AGREEMENT
THIS AGREEMENT made and entered into this / day of
_4~-.L~ , ].982, by and between THE CITY OF BREMERTON, a
WaShington municipal corporation (hereinafter referred to as "City")
and KITSAP CO~TY SE$~R DISTRICT NO. 1, a Washington municipal
corporation (hereinafter referred to as "District").
WITNESSETH:
WHEREAS, the City operates and maintains a computer
billing system uresently being utilized by the District under a
separate agreement.
WHEREAS, the District desires to add to its existing
billing process to include charges to its customers for street
lighting services.
NOW, THEREFORE, for good and valuable consideration, the
receipt of which is hereby acknowledged, the parties hereto agree
as follows:
1. The City shall include a separate line item on
District billings for each District customer's water bill to be
identified as "Street Lights" and showing a charge therefor of
One and 50/100 ($1.50) Dollars per billing period until otherwise
directed by the District in writing.
2. The District shall pay the City the sum of Fifteen
and 00/100 ($15.00) Dollars per billing period for said services.
Said payments shall be due 2/15/82 ~ bimonthl~ thereafter. In addition
thereto, the District..shall-~y the C~'ty the sum of 0ne Hundred
Dollars and Q0/100 .................. ($ 100.00 ) Dollars as and for
a set-up charge for said service prior to the City's commencement
of said service.
3. The City shall use its best efforts to provide said
service in a timely and efficient manner pursuant %o the billing
periods established by the District.
4. The District shall provide the City with all relevant
information concerning its customers necessary to process such
billings and the City shall not be responsible for the information
so provided.
5. It is understood and agreed that either party hereto
shall have the option to terminate this agreement upon ninety (90)
days written notice to the other. Any such notice may be delivered
personally or sent by certified mail, return receipt requested; if
to the City, as follows: City of Bremerton, c/o Commissioner of
Finance, 239 Fourth St., Bremerton, WA 98310; if to the District,
as follows: Kitsap County Sewer District No. 1, utilities Building
702 Charlotte Avenue, Bremerton, WA 98310.
6. This agreement shall be binding upon and inure to
the benefit of the parties hereto and their respective successors
and assigns. In the event of a dispute between the parties relating
to the interpretation or operation of the agreement, the prevailing
party shall be entitled to recover its costs and expenses incurred
in resolving such dispute from the other party, including a
reasonable sum as and for attorneys fees.
IN WITNESS WHEREOF, the parties hereto have caused this
