WHEREAS, theCityofBremerton enteredintoacableTVfranchise agreementwithComcastCableCommunicationsManagement, LLCasauthorizedby OrdinanceNo. 5218onJune19th, 2013; and WHEREAS, ComcastsenttotheCitya626letterpursuantto47USCSection546, whichwasreceivedAugust13, 2020; and WHEREAS, pursuanttoSection2.3oftheabovereferredtoagreement, theagreement isten (10) yearsindurationandthereforeresultsintheexpirationoftheFranchiseAgreement thonJune18, 2023; and WHEREAS, boththeCityandComcastdesiretocontinuenegotiatingbutdonotdesire tointerruptcabletelevisionserviceintheCity; and WHEREAS, thepartiesmutuallyagreetoextendthetermofthisFranchisebeyondten 10) yearsinordertopromoteandfacilitateanorderlyfranchiserenewalprocess; agreeing however, thatanysuchextensionshallbeincompliancewithApplicableLaw (includingthe CableAct, 47U.S.C. Section546ascurrentlyadoptedorhereinaftermodifiedantherenewalof thisFranchiseshallbegovernedbyandcomplywiththeprovisionsofSection626oftheCable Act, asamended; and WHEREAS, theCityandComcastCableCommunicationsManagement, LLChave reachedamutualagreementforaone (1) yearextension; NOW, THEREFORE, THECITYCOUNCILOFTHECITYOFBREMERTON, WASHINGTON, DOESHEREBYORDAINASFOLLOWS: Section1. ThattheFranchiseAgreementwithComcastCableCommunications Management, LLCreferredtoinOrdinanceNo. 5218shallbeextendedforaperiodof __ONE_ 1 ) year, expiring ____________ 2024 (1) yearsfromtheeffectivedateofthisordinance. Section2. ThattheFranchiseAgreementwithComcastCableCommunications Management, LLCreferredtoinOrdinanceNo. 5218, shallbeextendedwiththesameterms andconditionsexceptfortheeffectivedateandterminationdates, whichshallbeassetforthin thisordinance. Section3. Ifanyprovisionofthisordinanceisdeterminedtobeinvalidorunenforceable foranyreasonbyfederal, state, orlocallaw, theremainingprovisionsofthisordinanceand/or theprovisionssetforthintheFranchiseAgreementwithComcastCableCommunications Management, LLCreferredtoinOrdinanceNo5218willremaininforceandaffect.
