The survey extends from the proposed enclosure location to the nearest property lines. The purpose of this report is to document the extent and impact of the acoustical changes due to the proposed cabinet fans. This report contains data on the existing and predicted noise environments, impact criteria, and an evaluation of the predicted sound levels as they relate to the criteria, and recommendations for improvement if appropriate. Noise Code The property is located in the City of Bremerton zoning jurisdiction, which is within Kitsap County. The proposed site is zoned commercial, and all receiving properties are also zoned commercial. According to Bremerton Municipal Code Section 6.32.010, commercial zones are designated District II. City of Bremerton Municipal Code Section 6.328.040 Environmental Sound - Maximum Permissible Levels limits noise from District II property as follows: District II Receiver: Noise is limited to 60 dBA 24 hours a day. Ambient Conditions Existing sound levels were measured at the site to determine the current ambient sound levels. Sound level measurements were taken on April 7, 2006 using aLarson-Davis Model 820 sound meter'. The average ambient noise level measured was 63 dBA dominated by noise from local vehicle traffic. The weather during the measurement period was clear with dry roads and no precipitation. Site plan, elevation and antenna -mounting drawings furnished by Clearwire representatives show that the proposed Clearwire facility will be configured as follows: up to four flush -mounted antennas, all to be side mounted on an existing 110-foot tall self-supporting steel monopole tower located at 4119 Wheaton Way, Bremerton, in Kitsap County, Washington. The new Clearwire antennas will be mounted and centered at approximately the 100-foot level. A chain link fence restricts access to the monopole. Therefore it is unlikely that anyone other than authorized workers could approach near enough to any of the monopole -mounted transmit antennas to cause that person's RF exposure to exceed FCC limits. It is expected that RF exposure conditions near ground level at the Parker Lumber site, and at all adjacent properties, due to the contributions from all transmitting antennas will be well below the FCC public exposure limit. To verify that the proposed Clearwire facility will be in compliance with FCC rules regarding public exposure to RF fields, I have performed EMF power density calculations to determine the exposure conditions that are likely to exist at ground level near the proposed facility. CALCULATIONS OF RF POWER DENSITY NEAR GROUND LEVEL RF power densities are computed in accordance with methods described in Evaluating Compliance with FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields, OET Bulletin 65, August 1997. Wireless facilities are required to Hatfield &Dawson Consulting Engineers 2 comply with the FCC "Rules & Regulations" CFR 47 91.1310, Radiofrequency radiation exposure limits. The OET Bulletin 65 describes the methods established by the FCC for predicting compliance with the FCC -specified exposure limits. Compliance is determined by comparing RF field predictions with the general population/uncontrolled environment (i.e., "Public") Maximum Permissible Exposure limits (MPEs) allowed by the FCC rules, as specified in CFR 47 §1.1310. The following formula has been used to calculate the power densities at specific locations: 0.36 x ERP (watts) / (Distance in feet)2 This formula is derived from Equation 9 on page 21 of OET Bulletin 65. It includes the effect of ground reflections. The Effective Radiated Power (ERP) depends on the vertical antenna pattern. THEORETICAL ANALYSIS According to the site plan drawings furnished by Clearwire, all of the proposed transmit antennas will be mounted and centered at approximately the 100-foot level. All of the proposed transmit antennas are highly directional and project the majority of the transmitted RF energy horizontally and well above all nearby ground -level locations. The following theoretical calculations predict the peak exposure condition for asix-foot person standing at the nearest approach to the transmit antennas. A six-foot tall person standing on the ground near the base of the monopole would be at least approximately 90 feet below all of the proposed transmit antennas. The calculations assume that the vertical patterns of all Clearwire transmitting antennas suppress the maximum ERP by a factor of 50 (i.e., IdB) downwards towards ground level. Hatfield &Dawson Consulting Engineers 3 CONTRIBUTION OF CLEARWIRE FACILITY TO RF EXPOSURE ENVIRONMENT Based on information provided by Clearwire RF Engineers, the maximum ERP from any sector of the proposed Clearwire facility will be less than or equal to 100 watts with all channels activated. Thus the worst -case downward ERP is 2 watts (i.e., 1/50th of 100 watts) from the proposed Clearwire