SIGNAL CREDIT MANAGEMENT SERVICES (SCMS)
AGREEMENT FOR TIME PAYMENT COLLECTION PROGRAM
THIS AGREEMENT, is made and entered into between BREMERTON MUNICIPAL COURT,
hereinafter called "Court" and SIGNAL CREDIT MANAGEMENT SERVICES, hereinafter called
"SCMS".
WITNESSETH:
That in consideration of the payments, covenants and agreements hereinafter mentioned and attached and
a part of this contract to be made and performed by the parties hereto, the parties hereto covenant and
agree as follows:
I. SCOPE OF SERVICES: SCMS shall provide services and furnish all equipment, labor, and
materials necessary to perform time payment collection, including monthly billing and payment
monitoring, on all time payment accounts referred to SCMS by the Court. The services provided, and the
obligations of the parties will be subject to such future revisions as the parties may mutually approve.
H. FEE SCHEDULE: The following fees and interest will be assessed against the debtor as
permitted by law, and paid to SCMS as remuneration for its time payment collection services:
TIME PAYMENT ACCOUNT SET-UP FEE: $25.00
MONTHLY ACCOUNT SERVICE FEE
one case: $ 4.75
multiple cases: $ 8.25
DELINQUENT MONTHLY ACCOUNT SERVICE FEE
one case: $ 7.75
multiple cases: $11.25
INTEREST (per month on unpaid balance): 1%
HI. TIME OF COMMENCEMENT OF CONTRACT: Thc work to be performed under this
contract shall commence January 4, 1999, and continue in force until terminated as provided herein.
IV. TERMINATION: This Contract may be terminated by either party upon thirty (30) days'
advance written notice to the other party.
V. REMITTANCE: Payments to the Court shall be for the total amount of the payment made by
the defendant, less fees as defined in Section II.
VI. INDEMNIFICATION: SCMS agrees and covenants to indemnify, defend and save harmless
Client and its officers, agents, and employees against and from any loss, damage, costs, charges, expense,
liability, claims, demands, or judgments, of whatsoever kind of nature, whether to persons or property
arising wholly or partially out of an act, action, neglect, omission, or in default on the part of SCMS, their
subcontractors and/or employees, except only such injury of damage as shall have been caused by or
resulted from the negligence of Client.
VII. INSURANCE: SCMS shall obtain and keep in force continually during the term of the contract
comprehensive general liability insurance coverage in the amount of at least One Million Dollars
($1,000,000.00).
IX. NON-DISCRIMINATION: SCMS, in its efforts, will not discriminate against any defendant on
the basis of race, color, creed, religion, sex or national origin. SCMS will comply with the requirements
of the Americans with Disabilities Act of 1992, and all regulations interpreting or enforcing said Act.
This Agreement constitutes the entire understanding between SCMS and the undersigned Client regarding
terms and conditions as they pertain to all time payment collection services provided to Client by SCMS
and may not be changed or modified except by written agreement signed by both parties.
IN WITNESS Wl:tE~REOF, the parties hereto have executed this contract on the /,Y_aS~
