1 EXHIBIT A SCOPE OF SERVICES Background This scope of services is to amend the Professional Services Agreement between the City of Bremerton (City) and HDR Engineering Inc. (HDR) for the Wastewater Salinity Impact Study/Project # 325011. Initial work performed by HDR involved review of collection system and wastewater treatment plant (WWTP) data and site inspections of pump station WB3, Bremerton West WWTP, and city-owned forest land where biosolids are land applied. As a result of the initial work it was determined that the scope and objectives of the original contract were not feasible as there was a lack of evidence and data that would support development of a quantification of the direct impact of saline discharges to WB3. In addition, new activities by Naval Base Kitsap (NBK) – Bremerton pertaining to salinity evaluations and Washington Department of Ecology (Ecology) pertaining to nutrient control prompted a change in study objectives. Thus, the original scope of services is being modified to address these issues. This amendment includes the de-obligation of budget under existing tasks and reallocation of budget to support the City on the following: 1.Task 100: Project Management A.No changes to this task. 2.Task 200: Data Collection A.This task is complete and the budget was used in its entirety, no change to this task. 3.Task 300: Site Studies A.This site study activities are complete, preliminary site visits and assessments were completed; however, there is insufficient evidence to quantify impacts of salinity from NBK-Bremerton on the City’s WWTP to support a financial claim as this task was originally scoped. B.HDR will prepare a short technical memorandum (TM) summarizing the results of the initial data review and site observations. C.A portion of the remaining budget will be used to prepare a technical memorandum (TM) summarizing results and interpretation of ongoing biosolids and soils salinity sampling. D.The remainder of the unused budget will be reallocated to new tasks. 4.Task 400: System Analysis A.The preliminary work for this task is complete for analysis of the system and impacts from Naval Base Kitsap (NBK). B.A portion of the remaining budget will be used to support the City during execution of the wastewater salinity study being conducted by NBK – Bremerton by their consultant, WSP. C.The remainder of the unused budget will be reallocated to new tasks. 5.Task 500: Report DocuSign Envelope ID: FD7F8A41-A2FB-41B1-B068-31D20962E879 Wastewater Salinity Impact Study 2 Scope of Services Contract Modification No. 1 A.Approximately $5,500 or 15% of the original task fee was expended in preliminary report-writing efforts for the biosolids and land application soil sampling TM, as well as for out of scope effort in support of communications with state of Washington Department of Ecology’s (Ecology) regarding the NPDES permit for NBK – Bremerton prior to opening of Task 700. Work on this task was suspended with the change in study focus. HDR is de-obligated from this task, and no additional work remains to be completed under this task. B.The remainder of the unused budget will be reallocated to new tasks. 6.Task 600: Management Reserve A.The original management reserve is retained and unchanged. 7.Task 700: Nutrient Permitting Support (New) A.This task was a new task that was authorized by the City on March 20, 2020 to support the City on out of scope items as they relate to this amendment and activities associated with the state of Washington Department of Ecology’s (Ecology) development of discharge permit changes relating to nutrient discharge to Puget Sound. B.Unused budget from existing tasks will be reallocated to this task. 8. Task 800: Salinity Threshold Loading Analysis (New) A.This is a new task for this amendment to develop salinity threshold loadings that can be used to support a basis for salinity limits in the NBK-Bremerton National Pollutant Discharge Elimination System (NPDES) permit. B.Unused budget from existing tasks will be reallocated to this task. 9. Task 900: Salinity Surcharge Support (New) A.This is a new task for this amendment to support the City in negotiations with NBK- Bremerton. B.Unused budget from existing tasks will be reallocated to this task. For a complete summary of the original authorized fee, effort completed/budget spent, contract fee remaining, fee being subtracted, remaining budget and revised authorized fee for existing tasks, refer to the summary table in Exhibit C. Also included in Exhibit C is the authorized fee for the new tasks. Scope of Services Summary The following tasks are included in this scope of services: Task 100 Project Management Task 200 Data Collection Task 300 Site Studies Task 400 System Analysis Task 500 Report Task 600 Management Reserve DocuSign Envelope ID: FD7F8A41-A2FB-41B1-B068-31D20962E879 Wastewater Salinity Impact Study 3 Scope of Services Contract Modification No. 1 Task 700 Nutrient Permitting Support Task 800 Salinity Threshold Loading Analysis Task 900 Salinity Surcharge Evaluation Support Task 100 Project Management There are no changes to this task as part of this amendment. Task 200 Data Collection This task is complete, no additional scope and budget required. Task 300 Site Studies Objective The objective of this task in the original scope of services was to gain a thorough understanding of the wastewater system and the impact of salinity to the operations. Work completed to date includes WWTP and biosolids land application site visits, data collection, and corrosion and condition assessments. Based on the information and evidence obtained from this effort, HDR could not quantify the impacts of NBK – Bremerton saline wastewater discharge to standards necessary to support a financial claim against NBK – Bremerton. Draft and Final TMs were prepared on recommendations for measuring salinity levels in the biosolids and land application site soils. The revised purpose of this task in this amendment is provide 1.Preparation of a short TM summarizing the results of the data analysis and site investigations. 