We write in response to your Notice to Vacate and Notice of Violations dated February 12,2024 (the "Notice"). Please direct to us all future communications from the City concerning this matter. Pursuant ro the Notice, Broadview is required to board up the Building and apply for permits to correct the issues noted in the WSW Engineering Report dated January 11,2024 (the "Report"). Furthermore, Broadview has been given the deadline of March 11,2024 to complete all corrections to the Building. Broadview is not currently disputing the need for repairs to the Building and has diligently sought qualified engineers in good faith for the remedial work. As you are likely aware, some of the work detailed in the Report requires advanced knowledge of concrete pilings for which there are a limited number of qualified engineers. Due to the limited pool of qualified professionals and the short timeframe to complete the work, Broadview has been unable to secure an engineer willing and able to comply with the tight timeline. To date, f,rve engineers have declined this project due to the time constraints. We hereby request that Broadview be provided with a suitable extension to complete the permitting phase of the project or be afforded a voluntary correction agreement with the City of Bremerton pursuant to BMC 1.04.030. Meanwhile, Broadview intends to continue working on the Building. In evaluating this request, it is important to note that Broadview obtained the Report on its own volition. Further, the findings in the Report were voluntarily shared by Broadview with the City in good faith. LASHER HOLZAPFEL SPERRY & EBBERSON City of Bremerton - Department of Community Development Attn: Ian Coen, Code Enforcement Officer March 7,2024 Page 2 of 2 Broadview has appreciated being part of the Bremerton community. However, the City's abrupt handling and treatment of Broadview and the Property leaves Broadview questioning its relationship with the City and standing in the Bremerton community. It would be unjust to penalize Broadview for voluntarily prosecuting the restoration of its building in good faith, and to have used against it in this way, information Broadview voluntarily shared with the City. Add to this the unreasonable timeline for corrective action. If needed, Broadview is prepared to defend itself accordingly, but hopes the City will cooperate by extending the deadline for compliance so that Broadview can complete repairs. We look forward to the City's response, and please do not hesitate to contact me directly if you would like to discuss this matter. Very truly yours, Kelly J. Based on our evaluation, it is our opinion that the building is not currently safe for occupancy due to extensive damage to the foundation. lt is our opinion that the foundation damage was initiated by the 2OO1 Nisqually Earthquake and has been progressively worsening since. ln addition, recent modifications to the decks were observed to be improperly constructed and in generally poor condition. We are recommending that the Owner implement retrofits and repairs throughout as necessary to restore the building to a safe condition prior to occupancy. Site Observation WSW Engineering visited the building site on December 8, 2023from 9:3oam to'lO:2Oam to observe and evaluate the condition of the existing foundation system as well as the condition of the existing elevated decks. Tides were fairly high on December 8 with a low tide of +6.Oft at 7:Olam and a high tide of +.l1.5ft at 1:1opm. Access to the outer foundations and framing was limited. Our evaluation started on the northwest side (fig 5) of the building and proceeded to the south (figs 2, 3). We focused primarily on the condition and stability of the existing concrete foundations and supported wood decks. Our evaluation was limited to structural life-safety and did not include any observation of non-structural or serviceability issues, nor does our observation include the two-story wood superstructure. It is our understanding that the building has been and remains unoccupied. Findings Primary Structure We observed many concrete piers with moderate to severe cracking, visible rust, spalling, and loss of section. The damaged piers (figs 30-33) were primarily on the east side (water side) of the building. The west side, with a long north-south concrete retaining wall was much less affected. An existing 'chimney' pier (figs 6-21) with corbels in the approximate center of the building also showed severe cracking, rusting, and spalling. The west corbel is showing severe cracks indicative of an ongoing bearing failure, probably initiated by a large crack in the wall. On the south side, a newer sonotube pier (figs 26-29l, was installed, apparently due to some issue with the original adjacent pier. This newer pier also has severe WSW ENCINEERINC PO BOX lr6'/8, BATNBRTDCE iSLAND V/A 98110 | (206) 402-2906 6'10 Washington Ave Bldg.3 Report of Structural Findings January 11,2024 vertical cracking. Concrete on the west side (uphill side) was in generally fair condition and appeared as would be expected for concrete of this age. The foundation does not appear to have a lateral resisting system on the east elevation (water side) to resist shaking in the north-south direction. As discussed below, this is the likely explanation for the concentration of damage to the east. ln addition to the concrete damage described above, we observed that there generally was minimal positive connection between the concrete and the wood structure above. At conditions where the structure has been more recently modified, there was typically no connection between concrete and wood, and no connection between wood posts and beams. Posts, shims, and blocks were observed to be ill-fitting and generally ineffective. Where a post-base was observed, it was severely corroded and ineffective. Decks Two wood decks were observed during our visit, an elevated deck over the water to the east supported on pilings, and an entry deck to the south supported on concrete walls. Both decks appeared to have been recently modified. East Elevoted Deck The east deck (partially visible in fig 2) is supported both on wood posts and on braces to the primary concrete house piers. 