HomeMy WebLinkAboutORDINANCE 55325532ORDINANCENO. ________ ANORDINANCEof the CityCouncil ofthe Cityof Bremerton, Washington, amendingBMCSection 15.03.040entitled WHEREAS, theCityCouncil desiresto amend Chapter15.03.040ofthe Bremerton Municipal Codein ordertoupdate thecoderelatingtoCitywastewater serviceto propertiesexisting outsideofCitylimits; NOWTHEREFORE, THECITY COUNCIL OFTHECITY OFBREMERTON, WASHINGTON, DOESHEREBYORDAINASFOLLOWS: SECTION 1.Section 15.03.040of theBremerton Municipal Codeentitled amended toreadas follows: a) GeneralPolicy. Itisthegeneralpolicy oftheCityof Bremerton thatproperties locatedoutsidetheCitylimits annexintotheCitybefore wastewaterutilityservices areprovided tothoseproperties. For thepurpose ofthissection, "service" means extensions ofand/orservice connectionstoCitywastewaterutilitiestoproperty locatedoutside Citylimits. "Extension" meanstomodify, expand, or extend theexisting Citywastewaterinfrastructure suchassewer mains andrelated appurtenances. This policydoes notapplytowaterutilities. Exceptionstothis policyaresetforthinsubsection (b) ofthissection. Propertieswithinurban growthareas. shallbepermitted wastewater serviceonlyupon enteringintoan outside utility agreement with theCity providingfor: 1) consent toannexation oftheproperty aspartofanynotice ofintentorpetitionforannexation presentedtotheCity; 2)Consistencywithanyproposed extraterritorialcomprehensivelanduse plananddevelopmentstandards for theproperty adoptedpursuanttoRCW35.13.117fornew development; and 3)Consistency withadopted Cityordinancesandpolicies fornew development; Page1of4 BMCCh. 15.03.040 ServiceBeyond CityLimits Docusign Envelope ID: C1EA7F12-15EF-462E-84D3-4D68FB5AD3B3 4) Consistencywiththeadopted CityWastewater Comprehensive Planand Engineering Design andConstructionStandardsfornewdevelopments. b) Properties outside urbangrowth areas. urbangrowth areas, Exceptions. Incaseswherean ownerofproperty locatedoutsidetheCitylimitsrequests extension ofutilityservice, the CityCouncil may, in itssoleandabsolute discretion, provide wastewater utilityservicestothose propertiesiftheproperty ownerexecutes anoutsideutility agreement pursuanttothe provisions setforthinsubsection (d) ofthis section and: AnnexationNot Feasible. Incases wheretheCityCouncil determines thatannexation of 2) FailedSystems. Incases whereanexisting septicsystem servingpropertyhas failed, and: 1i) TheHealthOfficerDistrictlocalhealth officialcertifiesthatan existing septic systemhasfailedandis physicallyincapable ofbeingrepairedorreplaced inamanner meetingapplicable healthstandards; and 2ii) TheCconnection isshown tobenecessarytoprotectbasicpublichealth andsafetyandthe environment; and 3iii) Forproperty locatedoutsideanurban growtharea, tThe utilityservices providedbytheconnectionarefinanciallysustainableatruraldensitiesanddonotpermit urban development pursuantto RCW36.70A.110(4); orand 3) OtherCircumstances. Inany othercircumstances wheretheCityCouncil determines, atitssole andabsolute discretion, thatitisnecessaryorappropriate toallow theprovisionofwastewater utility service. 4) Theowneroftheproperty executes anoutsideutilityagreement withthe termssetforthinsubsections (a)(1)-(4) ofthissection. c) ExistingUtilities. Nothing inthissection isintended toabrogate anyexisting wastewater utilitysystems currently inexistence outsidetheCity limits. The Citydoesnotintend toterminate anywastewater utilityserviceoutsidetheCity limits thatisinexistence asof the effectivedateof theordinancecodifyingthissection. However, theCitywillnotprovidenewwastewaterutilityservices to propertyfromexistingwastewater utilitieslocated outside theCitylimitsexcept: 1) Asprovided insubsection (b) ofthissection; or 2) Anew serviceconnectionto asingleparcel of propertyfromafronting sewermain pursuant toBMC15.03.080 wastewaterutility infrastructure suchassewer mainsandrelated appurtenances; or 3) Newutilityservices fromanexistingCity wastewaterutilitysystemas established byalocalimprovement district (LID) to property thatissubjectto theLID. Toreceive anyofthesenewservices, theproperty ownermustexecute anagreement pursuant to theprovisions setforthinsubsection (d) of thissection. TheDirector ofPublic Works and Utilities isauthorized toapproveutilityservice pursuanttosubsections (c)(2) and (3) ofthis section. d) Outside UtilityAgreement. IntheeventthattheCityCouncildetermines, pursuant tosubsection (b) ofthissection, toprovidewastewaterutilityservices beyondtheCitylimits, the owneroftheproperty for whichservice isauthorizedmustexecute anoutsideutilityagreement withtheCityprovidingfor theownergranting tothe CityofBremertonalimitedpower of orpetition forannexation presented totheCityofBremerton. e) TheDirector ofPublicWorks andUtilities shallreviewthe applicationforservices reviewanddetermination undersubsection (b) ofthis section. SECTION 2. Severability. Ifany oneormoresections, subsections, or sentencesof thisOrdinance areheld tobeunconstitutional orinvalid, suchdecision shallnot affectthevalidityoftheremaining portion ofthisOrdinance andthesameshall remain infull forceandeffect. SECTION 3. Effective Date. Thisordinanceshalltakeeffect andbeinforceten 10) daysfromandafteritspassage, approval andpublication asprovided bylaw.