2.Continued support on the recommended biosolids and soils testing. HDR Services 1.HDR will prepare a short TM summarizing the results of initial data analyses and site investigations. 2.Review biosolids and land application site soils salinity testing results, and prepare a Biosolids and Land Application Site Soil Salinity Analysis TM to interpret and provide recommendations on management of salinity concentrations and implications with respect to agronomic loading rates and risk of “tree burn”. Client Responsibilities 1. Coordinate and execute recommended sampling activities. 2.Pay for third party salinity analyses that cannot be completed in the City owned laboratory testing facilities. Assumptions 1.Data analysis and site investigation TM will be a maximum of five pages. 2.Weekly biosolids salinity testing is anticipated to begin in September 2020. One-time dry- season land application site soils salinity testing results are anticipated to begin in DocuSign Envelope ID: FD7F8A41-A2FB-41B1-B068-31D20962E879 Wastewater Salinity Impact Study 4 Scope of Services Contract Modification No. 1 August/September 2020. The TM will be prepared when the soil salinity data and at least two months of biosolids salinity data are available. Deliverables 1.Draft and Final Data Analysis and Site Investigation Summary TM. 2.Draft and Final Biosolids and Land Application Site Soil Salinity Analysis TM. Task 400 System Analysis Objective The objective of this task in the original scope of services was to use information obtained from Tasks 200 and 300 and perform an assessment of the impact of salinity on the wastewater system. The revised purpose of this task in this amendment is to support the City during execution of the wastewater salinity study being conducted by NBK – Bremerton by their consultant, WSP. The draft NPDES permit for NBK – Bremerton requires a Salinity Study to be submitted to Ecology. The overall objective of the Salinity Study is to characterize high-salinity wastewater sources through sampling and address potential means of reducing salinity. NBK – Bremerton has prepared and is executing a sampling plan as part of the Salinity Study. HDR will assist the City on an on-call basis in reviewing, interpreting, and responding to the Salinity Study as associated work products are produced by NBK - Bremerton. HDR Services 1.HDR services for task activities related to the NBK- Bremerton salinity study will be executed as an on-call task, as requested by the City. Potential services may include, but are not limited to, the following: a.Review and comment on Salinity Study work products from NBK – Bremerton. b.Prepare responses to NBK – Bremerton Salinity Study work products on behalf of the City. c.Attend meetings related to the NBK – Bremerton Salinity Study. Client Responsibilities 1.Schedule meetings related to NBK – Bremerton Salinity Study that may be attended by HDR. 2.Share information and correspondence related to the NBK – Bremerton Salinity Study. Assumptions 1.Three major documents are anticipated for review from NBK - Bremerton: 1) Sampling Plan; 2)Preliminary Salinity Study Report; 3) Final Salinity Study Report. 2.Based on conversations with NBK-Bremerton, the City anticipates the Preliminary Salinity Study Report will be received by early September 2020. DocuSign Envelope ID: FD7F8A41-A2FB-41B1-B068-31D20962E879 Wastewater Salinity Impact Study 5 Scope of Services Contract Modification No. 1 3.All meetings will be in virtual/teleconference format. Three “major” meetings/workshops jointly attended by the City, and NBK – Bremerton and their associated consultants to discuss the anticipated documents listed above. 4.NBK – Bremerton will prepare meeting minutes as the responsible party for Salinity Study. 5.Effort for this task is limited to the fee included in this amendment, unless authorized by the City to use the Management Reserve fee in Task 600. Deliverables 1.Comments/responses to NBK – Bremerton Salinity Study work products. 2.Responses to meeting minutes, as appropriate. Task 500 Report This task is no longer required and the effort is being de-obligated and reallocated to other tasks as shown in Exhibit C. Task 600 Management Reserve This management reserve is an allowance of $25,000 originally intended to be used for such activities as testing and additional investigation. It may only be used when authorized in writing by the City. There are no changes to the management reserve as part of this amendment. Task 700 Nutrient Permitting Support (NEW) Background Recently, the Washington Department of Ecology’s (Ecology) proposed using both general and individual permits to control nutrient discharges to Puget Sound. Details of Ecology’s permitting approach are under development, but the signal is clear that Ecology intends to promulgate new nutrient control measures, with particular emphasis on nitrogen removal. The expectation is that Ecology will cap effluent nitrogen loads at current levels, which becomes a de-facto nitrogen removal requirement in order to accommodate growth. New nitrogen removal requirements could have major implications for plants not designed for nitrogen removal, such as the City’s West WWTP. Based on how other facilities are permitted nationwide, explicit nutrient