have always embraced our constitutional responsibility to review
challenged legislation, even legislation encompassed by the SMA, to determine
whether that legislation comports with the State's public trust obligations.
Caminiti, 107 Wn.2d at 670. We decline to abdicate that responsibility now.”
Chelan Basin Conservancy v. GBI Holding Co., 190 Wn.2d 249, 267 (2018).
In various ways, city government here bent to the will and caprice of the Wesley Larson’s
Sound West Group cartel / oligopoly. One of those ways was to deprive FoSC, allies, and the
public of its Constitutional rights to free speech at the public forum, and of the Constitutional
right to receive full material information from its government. It also appears the sabotage of
the BHA shelter / housing project was born out of that same well of vindictiveness, egotistical
greed and caprice as shown in these Sound West Group – Denise Frey collusion emails . These
show not merely the violation of the appearance of fairness doctrine, but the actual scheming
of Wesley Larson / Sound West Group, Denise Frey, planning commissioners, and other local
government officials to institute and ensure intentional unfairness – an advantage for the SWG
oligopoly over the public – to run a private District 2 “master plan” influence campaign for
land use parallel to and at the same time as the “Bremertonw2044” comprehensive planning
by Sound West Group actors, particularly Jack Paauw – the validity of the “Bremerton2044”
comprehensive plan is doubtful on this ground as well as what we’ve argued previously.

Streateries and parking

Hello Brem City Council
I wanted to voice my support for keeping the streatery program in place that has been
informally setup with several downtown businesses such as Remedy and Local Boys. These
are clear positives from 2 key perspectives:financial and communal.
For the space of 1-2 vehicle spots apiece,we gain seating for dozens of people. This puts
community and energy in our core downtown which is critical in making it a "3rd place"at
which people want to spend money and time.
Secondly,we have to always consider trade offs in policies. In this case this would mean
reinstalling "free"street parking."Free"is a loose term.As has been well documented in
research by Donald Shoup and others, generating no financial income on land requiring
building and maintenance is a negative ROI.Indeed nothing in life is free.
Well in excess of 50%our core downtown land is used for parking, often free.If this
approach is such an attractive one for our city and local businesses why haven't these policies
resulted in an ever stronger downtown after decades of this strategy?Perhaps we can benefit
from more balanced approaches.
Thanks for your consideration and taking the time to read this,
Dever Graham

The recent collusion emails, showing improper conduct,
scheming,and malfeasance,including through the acts
of a long-conflicted Jack Paauw and the SWG shill
Denise Frey, were obtained from the city clerk via
Public Records Act requests.
Violation of 18 U.S.Code,Section 242
The right of the public to receive material non-
misleading information and ideas from our government

is a foundational First Amendment right, and long
recognized in our federal and state Constitutions. See

