Dear Mr. Milnes,
After speaking with you last week I reviewed your flle and spoke with the Dlrector of Community
Developmentind severat of the staff, who have worked on your project, about the cunent state of the
"patio covering" at 610 % Washington Street.
Our records show that you applied for and were granted a building permit in September of 1996' That
building permit includeil windows, siding, drywall, insulation and a patio covering. A SEPApyiewyvaq
also co-nducted resulting in a Determination of Nonsignificance (DNS). On 7 November 1996 revised
plans were submitted io ptace guard railing over the second floor sliding glass doors instead of
building the patio covering (copy included). These revised plans were approved on 15 November
1996. The project was completed and the permit expired on 24 May '1997'
Subsequently the "patio covering" has been build without a permit, and the abatement process has
been initiated. There is cunently patio furniture on this "covering" indicating deck-like uses with no
guardrails etc., thus increasing safety hazards.
While this project did receive land use approval in 'l 996, it does not quality for approval at this time.
The Bremerton Shoreline Master Program (SMP) does not allow fordevelopmentwithin 25 feet of the
Ordinary High Water Mark (OHWM). This projectwas constructed overthe OHWM without a permit.
Moreover, this project does not meet any of the requirements for a shoreline exemption in the
Bremerton Shoielirie Master Program or WAC 173-14-040. Thus, the abatement should proceed and
the protective guardrails (as indicated in the revised 1996 plans) replaced.

and liiten to any concerns, thoughts, discrepancies, and alternatives you may present within_the
