INTERLOCAL AGREEMENT BETWEEN
THE CITY OF BREMERTON
KITSAP COUNTY PUBLIC WORKS
CONCERNING STORMWATER EDUCATION
WHEREAS, the City of Bremcrton (City) owns and manages a stormwater system; and
WHEREAS, Kitsap County Department of Public Works (County) is responsible for stormwater
managemem in unincorporated Kitsap County; and
WHEREAS, a requirement for managing a stormwater system is providing public education on
proper stormwater control and best management practices; and
WHEREAS, the County and the City coordinated a Department of Ecology Cemennial Clean Water
grant application, Kitsap County Contract ControlNumber KC-542-99, titled "Stormwater
Consortium Education Project" in which the County is the lead and the total amount of the gram
award is $29,000;
WHEREAS, the City agreed to provide matching funds in the form of purchasing $4,000 worth of
educational materials in exchange for a comprehensive stormwater education campaign aimed at
citizens and homeowners; and
WHEREAS, it is a requirement of the grant to have an interlocal between the City and the County;
THEREFORE the City and the Counly agree to the following:
1. No separate adminWwafive entity is created by the terms of this agreement.
2. As provided by Chapter 39.34 RCW, the City agrees to provide the matching funds to meet the
requirements of the Centennial grant by purchasing $4,000 of stormwater education materials
such as newspaper ads, billboards, and brochm~s as detailed in the Cente,nial Grant contract.
These funds have been budgeted in the 2000 Bremert0n Stormwater Utility Fund.
3. The City will provide documentation of the expenditure of these matching funds as required by
~ Cemennial Gram contract.
4. With respect to this Interlocal Alpeement, the City agrees to comply with all conditions of thc
Centennial Grant contract.

5. Kitsap County Department of Public Works agrees to provide a comprehensive stormwater
public education campaign, design of education materials, and evaluation of the campaign in
addition to grant administmtior~
6. This agreement will take effect immediately upon execution of both parties. All work to be
performed under this agreement will be completed by March 31, 2002.
7. This agreement may be amended or rescinded by mutual agreement of thc City and the County.
8. Nothing in this agreement shall be construed to abrogate or limit the sovereign immunity of
either party; grant or relinquish any interest in lands, water, or other real or personal property,
alter the jurisdiction and authority of any court or agency not a pm-ty to this agreement, or of
either of the parties except as explicitly set forth in the agreement; impose or alter the liability of
any person for personal or property damage arising from, or contracts related to, any project
.approved to reviewed pursuant to or otherwise subject to this agreement or responsibility
rmposed by law.
9. Any and all notices under the terms of this agreement shall be given to the patties at the