The cynical manipulative aporophobic hearings and
objections against the Bremerton Housing Authority
shelter /housing project which my friends and I were
subjected to in the planning commission and city council
omitted crucial and applicable law to the matter. This
tactic of misrepresenting and omitting actual law which
the public has a right to receive from city government,
and must receive to fully participate in democracy,is a
long-standing objection of Friends of Smith Cove -since
the tactic was demonstrated in DCD's rigging of Wesley
Larson's Evergreen Pointe project, and the rigging of
the 2019-2021 SMP periodic review process to enable
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
the E.P.rig.It is a First Amendment violation every bit as
much as the so-called "pause"Sound West Group and
city government inflicted on its critics and the general
public.
This tactic violates 18 U.S.Code,Section 242 and can be
remedied including through punitive damages pursuant
to a Section 1983 Civil Rights action, and the Fair
Housing Act.
Contract Between BHA &City Of Bremerton
In Washington, there is in every contract an implied duty
of good faith and fair dealing which "obligates the
parties to cooperate with each other so that each may
obtain the full benefit of performance."Rekhter v.DSHS,
323 P.3d 1036,180 Wash.2d 102 (2014).The agreement
between the BHA and Bremerton explicitly incorporates
the BHA’s plan for its hybrid shelter project, and
nowhere written or implied is there any preclusion of the
1231 Sheridan site.
That agreement states:
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
"The Parties NOW,THEREFORE,agree as follows:
AGREEMENT:
1.PURPOSE,RECITALS AND ATTACHMENTS
INCORPORATED.The Purpose and Recitals set forth
above and the Attachments,Resolution No.3375 and
the January 10,2024 City Council Presentation, are
expressly incorporated into the Agreement by this
reference...."
The Interlocal Agreement as to the BHA project is a
contract, and it was and is being ignored as THE
controlling factor in the BHA project. It is a government
to government contract with an effect.
As evidenced by this contract, cooperation was the point
of BHA working with the city to help low-income and
homeless Bremertonians, and no one in Bremerton's city
government had a problem with leaving the siting of
BHA's project open-ended.Or it would have been so
noted explicitly in the contract. That's how contracts
work.
That is why we see Denise Frey extolling the BHA project
potentially being located in her District 2.See “1-17-24
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
Denise Frey Vouches For BHA Hybrid Shelter Project &
For Her Own Dist.2 As Its Location”
https://youtu.be/dnJ8GPUuw7E
There was zero problem with open-ended siting until
Wesley Larson and Jack Paauw asked council member
Denise Frey to join their "ad hoc"influence campaign for
District 2 land use. This was unknown to the public. That
influence campaign included Dr.Tara Kirk Sell -a sitting
planning commissioner who sat and deliberated at the
planning commission hearings. Her part in Larson's
influence campaign was unknown to the public.
What we now know from these recent emails is that after
voting twice for the BHA project,it was only a matter of
2-3 weeks after the last vote in favor of the project
that Frey changed her tune, and started to prepare to
undermine the BHA contract and project with pretexts
for sabotaging it -reaching out to SWG and Andrea
Spencer soon thereafter -divulging confidential
information of the location of the BHA project -a
disqualifying malfeasance.
By 4-17-25,Denise Frey emails Sound West Group
partners, Marianne Weber,and planning commissioner,
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
Jack Paauw:
"I'd really like to be able to speak to the loss of tax
dollars ...I think the time for this is coming soon
and I want to be prepared.Has there been any
progress in assessing this?"
The bad faith pretextual nature of this malfeasance is
easy to spot.During the last MFTE discussion (May 2025
to Sept.2025)the evidence showed there is a 2 million
dollar loss in such tax revenue from multifamily
developers such as Sound West Group.
Constitutional Prohibition Against Impairment Of
Public Contracts
This municipal government is in bad faith violating
superior law which it has no authority to flout.Bremerton
cannot disregard the Federal or state Constitution. But it
does with shameful casualness.
City government, including the mayor and city council,
cannot impair the BHA contract with the city by
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
misrepresenting law, then voting to flout the contract
and keeping the law hidden from the public. This time,
Constitutional law:impairment of contracts is
Constitutionally forbidden.Washington’s Constitution,
Article 1,Section 23,and U.S.Constitution,Article 1,
Section 10.
The three part test for legislative impairment of public
contracts is:1.whether a contractual relationship exists;
2.whether the legislation substantially impairs the
contractual relationship;3.whether the impairment was
reasonable and necessary to serve a legitimate public
purpose.Caritas Services v.DSHS,869 P.2d 28,123
Wash.2d 391 (1994).This threshold is easily met in the in
the BHA's favor -which is to say in the favor of the
homeless community you seek to crush and drive out or
monetize.
Pursuant to known Treasury regulations, there is a
December 2026 deadline beyond which ARPA funding
will be lost.
The project's ARPA funding which city government has
so recklessly and capriciously been willing to risk is a
result of and part of the contractual underpinning
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
relating to the operations of the US Treasury Dept. The
contract between the BHA and the city, and rules
establishing deadlines and the obligation of such
funding is within the domain of Federal authority which
Bremerton's capricious sabotage efforts
impermissibly impairs.
FoSC is adopting and incorporating herein the rationales
and precedents of United States v.Commonwealth of

