WHEREAS, theCorporation oftheCatholic Archbishop ofSeattle hasinitiated thevacation inaccordance withBremerton MunicpalCode (BMC) 11.20.070;and WHEREAS, thealleytobe vacatedwillbetterservethecommunity byallowing theStaroftheSeaCatholicSchoolto expandtheexistingschoolcampusandconstructanew facilityforstudents; and WHEREAS, theCitypassedResolution No. 3403 settingahearing dateto considerthevacation, totakepubliccommentorconsiderwrittenobjectionstothevacation; and WHEREAS, onehundred percentofthe propertyownersabuttingsaid right-of- wayhaveagreedto vacatesaidright-of-waypriorto thetimeset forpublic hearing herein; and WHEREAS, apublichearing washeld byCityCouncil withproper noticeon October1, 2025, intheCityCouncil Chambersofthe NormDicks Government Centertotake publiccomment orconsider writtenobjections tothevacation; and WHEREAS, theCityCouncilhasdetermined thatitis inthebestinterestofthe publictoproceedwiththevacation; NOWTHEREFORE THECITY COUNCILOFTHE CITYOFBREMERTON, WASHINGTON, DOESHEREBYORDAINASFOLLOWS: SECTION 1.Recitals.Theforegoing recitalsareincorporated asif fullyset forth herein. SECTION 2.Easements.Noeasementsare reserved. SECTION 3.VestedRights.Novested rightsshallbe affected bytheprovisions ofthisordinance. SECTION 4.Severability.Ifanyoneor moresections, subsections, orsentences ofthis Ordinanceareheld tobeunconstitutional orinvalid, suchdecisionsshallnotaffect the validityoftheremaining portion ofthisOrdinance andthe sameshall remain infullforceand effect. SECTION 5.Effective Date.Thisordinanceshalltakeeffect andbeinforceten 10)daysfromandafter itspassage, approval andpublication asprovided bylaw.
