Proposedamendments totheBremertonMunicipalCode (BMC) arelimitedtothefollowing sections: BMC20.02ProjectPermits, BMC20.46Special DevelopmentStandards, BMC20.58 Land UsePermits, BMC20.60Low DensityResidential (R-10), BMC20.78Medium Density Residential (R-18), andBMC20.79High Density Residential (R-40). STATEPERMIT REQUIREMENTS PerRCW36.70A.020, processing permitapplications inatimelyandfairmannerisoneofthe 15goals oftheGrowth ManagementAct (GMA). Accordingly, theCityComprehensivePlan contains policies supporting effective permit review, withbulleted examplesprovidedbelow. HousingElement, Policy H4(D). Encourage efficientpermit review byeliminating unnecessary regulatoryimpediments, improving certaintyin development regulations, and provide anexpeditedpermit process. EconomicDevelopment Element, Policy ED5(A). Evaluateandworktowards efficiencyand effectiveness ofall permit processes toensure requirementsandtimelines arepredictable. Encourage CityDepartments andStafftoprovidecondenseddevelopment guides to applicants thathelp identify coderequirements. WashingtonStatemore specificallyregulates localpermit processingpertheLocal Project ReviewAct (LPRA) whichwasestablished in 1995 asthestatewide framework forlocal government landuseplanningreview. LPRAwasrevised in2023perSenate Bill5290, and requiresjurisdictions to implementadditional measures intendedtoacceleratethepermit decision process. Bremerton generally regulatespermit processingper Bremerton Municipal Code (BMC) 20.02 ProjectPermits, whichestablishes permit timelines, noticing, andappeals procedures. PerSB 5290, BMC 20.02 ProjectPermitsisrequiredtobe updatedtoalterthe number ofdaystheCity hastoissueapermitdecision. Currently coderequirestheCity toissue a decisionwithin120days, which willtransition to thefollowing withthiscodeupdate: 65Days. Forproject permits thatdonotrequire public noticeunderRCW36.70B.110, a localgovernment must issuea finaldecisionwithin65days ofthe determination of completeness under RCW 36.70B.070. 100Days. Forproject permitsthatrequire publicnoticeunderRCW36.70B.110, alocal government mustissuea finaldecision within100 daysofthedetermination ofcompleteness underRCW36.70B.070. 170Days. For project permitsthatrequire publicnoticeunder RCW36.70B.110and apublic hearing, a localgovernment mustissueafinal decisionwithin 170daysofthe determination ofcompleteness underRCW36.70B.070. Per SB5290, permits notmeeting adopted permittimelines maybeentitled to apermit refundof 10-20% ofpermitfeesifthenewtime periods arenotmet. Toavoid negativeimpacts tothe budget, andincreased permitprocessing time, RCW36.70B.160allows analternative toissuing refunds that requiresthe Citytoadoptadditionalmeasures toincrease permitefficiency. The Page2 Docusign Envelope ID: F5C43DEB-C4AD-44BF-A1F8-515CD2E8983A MemoZoningCode Amendments following provides acomplete listofallState recognizedpermitprocesses meant toincrease efficiency, withthe Cityrequired tochooseaminimum of3ofthese options. Recommended forAdoption. Thefollowingthreemeasures areproposedforadoptiontomeet minimumStaterequirements. Unlikethe optionswhich werenotselected, that relateto administrative processes, each oftheselected options aredevelopment regulations: Presubmittal ApplicationConference (BMC 20.02.050). Currently, morecomplex permit typesarerequired to participateinaPresubmittal Conference. Theproposal wouldtransition this permittooptional. Public Hearings (Variouscodesections). Allpermits thatarenotrequired byState statuteto have apublic hearing would transitiontopermits thatareadministrativelyreviewed. Current City codeidentifies TypeIIIPermitsastypesthatrequire apublichearing; these would transition toTypeIIPermitswhich maintain a public comment period andappeal rightsfor any personprovidingcommentsduringtheassociatedpublic commentperiod. Itisimportant to note thatthe criteria for approving theseapplication types isnotproposedto changewith thiscode update, only minorchanges toensure conformance withSB5290. Thefollowing providesacompletelist ofapplicablepermits: Adaptive ReuseofCommercial Buildings BMC20.46.070), Mineral ResourceOverlay (BMC 20.46.080), Temporary Encampment Permit (BMC20.46.090), Wireless CommunicationFacilities (BMC20.46.140), Conditional Use Permits (BMC 20.58.020), Variance (BMC20.58.030), ResidentialClusterDevelopment BMC20.58.060), AffordableHousing Bonus (BMC20.58.100). Permitted Housing Uses (BMC 20.60, BMC 20.78, BMC 20.79). There areanumberof housingtypesthat currentlyrequireaConditionalUsePermit perBMC20.58.020; these housingtypeswould betransitioned to outrightpermitted uses whileretainingdevelopment regulations specifictotheir housingtype. IncludedareCottageHousing (BMC20.46.170), Group Residential ClassI (BMC 20.46.180), SeniorHousing Complex (BMC 20.46.190), and Manufactured HomePark (BMC 20.46.200). It isimportant to notethatthecriteria for approvingthese application typesis notproposedtochange with this code update, only minor changes topermitprocessingtoensure conformance withSB5290. Additional Measures. Below are othermeasurestheStateidentifies forincreasedpermit efficiency. Whiletheseadministrative