The US Treasury Dept.maintains an OIG which monitors
for and combats waste and fraud, including involving
ARPA funding. We are reaching out to them as well as
the DOJ.Therefore, pursuant to the Public Records Act,
provide us all Treasury communications,textual
materials,literature,permissions,exemptions,
exceptions, and authorizations for any action on the
city's part other than fully authorizing and expediting
BHA's use of its full ARPA funding and allowing its
project to move forward so that the low-income public
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
does not lose the benefit of any portion of said ARPA
funding for the BHA project on its 1231 Sheridan site.
The city has full ability and legal authority under the
Housing Cooperation Law to immediately pass a
resolution excepting all supposed barriers cited during
the planning commission and city council hearings in
this matter.See RCW 35.83.030 and RCW
35.83.060, further discussed below.
Governmental Status &State-Level Mandates Of
BHA
The Bremerton Housing Authority exists independently
of the city as it is authorized and empowered through
the Housing Authority Law,Chapter 35.82 RCW.
The BHA exists is a manifestation of Federal and state
law and policy specifically for the production of low
income housing.City government,and Denise Frey's
friends in the Sheridan Community Alliance, has elided
the governmental status of the BHA and its mandate –
one which the city has itself abandoned in favor of
Denise Frey and SWG's wet dream of "market rate"
unaffordable hyper-gentrification.
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
The BHA mission derives from the state’s declaration of
the necessity for low-income housing.Municipal level
graft,Larson's caprice, whim,or aporophobia cannot
impinge on state policy:
RCW 35.82.010 Finding and declaration of
necessity.

insanitary or unsafe dwelling accommodations and
that persons of low income are forced to reside in
such insanitary or unsafe accommodations;that

persons of low income can afford … these conditions
necessitate excessive and disproportionate
expenditures of public funds for crime prevention
and punishment, public health and safety, fire and
accident protection, and other public services and
facilities;(2)that these areas in the state cannot be
cleared, nor can the shortage of safe and sanitary
dwellings for persons of low income be relieved,
through the operation of private enterprise, and that

the construction of housing projects for persons of low
income (as herein defined)would therefore not be
competitive with private enterprise;(3)…the
providing of safe and sanitary dwelling

public uses and purposes for which public money
may be spent and private property acquired and are
governmental functions of state concern;(4)that it
is in the public interest that work on projects for such
purposes be commenced as soon as possible in
order to relieve unemployment …and the necessity
in the public interest for the provisions hereinafter
enacted,is hereby declared as a matter of legislative
determination.”

Per BHA history (p.11) consistent with state concern,
public interest,and requirements,Bremerton passed its
enabling resolution in 1940,creating an independent
BHA:
"There is a shortage of safe and sanitary dwelling
accommodations in the City of Bremerton available to
persons of low income at rentals they can afford, and
said shortage is primarily caused by the influx of
employes of the Puget Sound Navy Yard due to the
emergent needs of national defense."