2" nominal diagonal braces are installed between the posts for stability. Both the posts and braces were observed to be in very poor condition, both with wood deterioration and with steel hardware corrosion. The deck framing above was not accessible but was observed from a distance. The framing was observed to be severely discolored, but we were unable to determine the cause. The deck posts are supported on circular concrete piles protruding above the sand, but underwater at higher tides. Both the post base connection and concrete condition were not visible during this visit, but were observed during our pre-proposal visit in July. The condition of both were observed to be very poor with severe wood and concrete deterioration. South Entry Deck The south deck (figs 22-25) was observed to be poorly constructed with few positive connections between members and no visible anchorage to the supporting concrete walls. The wood appears to be in fair to poor condition with some evidence of water damage throughout. The sand supporting the foundation walls have been scoured over time and are completely undermined in places. We observed evidence of ongoing settlement in the walls with diagonal cracking throughout. Nisqually Earthquake Based on our observations and findings, it our opinion that much of the concrete damage initially occured during the Nisqually Quake in 2OOl, and has since been worsening. The damage appears consistent with the seismic event (USCS lntensity Vl, strong shaking, light damage, O.l2 PSA reported in Bremerton). This level of shaking is described by the USCS as "Felt by all, and many are frightened. Some heaqy furniture is moved; a few instances of fallen plaster occur. Damage is slight." See Appendix B for USGS Nisqually reference information. 2ot 4 WSW ENGINEERINC po BOX ]1678, BATNBRTDCE iSLAr.tD V/A 98il0 | (206) 402-2906 610 Washington Ave Bldg.3 Report of Structural Findings )anuary11,2024 The damage is characterized by large open vertical cracking on concrete columns, piers, and walls caused by extreme bending stresses during shaking. While modern buildings are reinforced to prevent this damage, the age of this building means that no such reinforcement is likely to be present. Once the cracks were started, the concrete had minimal residualstrength and continued to fracture and open under much lighter stresses. The ability for the building to resist another earthquake of a similar magnitude is questionable. Given that current design seismic events in the region far exceed the Nisqually shaking intensity, seismic strengthening retrofits should be strongly considered. Recommendations Our recommendations to restore the building to a safely occupiable condition are as follows: Seismic Retrofitting '1. Retrofit the building to provide lateral resistance in the north-south direction on the east elevation. Retrofits would likely be constructed using steel bracing between new piers on the east elevation of the building. 2. lmprove connections between the foundation and the wood framing to ensure adequate strength to resist seismic forces.3. Retrofitting should be performed in accordance with the recommendations of the American Society of Civil Enginners (ASCE) published in the standard "Seismic Evaluation and Retrofit of Existing Buildings", ANSI/SEl 41. Concrete Piers and 'Chimney' L Retrofit or replace the existing damaged piers and 'chimney'. lt is likely that repair will not be feasible in many cases and full replacement will be required. East and South Decks l. Remove and replace deteriorated wood framing and framing connectors. 2. Add positive connections between wood members and an anchorage between wood members and concrete supports.3. Remove and replace the east deck posts and bracing with new structure suitable for the marine environment. Engage a testing agency to evaluate the subsurface condition of the deck piers and their adequacy for re-use. Replace if necessary. 4. Underpin the scoured footings supporting the south deck. Repair spalling and corrosion damage. Consulting '1. Engage a licensed Ceotechnical Engineer to evaluate the site and provide recommendations for the capacity of existing footings as well as for the capacity and installation of new footings, pilings, and underpin piles. 2. Engage a material testing agency to test the strength of the existing concrete.3. Engage a licensed Architect to consult on planning, zoning, environmental and other non-structural issues, and to coordinate with the Building Official. 4. We strongly recommend engaging consultants and contractors with specific experience working in marine environments. 3of4 WSW ENGINEERING po Box lr678, BATNBRTDCE rSLAr'lD, WA 9Blt0 | (206) 402-2906 61O Washington Ave Bldg.3 Report of Structural Findings January 11,2024 Unfortunately, based on our observations and findings, it is our opinion that Building 3 in not structurally safe for occupation in its current state.
