Whileitis located inacommercialzone, CJ's Evergreen General Store & Catering, located at1417Park Ave, isanexampleof aneighborhood serving commercial business. OthercitiesintheState have adoptedsimilar standards, suchas Bothell, Shoreline, andAnacortes. While the proposalwasnot approvedbythe legislature, House Bill (HB) 1175wouldhave mandated thatallWashington citiesallow neighborhood commercial inresidential zones. An approved ConditionalUsePermit (CUP)wouldbe required forsitingtheproposed Neighborhood-scaleCommercial usein ordertodeterminewhetherany mitigation or special conditions are appropriateforaspecific site oruse. The proposed regulations would allowfor commercial usesincluding: Restaurant Drinkingplace (onlyifalsoofferingfood) Market/grocery store (limitedto saleoffood, beverages, household items) Personalservices (perthezoningcode definition inBMC20.42, whichincludeslaundry anddry-cleaning, beautyand barbershops, tanning, otherpersonal groomingfacilities, andcomputer/phone repairs) TheseNeighborhood ScaleCommercialuseswould bepermittedoncornerlotsonly. Alimit of 1,200squarefeetapplies foranewconstruction, and 2,500squarefeetforan existingbuilding. Inall instances, businesses mustbewithinacompletelyenclosed space, conform to theCity noiseordinance BMC 6.32, andhoursofoperationwouldbe limited to10PM. Standardnotification foraTypeIICUPwouldapply, withnotice mailed to allproperty owners within 300feetofthesubjectproperty, inadditiontolandusenoticepostedatthesite. The14- day commentperiodallowsneighboring property owners toprovide feedbacktotheCity regardingtheproposal, to potentially allowtheCityto determineneeded mitigation, suchas landscaping orlimiting hoursof operation. ThePlanning Commissionshowed support forallproposed zoningcodeamendments, however, one Commissioner voted againstrecommendation totheCityCouncil duetodisagreement with thefinal versionofNeighborhood-scale Commercial criteria. WhilethedissentingCommissioner supported the overallNeighborhood-scaleCommercial codeaddition, theypreferred ceasing business operationsat9PM, andrequiring business be spaced ¼ mileapart. TheCommission recommendation is fora10PMclosingtime, andbusinessesbeing limited to streetcorners.