pdf
This author continues to maintain that STEP Housing law,
including RCW 35.21.683,RCW 35.21.689, RCW
35A.21.430 and HB2266,applies to BHA’s efforts as FoSC
has previously argued during the gag order the city
called the “pause.”During the joint SWG-city
government "pause"gag, city government went on an
orgy of lies and bumbling to undermine the shelter
project, its ARPA funding, and other chaff and
disinformation which has continued into the "empty
ceremony"planning commission meetings.
Housing Cooperation Law
The BHA contract “obligates the parties to cooperate
with each other.”Rekhter v.DSHS,supra.
Cooperation is also legislatively mandated by Chapter
35.83 RCW,the Housing Cooperation Law,This is tied to
the raison d'être of the BHA.The Housing Cooperation
Law incorporated into contract between BHA and the
city, details not only the duty to cooperate, but how to
cooperate:
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
RCW 35.83.030 Cooperation in undertaking
housing projects.
“For the purpose of aiding and cooperating in the
planning,undertaking,construction or operation of
housing projects located within the area in which it is
authorized to act,any state public body may upon
such terms, with or without consideration,as it may
determine:…
(4)Plan or replan, zone or rezone any part of
such state public body;make exceptions from
building regulations and ordinances;any city
or town also may change its map;…
(8)Do any and all things, necessary or
convenient to aid and cooperate in the
planning,undertaking,construction or operation
of such housing projects;...”
RCW 35.83.060 Procedure for exercising powers.
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
“The exercise by a state public body of the powers
herein granted may be authorized by resolution of
the governing body of such state public body
adopted by a majority of the members of its
governing body present at a meeting of said
governing body, which resolution may be adopted at
the meeting at which such resolution is introduced.
Such a resolution or resolutions shall take effect
immediately and need not be laid over or published
or posted.”
We who have experienced homelessness testified to this
omitted law and legal framing on 8-17-25 at the
planning commission, including but not limited to Zach,
Brandy and this author:
Zach at planning commission 8-17-26:
"Good evening, chair and members of the planning
commission. My name is Zachary Martin and I am a
resident of Kitsap County.I've lived here since April of
last year.I'm here tonight to ask you to recommend
that city council do everything possible to expedite the
homeless shelter planned on Sheridan Road. This
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
matters to me personally because I am also homeless.
I know firsthand what it's like to not have a safe place
to sleep at night. When you don't have that,
everything else becomes so much harder.Your health,
your safety, your ability to work,to think about
tomorrow. This shelter will benefit our whole
community. But I can tell you it will mean safety and
dignity for people like me,your neighbors. It's not just
a building.It's a chance to rest,to be safe,to get
stable.Bremerton is in a crisis and we need more
options for housing and shelter and we need them
now. This shelter is compassion. It's community health
and it's how we become stronger together.Investing in
this today builds a healthier,more hopeful tomorrow.I
want to be part of a better Bremerton and I hope this
shelter can help me get there. Please be part of the
solution. Please move this project forward.Thank you."
Jose at planning commission 8-17-26:
“Jose Camacho,Friends of Smith Cove.Um,Rock The
block.I'm an ex paralegal.Uh,we became Friends of
Smith's Cove because we realized the city used
calculated omission to deform the law and to rig
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
public processes and projects, including for Wesley
Larson. And what we hear from Garrett Jackson is
deception because he's omitted the actual law called
Housing Cooperation Law.With a simple resolution,it
could happen Wednesday, the council could simply
make an exception.Every single point made in the
planning commission can be addressed by resolution.
This is the law. This destroys any possibility of a spot -
zoning argument,of a location or site-based
argument. I looked through all the documents. This
has never been mentioned by any of the planners for
the city. This is how they rigged the Evergreen Pointe.
This is calculation.Law should always be taken in
context. So if you look at the law,it will tell you that
zoning,rezoning,replanning,exceptions to building
regulations,are all okay.This law acts as a
supplement to any existing law.So why haven't we
heard this? That's because someone doesn't want you
to hear this. You guys are up here,at least half of you,
I recognize you in good faith. So as a neutral
commissioner with integrity when you don't get this as
part of your input you are skewed, and the whole
public is skewed when we don't get this information.
This is how it happens. This is what happened to the
Evergreen Pointe. This is a violation of the First
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
Amendment because the public has a right to know
material information. If we don't get full information,
we're skewed. We're crippled from fully participating
in democracy. This is what happened with the 2019-
2021 SMP periodic review in which they created
Trojan horses which were then used to rig the
Evergreen Pointe. This is an incredibly cynical thing.I
just discovered this Thursday or Friday. So,it's not eas
-law is not natural or intuitive. But it must be sought.
We have professional attorneys with degrees and it's
their job to do this for us.Ordinary citizens -I'm I'm a
bum.I'm a hobo,right?-Ordinary citizens should not
have to become investigators to counteract the cynical
manipulation of city planners and city attorneys
working for developers.Thank you.”
Brandy at planning commission 8-17-26:
“Okay.Good evening.I'm here tonight urging that you
approve the shelter. The city of Bremerton has already
said yes to this project, not once, but twice. The city
committed their funding.BHA has invested in this
project, and people have spent years working on a
solution to homelessness in this community. Now
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
