COUNCIL MEETING Date: August 7, 2024
Department: Public Works & Utilities
Presenter: D. Dinkuhn
Phone: (360) 473-5331
SUMMARY:
The consultant had submitted the 90% PS&E package, and Operations staff were confirming field
conditions, when a previously unknown 18-inch outfall was uncovered. The second outfall will
provide sufficient capacity for the system and simplifies permitting for the project. However, use of
this second outfall necessitates a significant redesign of the project, redoing a wetlands report, and
additional survey. This modification will increase the project budget to include costs for the project
redesign, wetlands report, additional survey, and contract time. This additional design cost is offset
by an approximate $235,000 savings in construction costs from the original design.

Scope of Work
City of Bremerton 2331896189Francis Street Stormwater Treatment Retrofit 1 June 2024
Modification 1 City of Bremerton
Francis Street Stormwater Treatment Retrofit
Modification 1
Introduction
This document describes Parametrix’s proposed scope of work (SOW) for additional engineering
design under our current contract for the Francis Street Stormwater Treatment Project. Exhibit B
shows an updated schedule with anticipated construction occurring in 2025. Our proposed budget is
attached as Exhibit C.
The scope of work modification describes additional effort needed for changing the design concept
at the 90%. The new design removes the proposed outfall and alters conveyance to split flows
between the two existing outfalls.
Main Elements of this SOW Modification:
•Perform engineering analysis and design as required to complete the 100% and Bid Set design
submittals with the water quality treatment system in the Francis Street stormwaterconveyance system.•Prepare and update all plans, specifications, and estimates (PS&E).
•Propose a new schedule to accommodate the modified construction date.
General Project Assumptions
•The treatment system location (Stormfilter, CDS, and Stormgate) will not be modified from the
90% PS&E submitted on 04/04/24.
•Modeling to size the treatment system and for a backwater analysis has been performed under
management reserve budget, no additional modeling is required.
•Project management (Task 01) time will be added as part of this modification to accommodate
the updated project schedule.
•Permitting (Task 03) time will be added as part of this modification to update the permits per
the design changes.
•In April 2024, the city requested an updated 90% PS&E set that included the design change
to remove the proposed outfall and change the treatment layout. This redesign was an
additional iteration beyond the original scope of work, and this additional effort was expended
under Task 05 Final Design. This modification will add budget to Task 05 to complete the
100%, Draft Bid Set, and Final Bid Set PS&E packages.
•Survey (Task 06) time will be added as part of this modification to add Temporary Construction
Easement (TCE) Exhibits to the survey scope.
Specific tasks for this SOW modification are described below.

Washington. During my time I have co-sponsored multiple

Unauthorized Camping
ORDINANCE NO. 5496
AN ORDINANCE of the City Council of the City of
Bremerton, Washington, amending Chapter 9.32 of the Bremerton
Municipal Code entitled “Unauthorized Camping” and repealing
certain portions of Chapter 9.32 which require the City to suspend
enforcement of unauthorized camping when overnight shelter is not
available.
WHEREAS, in Martin v. Boise, 920 F. 3d 584 (9th Cir. 2019), the Ninth Circuit
Court of Appeals held that the Eighth Amendment to the United States Constitution prohibits
cities from enforcing ordinances criminalizing camping on all public property when there is no
available shelter; and
WHEREAS, in Johnson v. City of Grants Pass, United States Court of Appeals,
Ninth Circuit, Nos. 20-35752, 20-35881 decided September 28, 2022, amended July 5, 2023, the
Ninth Circuit Court of Appeals held that ordinances that operate to make it “nearly impossible”
to sleep outside with any form of bedding or shelter, or in a vehicle, on public lands violate the
Cruel and Unusual Punishment clause of the United States Constitution; and
WHEREAS, in City of Grants Pass v. Johnson, 601 U.S. ____ (2024), the
Supreme Court held that the Eighth Amendment’s Cruel and Unusual Punishment Clause does
not prohibit the enforcement of generally applicable laws regulating camping on public property
and reversed the Ninth Circuit’s prohibition on enforcement when no shelter space is available;
and
WHEREAS, the Supreme Court reasoned that public camping regulations are
used to provide local government employees with the legal authority to address encampments
that pose significant health and safety risks, to encourage their inhabitants to accept other
alternatives such as shelters, drug treatment programs, and mental health facilities, and to allow
local governments to focus on expending resources to help the homeless community while also
ensuring public spaces are safe and clean in a manner consistent with local needs; and
WHEREAS, despite City and regional efforts to provide housing, shelter, and
related services, illegal encampments continue to proliferate and result in large expenditures of
resources for many City departments, such as Law Enforcement, Fire & EMS, Public Works, and
Parks; and
WHEREAS, illegal encampments create numerous safety and health hazards for
all citizens of Bremerton, causing local businesses, community centers, shipyard employees,
property owners, and residents to bear the burden of the conditions brought about by the
encampments, and
BMC 9.32
Unauthorized Camping
WHEREAS, various resources for citizens around the city are disproportionately
impacted by unauthorized camping and the City’s paramount priority is to provide a safe
environment for those resources and the citizens utilizing them; and
WHEREAS, should there be no shelter space available due to closures, natural
disaster, overflow of persons seeking shelter, or any other variety of unforeseen circumstances,
the ability to keep peace and safety on public property would be greatly diminished as the City is
currently unable to enforce its unauthorized camping laws when no shelter space is available;
and
WHEREAS, illegal encampments have demonstrated a trend of abuse of illicit
drugs, resulting in multiple deaths, and it would be cruel for the City to allow these conditions to
exist once again; and
WHEREAS, the City recognizes the plight of unhoused persons and therefore has
engaged the services of Commonstreet, an organization specifically versed in helping unhoused
persons get the assistance they need to change their situation, and limiting Commonstreet to only
shelters within the City hinders their ability to assist unhoused persons obtain necessary
resources such as drug and behavioral counseling that does not exist locally; and
WHEREAS, the intent of this ordinance is to provide assistance to the unhoused
population without requiring the City to reach outside of long-held governmental provisions for
services, and public safety for residents, businesses and local employees transiting each day is
the paramount priority of the City; and
WHEREAS, pursuant to Article XI, Section 11 of the Washington Constitution
and RCW 35.22, and the Charter of the City of Bremerton, the City of Bremerton is authorized to
regulate public property; and
WHEREAS, the City Council desires to amend the provisions relating to
suspension of enforcement of unauthorized camping regulations when overnight shelter space is
not available in order to promote public health, safety, and welfare by preserving public use of
public spaces for which they are intended; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS:

