CUTTING LINE AGREEMENT
THIS CUTTING LINE AGREEMENT (this "Agreement") is made and entered into on this
/Tr/t day of February, 1999 by and between Port Blakely Tree Farms (Limited Partnership),
1325 Fourth Ave., 10th Floor, Seattle, WA 98101-2524 and the City of Bremerton,
Department of Public Works and Utilities, 3027 Olympus Drive, Bremerton WA. 983 I0.
The blazed and flagged lines located along the common property boundaries of the following
parcel:
the West line of the E¥~EV2 of Section 24, Township 24N, Range 01W, W.M., Kitsap
County, Washington
a~e hereby accepted as valid cutting line boundaries for the purpose of harvesting timber
proposed by Port Blakely Tree Farms;
1. The said line has been established and marked on the ground solely for the
purpose of establishing a line, up to which each party hereby may cut timber,
and it is not intended to mark or establish by adverse possession, agreement,
acquiescence, estoppel, or otherwise the true boundary between the adjoining
parcels of land owned by the parties hereto.
2. The lines have further been marked on the ground with tree blazes and plastic
flagging.
3. The parties hereby, their heirs, successors, and assigns, grant each to the other
the right and permission to cut timber up to said line.
4. This Agreement may be rescinded by mutual agreement of the parties hereto or
by either giving to the other thirty (30) days notice in writing (which notice
shall be served either personally by the rescinding party on the other or by
mailing to him at his last known post office address by certified mail, return
receipt requested) after the rescinding party has taken appropriate and suitable
action to determine and establish the tree boundary between the adjoining
parcels of land.
5. In the event the true boundary is determined and established between the
adjoining parcels of land owned by the parties hereto, and it is revealed thereby
that either party has cut timber which, in fact, belonged to the other, such party
shall pay to the other the fair price of the timber so cut prevailing at the time it
was cut, as determined by appropriate Washington State Department of
Revenue Stumpage Values.
The attached exhibits show the locations of the above mentioned lines, and associated survey
data used to established such lines.
This Agreement is hereby executed as of the day and year first hereinabove written.