we're talking about throwing it all away.Throwing all
the people in desperate need of our support away.
Washington law specifically recognizes housing
authorities as public bodies created to address the
shortage of safe,affordable housing.The Housing
Cooperation Law gives cities such as Bremerton the
authority to cooperate with housing authorities such
as the BHA and specifically allows them to pass a
resolution except excepting any issues of zoning,
rezoning,building regulations,and/or amending
ordinances for housing projects.RCW 35.83.60 says
these powers can be exercised by a simple resolution
of the governing body.It is that simple. The
Washington Supreme Court addressed this very issue
in Mercy v.City of Seattle. The court recognized that
housing authorities and the municipalities working
with them have special statutory powers for
accomplishing this public purpose through one
resolution under the Housing Cooperation Law.So if
there's a zoning problem, solve the zoning problem by
a resolution exempting the zoning issue.If there's a
regulatory problem, solve the regulatory problem the
same way.If there's a contractual problem deal with
the contract and enter it in as a resolution. We cannot
keep wasting time. There's already public funding
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
committed to this project and that funding has a
deadline. If we keep delaying until the funding
disappears, then what have we accomplished?I also
want to address something else.We talk about
homeless people as though we have to decide which
homeless people are deserving. The elderly deserve
housing.Children deserve housing.Disabled people
and veterans deserve housing. But so do the people
struggling with addiction. So do people struggling with
mental illness. So do people who lose their jobs and
fall on hard times and make terrible decisions.People
who have not gotten their life back together yet still
deserve housing.Everybody deserves housing.
Everybody needs housing.Everybody deserves
somewhere safe to sleep. And if we're going to talk
about the homeless people as though they're the
threat to our community and we're going to use them
as the boogeyman, then isn't it actually more
reasonable to public safety to have them inside of a
shelter than outside with nowhere to go?A shelter
gives people a place to sleep,a place to connect with
services,a place to stabilize, and a place to begin
moving forward. You don't solve homelessness by
making homelessness harder to see.Pushing it out of
your face doesn't make it go away. You solve it by
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
giving people somewhere to go.The city already made
a commitment to this project and the funding is there.
The need is there. The legal tools exist to address the
obstacles. So,I'm asking you,do not abandon this
project.Don't delay and let it become the reason that
this shelter never gets built. We're just asking that you
pass a resolution to build this shelter.”
No commissioner,planner,nor city attorney addressed
this city-omitted law and framing. This can't be
surprising given the SWG oligopoly -city "partnership"
does long-range scheming as with the rigging of Wesley
Larson's $57 million dollar Opportunity Zone Evergreen
Pointe project and the Shoreline Master Program which
started in 2019. We exposed it in late 2023,and the city
government only stalled that project, and -except for
Anna Mockler's brief exchange with Ecology agreeing
our E.P.Project /Shoreline Management Act contentions
-city officers and leadership covered up the malfeasance
and obstructed /retaliated against our valid criticisms
and requests for accountability, and still covers up this
malfeasance to this very day.
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
Ordinary citizens should not have to struggle to
ascertain the truth and the law because of city
government's manipulations,concealment and
misleading of the public.
Since as a matter of survival we are forced to take on the
challenge of fighting your corruption and abuse,we do
the research and investigation you do not,and it shows
that the Housing Authorities Law and the Housing
Cooperation Law have been analyzed and applied by our
Courts.
Holding &Rationale Of Mercy v.Seattle &Wilcox v.
Housing Authority
Applicable case law exists.Wilcox v.Housing Authority of
the Cy.of King,66 Wn.2d 864,405 P.2d 723 (1965)and
Mercy v.City of Seattle,429 P.2d 917,71 Wash.2d 556
(1967)explain that the State of Washington enacted the
Housing Authority Law and the Housing Cooperation
Law together to permit the political subdivisions of this
state “to qualify for the benefits of the federal Low-
Rent Housing Act”for an express purpose:“to remedy
the unsafe and insanitary housing conditions and the
acute shortage of decent,safe,and sanitary
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
dwellings for families of low income.”
The rationale of the two state statutes and the
implementation of the mission to alleviate low-income
housing shortages, and their interplay to effect the
federal and state imperative to achieve actual low-
income housing is laid out clearly in the statutes
and Mercy v.City of Seattle.
Why did none of the city’s attack on the BHA even hint
at this law?
The city attorneys'office has a duty to research the law to
uphold the law.Even if they know nothing on an issue on
Day One,they have a duty to investigate and research
the law on that issue on Day Two –or before the public
is deceived by Denise Frey and DCD’s developers’
disinformation and drivel.
The verbiage and graphics we see issuing from Garrett
Jackson in this latest disgrace was free of the most
applicable law.It was for deflection,misrepresention,and
for show. There was no concern there for law or its
objective impartial application.FoSC has seen this before
with the Evergreen Pointe /SMP malfeasance.DCD
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
planners are neither attorneys nor concerned with legal
analysis. Why is Kylie Finnell paid a city salary as the city
attorney if not to prevent the color of law from being
used to defeat the rule of law and to further marginalize
the homeless and those attempting to give their dire
needs a voice?
In Mercy v.Seattle,a city council cooperated with the
Seattle Housing Authority by using the Housing
Cooperation Law,RCW 35.83.030,to except parking
