The 58RAV offers the same high quality you demand and receive from Carrier. The cabinet is constructed from a specially selected galvanized embossed steel with a clear coating. This material provides the same protection from humidity and rust as our other. cabinets. The 58RAV offers a hot surface ignition system which provides a superior and more reliable ignition than older spark relight systems. The heat exchangers are constructed of aluminized steel and covered by a 10 -year Limited Warranty. They are Carrier's patented Super -S heat exchangers that improve heat transfer and enables downsizing of this furnace to only 40 in. tall. To improve the sound level, we have incorporated a soft mount inducer assembly and a slow opening gas valve. The control board is the brain of this induced -combustion gas furnace. It offers a unique self -test feature that checks all the major functions of the furnace within 1 minute. The control board also features a 3 -amp fuse that protects the transformer and control board. Another feature on the control 'board is a LED status indicator light to ensure top furnace performance. C. Location: 3231 Pine Road City of Bremerton D. Attachments: I. Applications: SPR & SUP II. Site Plan III. Memo- Olsen & Associates from The Arbors, dated 11/21/96 Letter - D. Moduchi to City of Bremerton, dated 3/31/97 IV. Improvements Agreement - 7-1-96 II. FINDINGS A. Project Description: The Community Development Department has been requested to 'approve a Special Use Permit and site plan which will allow the construction of a Group Residential Facility -- Class 1 (Large) within the MR zone. (A similar facility was approved by. Planning Commission on the site west of and adjacent to this site in 1996.) The project consists of an Alzheimer's care facility located in'2 buildings with a total of 34 rooms (34 bedrooms with shared bathrooms and common areas) . A future phase may include two multifamily residential buildings with 4 units each. The two Alzheimer's care facilities under the SUP and SPR applications each have common kitchen, dining, activities room facilities and administrative offices. The buildings are one story in height., Significant landscape planting areas would surround the buildings along property perimeters. Most of the parking areas are located mostly within an interior site area surrounded by buildings. Approximately 58% of the site is left in open space, in the built -out' condition of Phase One and subsequent phases shown on the site plan submittal. (Phase One open space is not separately calculated on the application) B. Comprehensive Plan: The Comprehensive Plan Map Designation for the site is High Density Residential with 18 or more dwelling units per acre. The Comprehensive Plan seeks to ensure an. adequate housing supply to meet the changing needs of Bremerton residents. In addition, the facility meets an overall Kitsap County regional need for specialized Alzhiemer's care, located centrally to nearby hospital, pharmacy and other specialized medical care facilities. C. Zoning Ordinance: The Zoning Map Designation for the site is Mixed Residential (MR). The use "Group Residential Facility Class I - Large" is allowed within the MR zoning district by Special Use permit as provided in Chapter 21 of the Bremerton Municipal Code. The code defines a group residential facility as follows: GROUP RESIDENTIAL FACILITY. CLASS 1. A group care residence for children and adults who for various reasons cannot reside in their natural homes, andlor for persons who have severe chronic disabilities or physical handicaps that cause substantial functional limitations. This facility may provide physical therapy and training in social skills. 1. Class 1 - Small: A total of six or fewer persons, including staff, whose permanent residence is the group residential facility. 2. Class 1 - Larne: A total of seven or more persons, including on -duty staff`. Class I facilities do not include facilities to which persons are assigned as a result of criminal conviction or those where residents, individually or by their legal guardians, are not free to terminate their residence at will. D. Surrounding Land Use and Zoning: Except for two single family side yards along north property limit, the entire land use context -of the site is either retirement group residential or multi -family residential use and zoning.. The zoning and land use is as follows: ZONING North: MR, SF -3 South: MR East MR West MR E. SEPA: 2 LAND USE multi -family, single family multi -family apartment retirement residential i i A Threshold Determination of Non -significance pursuant to WAC 197-11-34 was issued by the City's Responsible Official on Feb. 20, 1997. An environmental impact statement was not required. F. Total Lot Area: 2.4 acre (104,544 Sq. Ft.) G. Topography: Relatively level with 5-10% slopes, generally from west to east. H. Utilities: Water, power, telephone, storm drainage and sanitary waste water utilities are available to the site from Pine Road frontage. I. Lot Development Requirements: Lot development requirements of the MR zone compared to applicant provided information shown on the site plan, for Phase One only (except lot coverage) is as follows : J. Parking: There are two issues - number of required parking spaces and operations of the facility which affect parking requirements. The parking requirement for an "assisted living" use or "Alzheimer's care facility" use is not identified among the 44 listed uses in the BMC 21 Appendix Fig. 670 (b). The proposed use can be most closely related to a boarding and rooming house use at 1 space per 2 beds or a convalescent home which would require 1 space per 600 square feet , which would result in more parking than needed. The boarding, and rooming house use has a parking reduction provision under the BMC 21.02.670 (a) (2) (i) which states "The Director may authorize a reduction in the number of required parking spades if there is a clear indication that the requirements of this Chapter are excessive, due to such factors as the residents' ability to drive, age, or mental or physical abilities or disabilities. " 11 3 Required Proposed Front Yard Setback: 10 ft. 65 ft. Rear Yard Setback: 10 ft. 20 ft. Side Yard Setback: 5 ft. 20 ft. Height: 120 ft. 24 ft. Lot Coverage: 45% Allowed 12% Landscape