facility. By use of the power density formula shown on page 2, with input values of 2 watts downwards ERP, and a distance of 90 feet, the worst -case calculated power density at head height from the Clearwire facility to a six-foot person standing at ground level is 0.0000889 mW/cm2. All of the Clearwire antennas will transmit and/or receive within the 2596-2690 MHz frequency band. The Public MPE limit for all frequencies transmitted by this facility is 1.0 mW/cm2. The worst -case calculated exposure condition resulting from the Clearwire facility is the power density divided by the Public MPE limit: 100% x 0.0000889 / 1.0 = 0,0089% of the Public MPE limit. PUBLIC EXPOSURE CONDITIONS NEAR GROUND LEVEL All areas near ground level in the vicinity of the Parker Lumber monopole, and on adjacent properties, are expected to have exposure conditions less than 0.0089% of the Public MPE due to the proposed Clearwire wireless broadband telecommunications facility. This worst -case calculated exposure level is well below the 100% FCC limit. The actual exposure conditions are likely to be many times less than this worst -case value. Hatiieid &Dawson Consulting Engineers C! FCC AND LOCAL COMPLIANCE The FCC has determined that at sites where multiple wireless facilities are co -located, the responsibility for site -wide RF safety compliance is the shared responsibility of all licensees whose facilities produce exposure conditions greater than 5% of the applicable MPE exposure limit. Thus a new applicant is responsible for compliance (or submitting an environmental assessment) at a multiple -facility site only if the proposed facility, when considered alone, would produce exposure conditions in excess of 5% of the MPEs. Wireless facilities that produce less than 5% of the applicable MPE exposure limit at accessible locations are considered to be exempt from further study. As demonstrated in this report by worst -case exposure calculations, the proposed Clearwire wireless facility will produce far less than 5% of the applicable exposure limit for public environments. Therefore, pursuant to the Commission's rules no further calculations, measurements or other RF studies are required, and the proposed Clearwire facility is presumed to be in compliance with the FCC's RF exposure rules. Because the proposed Clearwire wireless facility is in compliance with federal rules, it is also in compliance with local regulations concerning RF exposure. The following is the complete text of 47 U.S.C. § 332(c) (7) (B) (iv): "No State or local government or instrumentality thereof may regulate the placement, construction, or modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions." Hatfield &Dawson Consulting Engineers CONCLUSIONS BASED ON CALCULATIONS AND FEDERAL REGULATIONS Based on my calculations and information supplied to me by Clearwire representatives, the proposed Clearwire wireless broadband telecommunications facility WA-KIT40&13 will comply with current FCC and local rules regarding public exposure to radiofrequency electromagnetic fields. This conclusion is based solely on the comparison of predicted RF conditions in specific areas with the corresponding safe exposure limits set forth in the FCC rules. The FCC exposure limits are based on recommendations by federal and private entities with the appropriate expertise in human safety issues. Thank you, Kevin Foy Clearwire Zoning 206-607-7220 9/27/2006 Aearw ° re 5808 Lake Washington Blvd, NE Ste. 300 Kirkland, WA 98033 To the City of Bremerton: PHONE: FAX: ONLINE: 425 216 7600 1425 216 7900 www.clearwire.com Clearwire US LLC is formally asking the city to provide an extension to the existing permit located at the following address: 4119 Wheaton Way Bremerton Permit identification # BB06-00215 Clearwire identification #KIT 406 Clearwire is asking for the extension for several reasons. Original predictions in forecasting an "on air" date were delayed due to circumstances outside of Clearwire US ,LC reach. This build out is establishing a network that will leave its footprint over most of Western Washington. Working with a multitude of contactors through the state and after proper training has left limited experienced vendors readily to build in our major markets (Snohomish County, King County, Pierce County, Kitsap County and all surrounding areas of each county). Clearwire is writing this justification letter for an extension as it plans to start development of its network by a projected date of October 1 st, 2006. Clearwire hopes the jurisdiction will allow an extension due to the delayed market launch and shortage of available contractors with proper training on installation of working radio equipment acceptable; providing the extension. Permits are projected to be pick-up from the City of Bremerton in the month of October, 2006. Please contact Kevin Foy with any questions regarding the extension of this permit.