measures are notrecommended foradoption atthistime, theDepartmentofCommunity Development willcontinue tointernally evaluate incorporation of thesemeasures inthefuture. Expedited ReviewProcess. TheStateencourages analternate expedited permit processbe available toapplicants. While thisoption may beimplemented, codificationofan expedited processisnotrecommended asstaffing levels, consultant availability, andothercontributing factors could potentiallylimittheCity’sabilityto meetanexpedited review timeline. ReasonableFees. The Staterecommends permitcost exclusivelycoverthe costs processing permitapplications, andthatthefeesimposedmaynotinclude afeefor thecost ofprocessing administrative appeals. While theCityofBremerton typicallyhastheleast expensive permitapplication feesinKitsapCounty, demonstrating tothe State that costsare reasonable” isasubjective andundefined processthatmay leadto additional/unneeded bureaucracy. Page3 Docusign Envelope ID: F5C43DEB-C4AD-44BF-A1F8-515CD2E8983A MemoZoningCode Amendments Interlocal Agreement. Entering intoaninterlocal agreementwithanother jurisdictionto share permitting staffandresources. Aninterlocalagreement maytakesignificant time tonegotiate and implement. Stafffromother jurisdictions wouldalso require significant amounts of training andoversight toensure conformance withBremerton coderequirements. On-callPermitAssistance. Budgetingforon-callpermitting assistanceforwhenpermit volumesorstaffing levelschange rapidly. Whilethisoptionisalsoavailable, Staff fromon- call agencies wouldalsorequiresignificant amounts oftrainingandoversight toensure conformance withBremerton code requirements. Potential lackofbudget couldalsoleadto notincludingthisprovision. NewBudgeted Positions. TheStateoffersanoptiontoaddnewbudgeted positionsthat are contingentonincreased permitrevenue. Onanannualbasis, theDepartment of Community Development analyzes the numberof employees needto complete submitted permits against theresources available tohirenewemployees. Asthisanalysis isupdated ona yearly basis, andcontingent onsufficientbudgetbeingavailable, it seems inappropriate to utilizethisprovision. Self-Certification.Thisoptionwouldpermitoutside professionals withappropriate professional licenses tocertify components ofapplications consistent with theirlicense. This may beanoptionfor theCityto consider inthefuture, however, appropriate research on best practicesandpotential negative consequenceswould needtobe exploredbefore furtherconsidering thischange. Applicant Meeting. Thisprocess encouragesthattheCityattempttoresolve outstanding issues during thereview process. A meetingmustbe scheduled within14daysof asecond request forcorrections duringpermitreview. Ifthemeetingcannot resolve theissues anda localgovernment proceedswithathirdrequest foradditional information or corrections, the localgovernment mustapprove ordenythe applicationuponreceivingtheadditional information orcorrections. Thisoption isgenerallyconsistentwithsuggested code revisions perBMC20.02.130(a)(1), however, theStatewouldalso requireto Citytoremove all application feesforappealsif thisoptionwas utilized. This mayleadtoanincrease in frivolousappealsthatwouldgreatly increasepermittimelines. ADDITIONAL MEASURES ThePlanning Commission proposesthefollowingadditionalpermitting measuresintended to increase permit efficiency: DesignReviewBoard. TheDesign Review processcurrently includes twopublic meetings, andadditionally theeventualBuilding Permit requiresanadditional publiccomment period andopportunity toappeal. Thiscreatesanunpredictablepermittingprocess, where a developer maynotknowiftheirprojectis feasibleuntil submittingtheBuilding Permit, which isoften thelast permitrequiredinalengthy process. Thisisthe onlypermit processthat currently requires a BuildingPermit to havea publiccommentperiodandincreasedrightsof appeal. The proposal istoremove thepubliccomment periodfrombuilding permits thathave received DesignReviewBoardapproval. Page4 Docusign Envelope ID: F5C43DEB-C4AD-44BF-A1F8-515CD2E8983A MemoZoningCode Amendments Applicant Response Time. Toincrease permitefficiency, proposedZoningCode Amendments wouldtransitionthestandard applicant response time. Existing code allows 90 daysforthe applicanttorespond toCityrequests foradditionalinformation, andthe proposedcode recommends revisingthattime limitto60days. Iftheapplicant either refuses inwritingordoesnotsubmittherequired information withinthetimelimits, applications wouldexpire. Informational Signage. While theStateisencouraging streamlining thepermitprocess, DCD staffhasreceived comments fromtheCityCouncilencouraging the useofinformational signsasa tooltoensure the publicstays informedonnewdevelopment occurringin their vicinity. Thesesignswouldcontaininformation about theproject, andcontact information for anyquestions, butwould not include aformalpubliccomment period. The intentofthese signswould beto raisepublic awareness, notincrease barriersto development by increasing permit requirements. SUMMARY To review, theCityisrequiredtoupdate permitting procedures tocomplywithnewrequirements fromthe StateofWashingtonperSB5290.
