HomeMy WebLinkAbout5519ORDINANCE NO. ________ ANORDINANCEof theCityCouncilof theCityof thBremerton,Washington,recognizingthe1896vacationof 26 StreetlyingwestofPhinney Bay Drive. thWHEREAS, aportion of26Street wasdedicated asacounty roadin 1891inan areathatwassubsequently annexed intotheCityof Bremertonin1961;and WHEREAS, thelawsineffect atthetimeofthededication required theroadway tobeopened for public usewithin five (5) years ofdedication. Theroadwasnotopened by 1896, therefore, the roadwaywasautomatically vacated by operationoflaw; and WHEREAS, theCitydesires torecognizeandacknowledge thattheportion of th26Street lying westofPhinneyBay Drivehasbeen vacatedbyoperation oflaw; NOW, THEREFORE THECITY COUNCILOFTHE CITYOFBREMERTON, WASHINGTON, DOESHEREBYORDAINASFOLLOWS: SECTION 1.TheCity ofBremerton herebyrecognizedandacknowledges that, thpursuanttotheLawsof1889-1890, Section 32,Chapter19, theportion of 26Street lyingwest ofPhinney Bay Drivehasbeenvacatedbyoperation oflaw. SECTION 2.Severability.Ifanyoneor moresections, subsections, orsentences ofthisOrdinance areheld tobeunconstitutional or invalid, suchdecisionsshallnotaffect the validityoftheremaining portion ofthisOrdinance andthe sameshall remain infullforceand effect. SECTION 3.Effective Date.Thisordinanceshalltakeeffect andbeinforceten 10)daysfromandafter itspassage, approvalandpublication asprovided bylaw.