Plan: YES YES J. " 11 3 Applicant background matedais indicate that'due to the age and mental condition of the residents along with typical maximum number of employees at the facility at any one time, the facility demands no more than one space per two units, including visitors and barrier free spaces. (See attached memo to Olsen & Associates from Stuart L. Gaines, The Arbors, dated November 21, 1996.) A listing of similar facilities permitted by other cities has been provided by the applicant. (See attached letter from D. Moduchi to City, regarding acceptable parking requirements for comparable projects from other WA. cities) Given the facility type and the anticipated age of residents, 17 parking spaces (including one van accessible space per WAC 51-30-1107.1.5. and one barrier free accessible space) will be required for this development. To accomplish the parking reduction from a higher parking requirement, a parking reduction agreement would be filed following approval of the agreement form by the City Attorney. The agreement would permit reduced parking until the permitted use no longer exists. The permit should be conditioned as a recorded agreement filed with the County Auditor requiring additional parking if circumstances change. Staff recommends requiring the parking ;,...,..ag.eement filing prior to issue of any building permit by city, to prevent unnecessary delay in drafting language and to fully resolve zoning issues related to parking prior to construction. K. Agcess onto neighborhood streets: One vehicular access point is shown on the site plan, located along the west side of Pine Road. This access will be designed to City right-of-way approach standards and must be approved by the City Engineer, as a part of subsequent submittals by applicant. L. Street Frontage Improvements: Pine Road frontage does not have curbs, gutters or sidewalks. A Short Plat application to divide the site into two parcels (one parcel fronting Pine Road and one parcel fronting Ricky Road) was approved in 1996 to create the 2.4 acre site under this application. As a condition of the plat approval, the property owners were required to agree to participate in a Local Improvement District (LID) for future sidewalk improvements to both Rickey Road and Pine Road. The recorded agreement requires the improvements to be built within six months of notification by the City of Bremerton. Staff recommends that the notice date for improvements be the same date as the building permit approval for any portion of the site plan under this application, to allow for frontage and site construction to be coordinated by applicant. As a condition of this application approval, staff recommends that applicant construct 211 linear feet of frontage improvements along Pine Road for frontage area to include the drive access. It is further recommended that the applicant bond (engineer's cost estimate times 150%) or construct remaining 135 linear feet of frontage improvements for future phase at the time of building permits for buildings shown on site plan, to fully satisfy the short plat Improvement Agreement recorded in 1996. The sidewalk, curb and gutter improvements for 211 linear feet and must match to existing sidewalk, curb `,- El and gutter located at the southwest comer of the site along the west side of Pine Road right of way. M. Stream Development: A Type III stream is located across the northern portion of the site. The Bremerton Critical Lands Ordinance defines Type III streams as: Those streams that are intermittent or ephemeral during years of normal rainfall and are not used by salmonids and do not have significant salmonid habitat or flow directly into streams used by salmonids or which have significant salmonid habitat. Type III streams maybe relocated or placed in culverts, provided it can be demonstrated that: a. No significant habitat area will be destroyed; A Vftland and Stream Evaluation has been prepared to evaluate the culverting of this stream. The report indicates that placement of the stream in a culvert will not adversely affect water quality, stormwater runoff or be detrimental to the other properties or the City as a whole. b. The new channel or culvert is designed and installed to allow passage of fish inhabiting or using the stream; The report indicates no fish activity in the reach of the stream crossing the site. C. The channel or culvert is large enough to accommodate a 100 -year storm, Culvert sizing for 100 year event is provided. d. The applicant will, at all times, keep the channel or culvert free of debris and sediment to allow free passage of water and/or fish; and The stream piping system will be privately maintained. In the event that the system is not maintained, the system is to be dedicated to the city and the property owners will not be eligible for a stormwater fee credit (reduction) for maintaining the drainage system. e. The applicant will provide a bond or other financial security to ensure maintenance as provided in Section 1.280 hereof. Bonding for maintenance is required prior to issue of building permit on any aspect of the site plan. The bond will equal 10% of the cost of the system installation, verifed by City Engineer. f. The relocated stream channel will result in improved stream function and value. Although a piped stream channel could reduce time of concentration and increase runoff velocity, pipe sizing has been designed to minimize the negative impacts of culverting an open channel.stream. The City Engineer has approved of the stream modification as a stream function and value improvement. A benefit includes uniform downstream flow during low flow periods, due to a water control release structure designed for release at predevelopment discharge rates. Reduction of scouring and erosion associated with an unimproved open channel stream during high intensity events is a benefit. `h- 5 A Type III stream requires a 25 foot setback, which is shown on the site plan for the remaining open channel portion (east half) of the stream. N. Lighting: The lighting system has been submitted, and such system is adequate to provide safety and security without producing glare onto surrounding properties. Exterior parking lot lights consists of concealed sources and illuminate only the parking areas on the site. All lighting will comply with the BMC 21.02.610 (h) which requires light source to be selected and placed so that glare produced by any light source does not extend to adjacent properties. 