removal requirements are not anticipated for the City’s East WWTP, which is used only for wet weather treatment, thus making conventional biological nitrogen removal not practical. Should the nitrogen discharge load reductions from the East WWTP be required, the permit structure would likely allow such load reductions to be achieved at the West WWTP as an additional incremental load reduction compensating for the required East WWTP reductions. This task was a new task previously authorized by the City on March 20, 2020 to support the City on out of scope items as they relate to this amendment and activities associated with Ecology’s development of discharge permit changes relating to nutrient discharge to Puget Sound. The task is being expanded and defined to address specific objectives below. DocuSign Envelope ID: FD7F8A41-A2FB-41B1-B068-31D20962E879 Wastewater Salinity Impact Study 6 Scope of Services Contract Modification No. 1 Objectives In order to prudently plan for possible nitrogen removal scenarios, the City is seeking a better sense of what different levels of nitrogen removal may mean in terms of capital cost, operations cost, and space requirements. HDR will perform a “bracketing” analysis to identify rough order- of-magnitude cost, tank volume, and space requirements to achieve different levels of nitrogen removal. The potential impacts of associated costs on service rates will be assessed. HDR will also review the current nitrogen data used in Ecology’s Salish Sea model and provide nitrogen sampling recommendations to better characterize the City’s influent and effluent nitrogen loads. HDR Services 1. Review historical data used by Ecology for Bremerton treatment facility inputs in the Salish Sea model. Comment on the data that were used and whether the data reasonably reflect current conditions. Comment on any potential permitting risks or biases emanating from the use of said data. 2. Provide nitrogen sampling recommendations in a short TM format. Such analyses can better characterize the City’s influent and effluent nitrogen loads, which may be advantageous in permit negotiations and to establish a more robust historical database for evaluation of nitrogen removal upgrades. 3. Conceptual nitrogen removal requirements bracketing analysis of order-of-magnitude tank volume, capital and operations costs, and space requirements for five scenarios: A. “No or low-cost” optimization opportunities in existing the treatment process, where system improvements for optimization are less than 5% of the annual equipment budget. Such opportunities will be considered but may not be practical at the West WWTP. This analysis will include comments on general findings and limitations to nitrogen removal (e.g., existing tank volumes, wet weather flows, etc.) in current infrastructure. B. Sidestream nitrogen removal, i.e., removal of the nitrogen return load from dewatering, which is typically about 20 percent of the secondary influent nitrogen load. C. Basic nitrogen removal for plant design capacity with conventional technology. Effluent total inorganic nitrogen (TIN) approximately 8 mg/L, which is the effluent nitrogen concentration associated with a “base” level of nitrogen removal assumed in Ecology’s Salish Sea modeling. D. Basic nitrogen removal for plant design capacity with innovative technology. Same as C above but using a newer technology with potential for cost and/or space savings. E. Enhanced nitrogen removal for plant design capacity with conventional technology. Effluent TIN approximately 3 mg/L, which is a lower effluent nitrogen concentration assumed in Ecology’s Salish Sea modeling. Tertiary filtration included. 4. Estimate East WWTP nitrogen discharge loads and relative magnitude compared to loads from West WWTP at current conditions and hypothetical future discharge at TIN concentrations above. This analysis informs the relative contribution of TIN discharges from the East (wet-weather) and West WWTPs and the potential “extra” TIN removal that the West WWTP may need to achieve to make up for the lack of additional nitrogen removal capability at the East WWTP. Client Responsibilities DocuSign Envelope ID: FD7F8A41-A2FB-41B1-B068-31D20962E879 Wastewater Salinity Impact Study 7 Scope of Services Contract Modification No. 1 1. Provide supplemental data such as design drawings, design summaries, and/or plant data that may be needed to support the analysis. 2. Review Conceptual Nitrogen Removal Requirements Bracketing Analysis TM. Assumptions 1. Many nitrogen removal technologies and approaches are available to target different effluent concentrations. The intent of this analysis is to use a representative technology/approach to estimate order-of-magnitude impacts and is not intended to be a full alternatives analysis. Technology/approach selections are not intended to represent HDR recommendations. 2. All meetings will be in virtual/teleconference format. Two meetings are anticipated: one to review preliminary concepts and space requirements for nitrogen removal scenarios, and another to review the draft TM after associated costs are developed. 