space requirements for a 300 unit apartment structure
for low-income elderly. The opponent of this Housing
Cooperation Law exception challenged this as an
ordinance which did not follow the procedural steps
outlined in the city’s existing zoning code for making of
zoning changes or the granting of zoning exceptions or
variances. The Mercy Court agreed with the Housing
Authority, holding that Seattle’s city council derived and
was invested with the power to override its procedure to
enact an exception pursuant to the Housing Cooperation
Law,RCW 35.83.
This holding rests on the HAL and HCL and Mercy’s
examination and adoption of the logic of Housing
Authority of Los Angeles v.Los Angeles,38 Cal.2d 853,
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
243 P.2d 515 (1952):
“The housing authority was thereby created as a state
agency,‘a public body corporate and politic’and is not
an agent of the city in which it functions.Similarly the
city under the Housing Authorities Law is an agency
of the state, functioning under state law to fulfill
state purposes, and is not acting pursuant to its
fundamental law to effect solely municipal
objectives.(Housing Authority v.Superior Court,
supra,35 Cal.2d 550,558;Kleiber v.City &County of
San Francisco,supra.18 Cal.2d 718,724-725.)Each
functioning body, the city and the housing authority,is
a separate body politic vested with specific duties and
powers under the Housing Authorities Law and
Housing Cooperation Law to effect a state objective.
Neither is functioning independently of that state law.
In pursuing the state objective each is governed by the
state law and neither may exercise powers not vested
or recognized by that law.The city and the housing
authority function as administrative arms of the state
in pursuing the state concern and effecting the
legislative objective.”
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
In other words, the status of the Bremerton Housing
Authority as a federally and state rooted purpose-built
governmental entity focused on implementing low-
income housing means the relative postures of each
governmental body here under the HAL and HCL is one
where Bremerton must help the BHA fulfil its mission for
the low-income.This is why Bremerton in fact signed a
contract to do just that. This is a state declared interest.
Not one amenable to more of your favoritism towards
"market rate"developers. This situation was settled long
ago by the contract and by existing settled law -this was
not a situation in which the incited residents of Harrison
Heights and the astroturf campaign led by SWG's agent,
Denise Frey, could affect this settled law.In Housing
Authority of Pasco v.City of Pasco,86 P.3d 1217,120
Wash.App.839 (2004),the Court held that "a housing
authority is an independent entity and not a
department of the city.[citing Wilcox and Mercy]
Housing authorities are not meant to be responsive
to the popular will or political pressure. Wilcox,66
Wn.2d at 870."
FoSC has seen this erasure and misrepresentation of law
before -Ecology is currently having to deal with that.
There is no doubt Wesley Larson can do whatever he
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
wants in Bremerton with impunity;there is only the
question whether outside officials, and those who are
attorneys, can stomach such betrayals of the public trust.
In Bremerton, this kind of malfeasance is kept a close
secret. And they will even gag citizens for speaking of it
in the public fora.
But now we have emails catching the collusion and
malfeasance as it happened. The recently obtained
emails showing council member Denise Frey being
invited into Wesley Larson's "master plan"circle for
exploiting land use in Frey's District 2 also show that
immediately upon that invitation, she turns 180 against
the BHA,and approaches Larson's partner (and planning
commissioner)Jack Paauw to provide her with
calculations upon which to craft a tax revenue loss
argument to undermine the BHA shelter in the future.
The tax revenue loss argument is laughable because
SWG is addicted to the MFTE -and that is optional. The
BHA as a governmental body is simply given the tax
exempt privilege to aid its mission for production of low-
income housing.
The emails also show Frey so determined to make
Wesley Larson's dreams come true in District 2 that she
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
reaches out to the developer's fixer,DCD Director
Andrea Spencer, and divulges a confidence BHA Director
Jill Stanton had stated was confidential during a January
2024 hearing:the location of the site for the BHA project.
Frey's slithering towards Jack Paauw,Marianne Weber
and Andrea Spencer to sabotage the shelter project is
collusion from a council member with a private interest -
the powerful wealthy and influential "Sound West
Group"-a literal combination of private interests.
The emails showing Wesley Larson hand-picking
governmental puppets and the SWG/Denise Frey
collusion can be found here:
https://drive.google.com/drive/folders/1gF7T60Y2-
6OxK3987w8CUr1FlXJoAv6I
The emails also demonstrate that while Jack Paauw was
acting as a planing commissioner he and the rest of
Wesley Larson's SWG oligopoly were simultaneously
working on the "Bremerton2044"comprehensive plan
and devising their parallel "master plan"influence
campaign for Denise Frey's District 2. This violates the
law outlined in Buell v.Bremerton, and invalidates the
"Bremerton2044"comp plan as the product of
FW:Pass the HCL resolution!-Sabotage Of BHA's Shelter /Transitional Housing Project
intentional exploitative self-interested malfeasance. See
FoSC's previous Buell v.Bremerton objection Of 1-2-25
https://drive.google.com/file/d/1TD6EvWFO47HqQPz7X
13SHPVjqLUM8y5A/
With these emails showing misconduct in-the-moment,
it is no longer merely an appearance of unfairness but
actual intentional scheming to promulgate actual
unfairness -advantages over the public process and
ordinary citizens including the low-income. In these
machinations Wesley Larson,holding court,hand picks
more government officials for their influence (he calls
them "influencers").
Even a military officer is targeted for the influence
campaign.
DCD planners, council member Denise Frey, and Jack
Paauw have violated the public trust and fundamental
ethics.A criminal inquiry should at least start with them,
and with these criminal statutes:
RCW 42.23.070 Prohibited Acts.