0. Storm Water. A preliminary stormwatee pian'has been provided. Stormwater will be collected via an on-site collection system and detained on site. The water will then pass through bio- filtration swales to achieve water quality. Discharge at the pre -development rate will be provided via the City's stormwater system which drains the Pine Road corridor. The drainage report addresses 2 buildings, 34 rooms (The site plan shows no future phase buildings at this time). The 2.40 acre site adjacent the project site under this application was permitted to place the upstream reach of the Type III stream west of the west property limit in a pipe, to daylight onto the applicant's site at the present location of the existing Type III stream. Staff recommends that a tightline connection be provided to the system on the adjacent property at the property limit, to avoid potential for future drainage water quality issues, erosion, etc. This requirement would be a minor modification to the stormwater report provided by the applicant. P. Open Space & Landscape: There are three (3) applicable areas of requirements - open space, interior parking and parking screening. Open space requirements are 15% of site area, which is 15,681 SF and 20,446 SF is provided. The site has six designated open space areas which equals 19% of the site area. Interior parking is 10 SF per space, which is 170 SF and 1,129 SF is provided. parking screening is required at edges of parking area, which includes 137, LF and 105 LF required and provided of a 5' wide planting strip; meeting landscape screening height requirements in the code. Q. Development meetings: There were no required meetings or community meetings held by applicant or city 111. CRITERIA FOR APPROVAL The Director shall approve a Site Plan and an Administrative Special Use Permit under the Type II Decisions Procedure as outlined in Fig. 840 of Chapter 21, Bremerton Municipal Code. Criteria For Special Ust Permits: The Community Development Director may approve special use permits only if the following statements are true: 1 A- 0 • 0 Is the proposal substantively consistent with the Comprehensive Plan? Yes. The zoning is consistent with the comprehensive plan and the use is allowed as a special use within the zoning category. 2. Will the proposal bear a substantial relationship to the public welfare and not result in adverse environmental consequences? Yes. The community has an ongoing need for special population care and residential facilities, which are not environmental hazards. 3. Will the proposal comply with the minimum requirements of the Zoning Ordinance other than type of use? Yes. The proposal meets parking, landscape, lighting, drainage, utilities and transportation related code requirements. 4. Are essential public facilities and services presently available and adequate, or can they reasonably be made availabre? Yes. The utilities and transit services serve this site along Pine Road. The staff finds that none of the following seven criteria of a Type III Decisia which would be made by Planning Commission applies to the project submittal : The bulk, height, location, or placement of structures or the intensity of uses of the proposal would: a. Be detrimental to other development in the neighborhood; or b. Result in loss or damage to unique natural or topographic features of the site that are important to the quality of life in the City. 2. The provisions for vehicular and pedestrian circulation and parking on the -site and on adjacent streets would: a. Create hazards to public safety; or b. Result in serious loss of natural or topographic features. 3. The landscaping provisions do.rl:ot aWy,ect neighboring properties from the development. _ 4. The Site Plan fails to provide forsoil.and drainage problems that will be caused by the development. 5. The provisions of exterior lighting are inadequate or will adversely impact adjacent properties. 6. The applicant has not set forth a reasonable plan for the private care and maintenance of open spaces provided on the site. 7. The proposed development will impose an undue burden upon public services such as sewer, water, and streets. 7 Based on staff review of the above seven criteria, the special use permit submittal falls within the Type II Administrative review category. Criteria For Site Plan Review: Bremerton Municipal Code Chapter 21.02.930 includes the procedure and requirements for Site Plan Review, a Type I Decision made by the Community Development Director. The Director shall review the site plan submitted for building permit approval and shall verify that it is in substantial compliance with the site plan approved by the Director. The following informalities in site plan application requirements are noted : 21.02.930 (d) (6) - Maps not larger than 18"x24". A 24"x 36" size is included and acceptable. Code Compliance Recap: 21.02.930 (d) (4) - Landscape plan is provided. 21.02.960 (h) - Lighting plan is provided. 21.02.930 (d) (1) - Vicinity map with property names will be provided by applicant, if a notice of appeal is required. There are no other required notices to adjacent properties. IV. CONCLUSIONS The "Group Residential Facility Class I - Large" use.is allowed within the Multi -Family Residential zoning district subject to a special use permit. 2. The proposal is consistent with the comprehensive plan High -Density Residential uses. 3. The use bears a substantial relationship to the public welfare. 4. Adequate areas for parking and landscaping are provided. 5. Essential public services are available and adequate to serve the proposed use. 6. No significant adverse environmental consequences will result by this development. 7. The applications meet the. minimum criteria for granting. approvals for Special Use Permit and Site Plan Review. V. DECISION & DEVELOPMENT CONDITIONS The Bremerton Community Development Director considering the findings and conclusions, approves the Special Use Permit and Site Plan for The Arbors of Bremerton application which meets the criteria for approval of a Special Use Permit and Site Plan Review as stated in the Bremerton Municipal Code.