Lori and City Council President, Vice President, and City Council Members,
I have attached the reports, and data discussed at the last council meeting relating to the
proposed ordinance change.
1. Commonstreet dashboard PDF includes outreach data starting in January, and not the prior
month (December 2023) we began to engage with them on outreach efforts.
2. Cartegraph Report (City system) contains all Commonstreet activities since December 2023.
This report does a good job of showing the amount of responses, amount of hours, and
averages for hours spent and days to closing a report.
Closed reports
a. Average Time- Number of City Locations
5.8 Days 308
Currently Open Reports
b. Average Time- Open to Close Number of City Locations
13 Days 19
3. A bed count sheet has also been attached showing the nightly count from 4/29/24 to 7/27/24
4. We have also attached encampment photos from various areas of the city, much of which
were from 2023.
Please reach out to me with any questions.
Thank You,
Captain Aaron D. W. Elton #403

Subject: RE: August 7 - Council Agenda Item 6B
As I am sure you can tell the dashboard is a quick look at Commonstreet activity and the
details you asked for in the 17 questions you present below will take more time to answer and
explain. I would suggest that Commonstreet and city departments who work directly with
them, often daily, attend a public safety committee meeting or a special council session to
give the more detailed answers you are looking for.
The beautiful thing is that Commonstreet documentation is stellar, and will answer your
questions.
I will provide quick responses for those questions I think can be succinctly answered below (in
red).
Here are some Commonstreet definitions of the following terms that might help;
Meaningful connection:
More than just an encounter on site and a "move along". We get some or all of a name,
perform needs assessment even if it's brief, pass along information for services, they are
receptive to a conversation even if they are not ready to begin working a plan, etc. A
conversation well received that assumes potential and a next step or action.
A Plan:
This comes out of a needs assessment when we make contact. Someone who is actively
engaged in a plan for resources and services. This is a tailored path and an average
number that changes week to week depending on who is still engaged and/or who got
successfully linked up with housing or other services.
Other Services & Resources:
Trisha can give you as much information as you'd like regarding other services. Quick
examples would be license, social security card, medical, dental, mental health, detox,
treatment, etc.
See answers in your original email below.
Thanks
Elton

