INTERLOCAL AGREEMENT BETWEEN
THE CITY OF BREMERTON
AND
MASON COUNTY DEPARTMENT OF EMERGENCYU MANAGEMENT
CONCERNING EMERGENCY NOTIFICATION
WHEREAS, the City of Bremerton (City) owns and operates Casad Dam for water supply
purposes; and
WHEREAS, as part of the operation of the dam the City has an Emergency Action Plan that
identifies a potential inundation area and provides for downstream notification for residents in the
unlikely event of dam failure; and
WHEREAS, Mason County Department of Emergency Management (County) is responsible for
emergency notification in Mason County; and
WHEREAS, the County has an automatic telephone notification system for residents that can be
upgraded to include downstream residents of Casad Dam in both Kitsap and Mason Counties in the
event of an emergency;
THEREFORE the City and the County agree to the following:
1.No separate administrative entity is created by the terms of this agreement.
2.As provided by Chapter 39.34 RCW, the City agrees to provide the funds to Mason County to
upgrade their automatic telephone system to add residents in the potential inundation area for Casad
Dam at a cost to be determined later but estimated to be approximately $4,000. These funds have
been budgeted for the 1998 Bremerton Water Utility Fund. The upgrade shall be the property of
Mason County.
3.Mason County Department of Emergency Management agrees to add these residents to their
system and to initiate the telephone call out when notified by the City that an emergency event is
imminent or in progress.
4.This agreement will take effect immediately upon execution of both parties and shall continue
until amended or rescinded by mutual agreement of the City and the County.
5.Nothing in this agreement shall be construed to abrogate or limit the sovereign immunity of either
party; grant or relinquish any interest in lands, water, or other real or personal property, alter the
jurisdiction and authority of any court or agency not a party to this agreement, or of either of the
parties except as explicitly set forth in the agreement; impose or alter the liability of any person for
personal or property damage arising fi.om, or contracts related to, any project approved to reviewed
pursuant to or otherwise subject to this agreement or responsibility imposed by law.
6.Any and all notices under the terms of this agreemem shall be given to the parties at the following