My name is Robin Weldin and my written comment will be leaving out so much due
to current time restrictions. As of this writing,it looks like the council has no “

business”,but that often changes after the public can no longer send a comment in
writing or ask to include it in their oral zoom comment.
My comment is directed at the city council and Bremerton Department of Community
Development and city attorneys.I adopt Jose Camacho’s /FoSC written and oral
comments as my own.
In January of 2024 the city viuncil unanimously approved the BHA model that this city
governmenthas been actively try to kill since the beginning of 2025.We have the
emsils z as nd public records that show the sabotage of this public good that was
entered into with a contract between 2 government bodies. There was always
transition pallet shelters and nothing in the contract (approved unanimously by the
2024 council members and signed by the mayor ).The ARPA funds were obligated to
the wraparound Service low barrier hybrid shelter and transitional pallet housing
project at the end of 2024.The Bremerton Housing Authority kept their part of the
contract and even were willing to lessen the Ed benefits of it to appease the
city while it was sabotaging the shelter and refusing to comply with 3 WA state
housing statutes that require shelters and transitional housing where dwellings and
hotels are allowed and a new 2026 law that strengthened the first 3 statutes, because
cities like Bremerton were not changing local codes to be in compliance.
HB2266 states that cities cannot have predecision hearing like the slow walk already
decided circus that took place between May and the end of August in front of a
rubber stamping anything DCD “staff”recommends, developer, investor and KEDA/
SWG “influencer” stacked Planning Commission.
We the people, who care about our homeless neighbors and US and WA state laws
that are supposed to protect s as ll of us,dms d thst this city council honor the
government contract that it entered into eith the BHA in 2024.Not to do do is in
direct violation of WA state’s Housing Coiperation Law.The DCD must chaa as nge
locaa as kncides to be in compliance with 4 state statutes and the HCL.Honor the
obligation the council mad and release the US treasury ARPA funds to the BHA
project that was approved Ed and obligated in 2034.Build that lifesaving and life

