HomeMy WebLinkAbout3405RESOLUTION NO. 3405 ARESOLUTION oftheCityCouncil oftheCityof Bremerton, Washington, acceptingthe proposal for annexation of 2925PerryAvenue (parcel #122401-1-033-2002); addressing interimzoning controls ofGeneral Commercial zoning; and requiring theassumptionofalloftheCity's existing indebtedness by theareato beannexed andauthorizing thecirculation of a petition forannexation. WHEREAS, onSeptember24, 2025, theCityreceived aNoticeofIntention to CommenceAnnexation Proceedingsfromownerofpropertyat2925Perry Avenue NEincluding illustratingthe proposed areaforannexation identifiedonamapandfurtherdescribedas depicted inExhibit 1; and WHEREAS, the iating areowners ofnotlessthan tenpercent (10%) invalue oftheproperty, accordingtotheassessed valuationfor whichannexation ispetitioned; and WHEREAS, theproposed area forannexationis located within Urban GrownArea (UGA); and WHEREAS, theCityCouncilmustmeetwiththeInitiatingPartiesnolaterthan 60days afterfilingtherequestforannexationto consider thepetition anddecide whether itwill 1) accept, reject, orgeographically modify theproposed annexation; 2) require thesimultaneous adoption ofthecomprehensive planfortheareaproposedtobeannexed; and3) requirethe assumptionofalloranyportionofCityindebtedness bytheareatobeannexed; and WHEREAS, theCityCouncil findsthat parcel 122401-1-033-2002should be evaluatedandassignedalandusedesignation amendment processandfurtherthatinterimzoningcontrolspursuant toRCW 35.63.200should beimplemented untilsuchtimeasthecomprehensive planamendment processiscompleted; and WHEREAS, theCityCounciladoptsfindingsoffact consistentwithRCW 35.63.200notingthatinterimzoningcontrols thepropertyadjacent toparcel 122401-1-033-2002isdesignatedGeneralCommercial, and furtheraffirmsinterimzoningcontrolsofGeneral Commercial should beapplied tothesite upon annexation; and WHEREAS, CityCouncilhassetOctober 8, 2025, asthedatethatitwillmeet withtheInitiating Parties toconsider thepetition; and WHEREAS, CityCouncil findsthatitisinthe bestinterestoftheCitytoaccept theproposed annexation aspresented, interim zoningcontrolsofGeneralCommercialshouldbe 1 Annexation 2925Perry Avenue Docusign Envelope ID: 5EA487BF-E533-43E7-A73C-1C4898496C43 appliedfortheareaproposed tobeannexed, andrequirethe assumption ofalloranyportion of Cityindebtedness bytheareato beannexed; NOWTHEREFORE, THECITY COUNCILOFTHE CITYOFBREMERTON, WASHINGTON, DOESHEREBY RESOLVEASFOLLOWS: SECTION 1. Therecitalssetforthaboveareherebyincorporatedbyreferenceas setforthherein infull. SECTION 2. ThePetition forAnnexation ofTerritory totheCity ofBremerton attachedheretoasExhibit 1, ishereby acceptedas presentedwithoutanygeographic modification totheareaproposedtobeannexed. SECTION 3. TheCityCouncil adoptsfindingsoffactconsistent withRCW untilsuchtimeasthecomprehensive planamendmentprocess iscompleted. SECTION 4. TheCityCouncil shallrequiretheassumption ofallexisting City indebtednessbytheareatobeannexed. SECTION 5. Toproceed withtheproposedannexation, theInitiating Parties shallberequired tosubmittheappropriate petitiontotheCityCouncilforconsideration and furtheraction alldeemedappropriatepursuant toRCW35.13.130. SECTION 6. Severability. Ifany oneormoresections, subsections, or sentencesofthis Resolutionareheld tobe unconstitutional or invalid, suchdecision shallnot affectthevalidity oftheremaining portion ofthisResolution andthe sameshallremain infull forceandeffect. SECTION 7. Effective Date. ThisResolutionshalltakeeffect andbe inforce immediatelyupon itspassage.
