HomeMy WebLinkAbout5516ORDINANCE NO. 5516 AN ORDINANCE OF THECITY COUNCIL OFTHECITY OF BREMERTON, WASHINGTON, AUTHORIZING THE CITY COUNCIL TO EXTEND A FRANCHISEAGREEMENT WITH CASCADENATURALGASCORPORATION. WHEREAS, theCityofBremerton (“theCity”) enteredintoafranchise agreement with CASCADENATURALGASCORPORATION (the “Grantee”) asauthorizedbyOrdinance No. 5271onApril4, 2015known jointlyasthe “FranchiseAgreement;” and WHEREAS, thepartiesmutually agreetoextendthefranchisetermforanadditional one 1) year, persection18.2ofOrd. 5271andthereforeresultsintheexpiration oftheFranchise Agreement onApril3, 2026; and WHEREAS, boththeCityandCASCADE NATURAL GASCORPORATIONbelieveitis intheirmutual interest, andinthepublicinterest, toextendthe termoftheFranchise for an additional periodoftimeinorder tonegotiate alonger-termFranchise withmutually agreeable termsbutdonotdesiretointerrupt naturalgasservice intheCity; and WHEREAS, theCityandCASCADE NATURAL GASCORPORATIONhave reacheda mutualagreement foraone (1) yearextension, effectiveApril4, 2025, andexpiringone (1) year from effectivedate. NOW, THEREFORE, THECITY COUNCIL OFTHE CITYOFBREMERTON, WASHINGTON, DOESHEREBY ORDAINASFOLLOWS: Section1. That theFranchiseAgreement withCASCADE NATURAL GAS CORPORATION referredtoinOrdinance No. 5271shallbeextended foraperiodofone (1) year, expiringone (1) yearfromtheeffectivedateofthisordinance. Section2. ThattheFranchise Agreement withCASCADE NATURAL GAS CORPORATION referredto inOrdinance No. 5271, shallbeextended withthesametermsand conditionsexceptfortheeffectivedateandterminationdates, whichshallbeassetforthinthis ordinance. Section3. Ifanyprovisionofthisordinanceisdeterminedtobeinvalidor unenforceable foranyreasonbyfederal, state, orlocallaw, theremaining provisions ofthisordinance and/or theprovisions setforthintheFranchise Agreement withCASCADE NATURAL GAS CORPORATION referredtoinOrdinance No5271willremaininforceandaffect. Section4. Uponthe approvaloftheCityAttorney, theCityClerk isauthorizedtomake anynecessarycorrections tothisordinance including, butnot limitedto, the correctionof scrivener’s/clerical errors, references, ordinance numbering, section/subsection numbers, and anyreferencethereto.