JANUARY 14, 2026
Prepared for Bremerton City
Council Study Session
A14
Background
How did our four organizations get involved?
City was faced with growing encampments in
the downtown area
State law required an overnight shelter option be
available before encampments could be swept
An informal group came together to find shelter
options which included our four organizations,
the Mayor, and County staff and other
service/shelter providers
Hybrid model was preferred over a city-owned
congregate shelter by the City Council
BHA, KMHS, KCR, St. Vincent de Paul were asked
to develop the hybrid shelter option

Coding & Design Challenges
Emergency Congregate Shelter:
Per RCW 35.21.683 A city shall not prohibit transitional
housing or permanent supportive housing (including
indoor emergency shelters) in any zones in which
residential dwelling units or hotels are allowed.
Per BMC 20.70.020 allowed outright uses for this parcel
include Residential, Hotels, Class 1 group residential
facilities as designated within the Harrison Heights
Subarea Plan (HHSAP)
Confirmation that this parcel would allow an emergency
shelter was confirmed by City planning personnel
5/20/25 via email, as well as during the Pre-Application
Submittal conference
We propose working closely with the City
planning department to ensure the City’s needs
are met and the project can be built
HHSAP has density requirements that we do
not meet with the current design of the
shelter, even if the lot was split
The design features of the hybrid shelter may
require a deviation from the HHSAP
Coding & Design Challenges
Temporary Encampment - Tiny Home Village:
The parcel itself could host a temporary
encampment right now for 183 days based on BMC
ordinance 5393:
Temporary encampment can be permitted in all
zoning districts (no development codes would
apply)
Site must be 1 acre
Must provide 150sf per resident
20’ perimeter setback; 40’ if adjacent to
residential use)
Cannot be located in critical areas or their
buffers
For the encampment to qualify for the extended
stay exception (3-years+), we would need one of
the following:
A change to the zoning code ordinance
language like we previously did to include this
parcel in the allowable locations for extended
stay encampments OR
City Council to amend the comprehensive
plan and remove this parcel from the Harrison
Heights Subarea Plan zoning and return it to
the DCC zoning it previously had.
Our Ask
What do we need from the City?
Bremerton City Council and/or the Mayor/City of
Bremerton formally endorse the hybrid
shelter/transitional housing proposal.
City of Bremerton/City Council allocate ongoing funding
in its annual budget to support operations
Request the City of Bremerton planning department.
participate in community discussions regarding the
siting of the shelter and streamline the permitting/zoning
process as much as possible to assure rapid
implementation.
Engage in collaborative planning discussions with the
partner agencies, Kitsap County and Legislators to
support the overall implementation and fund
development requirements for the proposed Hybrid
shelter project on Sheridan Road.
Our Ask
What could support look like?
Acknowledgement that the City still wants the hybrid
model
Commitment to pursue necessary zoning and
development code changes if needed
Help with community outreach – attend to the meetings,
listen, help to address concerns
Partnership with the police department
Financial commitment to help fund on-going operations
explored on an annual basis
Our initial projections have a gap but we don’t expect
the City to cover it all. (Most of the operations dollars
will come from county funding through the shelter bed
rate, CIAH funding, and Mental Health funding dollars.
We are also pursuing dollars through department of
health, Foundational Community supports, private
donations.)
The Vision
Work together as a community with our City and our County to provide a shelter model
in Bremerton that provides a pathway to permanent housing developed around
individual needs, human dignity, safety and security, and a holistic approach to healing,
health and overcoming barriers to successfully live in permanent quality housing
without causing further trauma through the process.
The
Partners
Why did our four organizations get involved?
Hybrid shelter option aligns with the missions
of BHA, KCR, KMHS, and St. Vincent de Paul
Hybrid model provides a clear entry point into
shelter and a pathway out of homelessness
through a joint response

CITY OF BREMERTON - CITIZEN PROPOSAL
Concept Originated By: John C. Belcher, Bremerton Resident
Email Submission Only - No Presentation Requested
Date: May 13, 2026
To: Mayor and City Council, City of Bremerton
345 6th St, Bremerton, WA 98337
From: John C. Belcher, Bremerton Resident
Subject: Citizen Request - $50M Community Resilience & Resource Preservation Trust
Dear Mayor and City Council:
I am a Bremerton resident submitting for the public record a citizen proposal for a
$50M Community Resilience and Resource Preservation Trust.
As documented in State Auditor Report No. 1035041 (July 29, 2024), the City has $0
questioned costs and complies in all material respects with federal requirements. A
permanent trust would ensure resources remain open and available to the public.
STRUCTURE:
$50M federal capitalization held as permanent principal, never spent. At 5% earnings,
this provides $2.5M annually forever to preserve parks, community centers, utility
assistance, and emergency repairs. Principal compounding at 5% grows to $81.4M in
10 years, $132.6M in 20 years, $216.1M in 30 years.
FACT SHEET:
Year | 4% | 5% | 6% | 7%
5 Year | $60.8M | $63.8M | $66.9M | $70.1M
10 Year | $74.0M | $81.4M | $89.5M | $98.3M
15 Year | $90.0M | $103.9M | $119.8M | $137.9M
20 Year | $109.5M | $132.6M | $160.3M | $193.4M
FW: Citizen Proposal for Public Record - $50M Resilience Trust - John C. Belcher
25 Year | $133.2M | $169.3M | $214.5M | $271.3M
30 Year | $162.1M | $216.1M | $287.1M | $380.6M
IMPACT: Preserves 4 community centers, 15 parks, utility assistance for 12,000 LMI
residents, 30 FTE jobs.
COMPLIANCE: $0 questioned costs, 2 CFR 200 Uniform Guidance, quarterly reporting,
annual audit per RCW 43.09.
I respectfully request this proposal be included in the Council packet and forwarded
to Finance / Grants for federal funding consideration via EDA / HUD / Community
Project Funding.
No presentation requested - email submission only.
Thank you for your service to Bremerton.
Sincerely,
John C. Belcher
Bremerton Resident
