Home My WebLink About5515ORDINANCE NO. ________ ANORDINANCEof theCity Council ofthe Cityof Bremerton, Washington, amendingBMC Chapter 10.36.010 WHEREAS, theCityCouncil desiresto amendprovisionsrelatingtocompression brakes withinthe Cityof Bremerton.NOWTHEREFORE, THECITY COUNCILOFTHE CITYOFBREMERTON, WASHINGTON, DOESHEREBYORDAINASFOLLOWS: SECTION 1.Chapter 10.36.010oftheBremerton MunicipalCode entitled Compression Brakes" isherebyamended to readasfollows: 10.36.010UNMUFFLED COMPRESSIONBRAKESPROHIBITED. Nopersonshallusemotor vehiclebrakes withinthecitylimitsofthe Cityof Bremertonwhich arein anywayactivatedor operatedby thecompression oftheengineofany suchmotor vehicleoranyunit orpartthereof,unless themotorvehicle isequippedwithan operational mufflerandexhaust system toprevent excessnoise. Amufflerispart ofanengine exhaustsystem whichactsasanoisedissipativedevice. Aturbocharger isnotpermitted tobe usedasamuffleroranoisedissipative device.Itshallbe anaffirmativedefensetoprosecution under thissectionthatsaidcompression brakeswereappliedinanemergencyandwere necessaryfortheprotectionof personsand/orproperty. 10.36.020VIOLATIONS -PENALTY. Anypersonviolating theprovisionsofBMC10.36.010shall havecommitted a traffic infractionand amaximum penalty of $250.00shallbeimposed. 10.36.030AUTHORITY TOPOSTSIGNS. TheCityEngineer isauthorizedanddirected topostappropriate signs consistent withtheprovisions ofBMC10.36. SECTION 2.Corrections.TheCityClerkand codifiersof thisordinanceare authorized tomake necessarycorrections tothisordinance including, butnotlimitedto, the correctionof scrivener, clerical, typographical, andspelling errors, references, ordinance numbering, section/subsection numbers andanyreferences thereto. SECTION 3.Severability.Ifanyone ormore sections, subsections, orsentences ofthisordinance areheldto beunconstitutional orinvalid, suchdecision shallnotaffect the validity ofthe remaining portion ofthisordinance andthesame shallremaininfullforce and effect. SECTION 4.EffectiveDate.Thisordinanceshalltakeeffect andbeinforceten 10)daysfromandafter itspassage, approval andpublication asprovided bylaw.
