Re: Ashley Gardens Assignment of Funds
I have reviewed the Assignment of Funds in Lieu of Bond for Ashley Gardens
executed by Washington First International Bank. The form for the Assignment is proper
as far as it goes, and of itself presents no problems.
You brought up the other issues that have to be determined. The bid price for the
landscaping must be reviewed before the City agrees to the Assignment. The two-year
guarantee required in BMC 21.02.760 also needs to be addressed, perhaps in a separate
document. The BMC contemplates one document to cover both installation and the
replacement guarantee, but there is no reason not to accept two separate documents if
they provide the security required. I would insist on an assurance device for the 2 -year
guarantee period before accepting the Assignment.
