Removal of billboard by midnight 2/1/09
STREET RIGHT-OF-WAY USE PERMIT FOR CBS OUTDOOR

THIS AGREEMENT, made and entered on this \2> day of October 2008, by and
between the City of Bremerton, Washington, a municipal corporation (hereinafter "the
City"), and CBS Outdoor~
Whereas, the City owns property at the northwest comer of the intersection of Kitsap
Way and Corbet Drive in Bremerton, Washington upon which CBS Outdoor currently
owns a billboard for commercial use.
Whereas, in 1975, the City and Obie Outdoor Advertising, CBS Outdoor's predecessor in
interest to the above-described billboard, entered into an agreement for a street right of
way use permit for said billboard~
Whereas, on April 3, 2008, pursuant to the terms ofthe 1975 agreement, the City
declared the street right of way use permit null and void~
Whereas, the City and CBS Outdoor desire to enter into another street right of way use
permit agreement to allow CBS Outdoor to display the billboard until midnight January
1,2009 in consideration for payment to the City $862.00 and to require removal of the
billboard by midnight February 1, 2009~
Whereas, CBS Outdoor currently maintains general liability insurance for the billboard
and the property upon which the billboard is located in the amount $15,000,000
aggregate and $5,000,000 per occurrence~
Therefore, the undersigned parties agree that the City grants to CBS Outdoor, its
successors or assigns the use of the street righ~ of w~y located on City property at the
northwest comer ofthe intersection of Kit sap Way and Corbet Drive in Bremerton,
Washington for the sole purpose of continuing to display the existing billboard, and for
no other purpose~
It is further agreed that the term of street right of way use permit expires at midnight on
January 1, 2009~
It is further agreed that CBS Outdoor will remove the billboard and repair any damage to
the property caused by the use or removal of the billboard no later than midnight on
February 1, 2009~
It is further agreed that CBS Outdoor will pay the City $862.00 in consideration of use of
the pillboard on the City's property for the year 2008~
It is further agreed that CBS Outdoor will hold the City harmless from all injuries to
property or persons occurring on the property or as a result of the display of the billboard,
and CBS Outdoor will maintain the general liability insurance described above until the

billboard is removed and any damages to the caused by the use or removal of the
billboard are repaired;
It is further agreed that this street right of way use permit shall continue until midnight
January 1,2009 unless tenninated in writing on thirty days' notice by either party;
It is further agreed that this street right of way use permit may be declared null and void
by the City and the rights and privileges hereby granted forfeited upon thirty days'
written notice and without requirement oflegal action, if CBS Outdoor or its successors
or assigns refuses or neglects to perform any of its obligations herein;

ADDENDUM AGREemENT
THIS AGREEMENT made this 4th day of January , 1982
by and between the City of Bremerton, a City of the first class in
· the State of Washington, and National Advertising Company.
WITNESSETH:
WHEREAS; The City of Bremerton and Obie Outdoor
Advertising, entered into an Agreement dated the 9th day of July
1975.
WHEREAS; National Advertising Company assumed the Street
Right-Of-Way Use Permit in January 1979.
WHEREAS; Said Use Permit Fee has not been increased since
July 1975.
WHEREAS; The City of Bremerton desires to review and
increase the Use Permit Fee annually based upon the Consumer Price
Index for All Urban Consumers.
NOW, THEREFORE, in consideration of the mutual benefits
to be derived, the parties hereto agree that the Agreement dated
the 9th day of July 1975, shall include the following provisions:
"The City of Bremerton shall have the right to review
the Special Use Permit annually and shall have the right to increase
such Special Use Permit rate an amount not more than the amount of
increase in the Consumer Price Index for All Urban Consumers as
published by the U.S. Department of Labor, Bureau of Statistics"

STREET RIGHT-OF-WAY USE PERMIT
THIS AGREEMENT, made and entered into this ~ '~/ day of
., 1975, by and between the CITY OF BREMERTON, a municipal

corporation, hereinafter referred to as "City", and Bob Dragoo, District
Manager, of Obie Outdoor Advertising, or any of his successors, or assigns,
hereinafter referred to as "Obie";
WHEREAS, Obie desires to continue to display the existing
advertising sign inadvertently erected on City street right-of-way on
the Northwest corner of the intersection of Kitsap Way and Corbet Drive
in the City of Bremerton;
WHEREAS, Obie agrees to pay to the City the sum of one hundred
eighty dollars per year payable in January of each year for the right to
continue displaying the aforesaid sign;
IT IS NOW, THEREFORE, hereby agreed between the parties hereto,
and the City hereby grants to Obie the use of said street right-of-way
above-described for the sole purDose of continuing to display the existing
sign, and for no other purpose. This is a street right-of-way use permit
only, and may be revoked at any time by the City.
IT IS FUTHER understood that this agreement shall continue
in effect from year to year unless terminated in writing on thirty days
written notice by either party.
IT IS FURTHER understood and agreed that this Street Right-of-Way
Use Permit may be declared null and void by the City and the r~ghts and
privileges hereby granted forfeited upon thirty days'written notice and
without requirement of legal action, in case Obie or its successors and
assigns, shall refuse or neglect to perform the conditions herein specified
on its part to be performed.
IT IS FUTHER understood and agreed that Obie shall hold the
City harmless from all injuries to property or persons occurring on the
Use property or as a result of the display of the sign. Further, Obie
agrees to provide insurance as may be required by the City so as to
protect the City from claims of damage to persons or property resultin~
from the display of the sign.