3. Effort for this task is limited to the fee included in this amendment, unless authorized by the City to use the Management Reserve fee in Task 600. Deliverables 1. Nitrogen Sampling Recommendations TM. 2. Draft and Final Conceptual Nitrogen Removal Requirements Bracketing Analysis Technical Memorandum. Task 800 Salinity Threshold Loading Analysis (NEW) Objective The NPDES permit for NBK – Bremerton is in the process of being renewed. HDR assisted the City in commenting on the draft permit during the most recent public comment period. HDR will provide further support by completing a salinity threshold loading analysis to identify the maximum allowable headworks loading (MAHL), which is an estimate of the upper limit of pollutant loading to a publically-owned treatment works intended to prevent pass-through or interference. The MAHL considers pollutant loading from all wastewater sources. The maximum allowable industrial loading (MAIL) is the portion of the MAHL that can be safely allocated to industrial sources and controlled through local limits. MAHLs and MAILs are the basis for local limits and are needed to support a basis for numerical limits in the NBK – Bremerton NPDES permit. HDR Services 1. Determine MAHL for salinity or salinity surrogate such as conductivity. MAHL determination considers pollutant removal efficiency and allowable headworks loadings for various criteria including effluent quality, biosolids quality, treatment inhibition, and corrosion. The most stringent allowable headworks loading governs the MAHL. 2. Determine MAIL for salinity or salinity surrogate such as conductivity. It is assumed that NBK – Bremerton is the sole industrial user for which salinity limits are applicable and thus the entire MAIL would be allocated to NBK – Bremerton. 3. Propose a basis for salinity local limits based on headworks loading analysis above. Compare the proposed basis to existing local limits adopted in City code. DocuSign Envelope ID: FD7F8A41-A2FB-41B1-B068-31D20962E879 Wastewater Salinity Impact Study 8 Scope of Services Contract Modification No. 1 4. Document the analysis and findings in a Salinity Threshold Loading Analysis Technical Memorandum. Client Responsibilities 1. Review and comment on Draft Salinity Threshold Loading Analysis Technical Memorandum. Assumptions 1. Existing City data will be used in headworks loading analysis. No supplemental sampling by HDR or the City will be performed. Data from NBK – Bremerton Salinity Study may also be needed and used as part of the headworks loading analysis. 2. All meetings will be in virtual/teleconference format. 3. Effort for this task is limited to the fee included in this amendment, unless authorized by the City to use the Management Reserve fee in Task 600. Deliverables 1. Draft and Final Salinity Threshold Loadings Analysis TM. Task 900 Salinity Surcharge Evaluation Support (NEW) Background and Objective High salinity discharges from NBK – Bremerton may adversely impact the useful life of the City’s wastewater conveyance and treatment infrastructure and biosolids land application facilities, thus imposing a disproportionate burden on cost of service relative to other primarily domestic wastewater streams. The development of cost-based strength surcharges is based on cost of service principles. A salinity surcharge may be a means of pursuing a more equitable distribution of costs between ratepayers or otherwise incentivizing salinity controls at NBK – Bremerton. HDR will assist the City by coordinating and assisting their rate development subconsultant, FCS, in evaluating the impacts for the activities in Task 800, and developing a basis for a potential salinity surcharge. To this end, this task will include the services listed below. HDR Services 1. Coordinate with FCS to provide information on salinity threshold analysis. 2. Answer questions and provide additional information as needed and requested by FCS. Client Responsibilities 1. Coordinate and subcontract with rate development subconsultant, FCS, for work to develop potential salinity surcharge. Assumptions 1. All meetings will be in virtual/teleconference format. 2. Effort for this task is limited to the fee included in this amendment, unless authorized by the City to use the Management Reserve fee in Task 600. A total of 20 hours of coordination is included in this scope of services. This system has been designed to efficiently collect and treat sewage from residential, commercial, and industrial customers with discharge parameters typical of municipal wastewaters. The City believes that high-salinity wastewater originating from Naval Base Kitsap (NBK) — Bremerton is negatively impacting the City's entire wastewater collection, treatment, and disposal system and exceeds p 9 Y p Y typical ranges for discharge to a municipal wastewater treatment facility. In recent years, City operations staff responsible for operations of the wastewater collection, conveyance and treatment system observed and documented increased corrosion of wastewater collection system equipment, impacts to the treatment plant process units, reduced performance of the biologic treatment process and changes in the composition of the biosolids from the treatment plant that all appeared to be the result of increased salinity in the wastewater stream. The City of Bremerton suspects the source of saline contamination resulted from an increase in the salinity concentration of the NBK— Bremerton wastewater discharges that trace back to 2014 when the City documented a decrease in the potable water usage by NBK— Bremerton; and the associated wastewater discharge from the facility did not correspondingly decrease. The purpose of this study is to evaluate the impacts of salinity on equipment and infrastructure on the conveyance facilities and equipment from the point of NBK— Bremerton discharge to the City's wastewater treatment plant, treatment process units within the plant, to the final discharge of the liquid effluent and the disposal of biosolids. In addition, this assessment will evaluate the impacts of high salt concentrations on wastewater treatment processes, both biological and physical, as well as the impacts on land application of the biosolids.