Subject: Re: August 7 - Council Agenda Item 6B
Good afternoon, Capt. Elton.
When Commonstreet was proposed, one point that Council liked was the data they
could provide. We hoped, I think, that we'd get hard data on the size of the problem, the
causes of the problem, the effectiveness of given solutions, and how much time and
money was necessary to implement those solutions.
I, at least, have not been able to find that kind of data in the Commonstreet database
you provided. Some questions:
Where are the encampments?
All over the city, but primarily on the west side, and moreso central (think downtown
core area)
Where do encampments recur?
Several camps repopulate, one example is under the Hwy 3 and Kitsap Bridge, in the culvert
west of there, under the Mentor sign adjacent Hwy 3, the 800 block of MLK, and 8th Street, to
name a few common areas.
How many people are in each?
Various
How large are they?
Most are small (think, a tent or two, shopping cart or two, and maybe two to four people. That
is a general description of a small camp.
How are the meaningful connections linked to the various encampments and the site
visits?
Need more time with this, and Commonstreet would be best to answer this.
Who responded to each complaint re encampment? How many people responded?
Were BPD personnel involved?
Varies, Commonstreet has three regular staff who do the Bremerton services. Often
times CS responds alone. Sometimes public works, streets, facilities may assist them if
they need it. It is rare that BPD is at a site or response with CS. CS usually only calls
BPD if there is a safety concern, which is again, rare.
Why is the "Requester" field so often blank?
Many reports are received by the city through Bremerton1 app and this is not a required
field. Sometimes people choose not to add there info. Sometimes the entry is made by
a city employee who does not complete that portion of the form. The field is optional
because it is largely used by the public and for many other reasons than encampment
reports. It is this way for those who want to be anonymous.
When status is "Closed", does that mean the encampment is gone?
Generally, yes. Commonstreet may want to expand on this.
Are any arrests associated with any of the "Close Dates"?
I do not know if any of the 3 or 4 arrests made after November 2022 were associated with
any of those closed dates. I do not believe we have not made any arrests at sites CS has
requested us to.
Are any people connected to services more than once?
Yes, very frequently this is the case. CS documents all those efforts.
What are principal needs of people in encampments, so that the City can consider
addressing those needs.
This is probably best answered by CS. I can opine but they have been doing 99.9% of
these site visits on their own, and they can provide you with their own findings.
What are principal causes that led people to live in encampments?
Also, a nuanced answer that CS may be better equipped to answer.
How many have been referred to the legal system, e.g., received a citation, notified that
they have an outstanding warrant of some kind?
None that I know of because 99% of the time police are not with CS while doing
response and outreach.
How many have been arrested, and for what cause?
See above
There is a graphic in the Homelessness Response & Property Management sheet,
included in tonight's Council Packet, that states there are 18 "Average in a Plan Weekly".
What does this mean?

Subject:Ordinance to Amend Bremerton Municipal Code Chapter 9.32 Unauthorized Camping

CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless
you recognize the sender and know the content is safe.
Greeting Members of the City Council;
I am Zita Bennett and I have been a resident and homeowner in Bremerton for many years.
Last night I watched the BCC July 24, 2024 meeting online and I am writing to support Police
Chief Tom Wolfe and Mayor Wheeler on the recommendation to scratch the shelter
requirement phrase on the Bremerton Municipal Code on unauthorized camping, Chapter
9.32.
Chief Wolfe made it very clear that in our effort to help the homeless situation on our
Bremerton streets that we need "compassion with accountability." He has learned from the
experience of 2023 that compassion without accountability resulted in the loss of lives and
took a great toll on our officers, paramedics and citizens. And the problem of "Criminal
Vagrancy" was also mentioned by Mayor Wheeler. It is understood that the Bremerton Police
Chief is a respectable person who understands what true compassion is. It is also understood
that nobody on the City Council wants to return to the situation we had in 2023. Chief Wolfe
needs the support of our Mayor and City Council to do his job effectively.
I want to say that what made the most sense to me as a listener were the things said by Chief
Wolfe, Tricia from Common Street, and Eric Younger. It was made known that two shelter
options are going on. Shelters will be built. And a Day Center is in the works, too. Tricia
(Common Street) made it clear that they are going to continue doing their job no matter if
there is a shelter requirement or not. And the same is true for other community partners as
well. Eric Younger's words giving support for the recommendation of Police Chief Wolfe were
powerful and made sense. They made more sense that the expressed concern, a what if there
is a "shelter vs. shelter" problem. I cannot make it any more clear what has already been said
at the meeting. Therefore I am asking the City Council to trust the advice of their respected
Police Chief and Community partners and do what is best for all. "Scratch the shelter
requirement" from the Ordinance on unauthorized camping.
Thank you for listening.
Sincerely,
Zita Bennett

2024 Kitsap Lake Management
Bremerton treats Kitsap Lake twice a year for
phosphorus to manage water quality and control
algae blooms within the lake. Once per year aquatic
plants are harvested from the lake to minimize
aquatic weeds and manage the lake plant
populations.
These treatments have been occurring since 2020
and have resulted in a cleaner lake that is open to
recreation year-round. Managing Kitsap Lake
optimizes water quality in the watershed and
promotes more natural lake and watershed
functions.
For 2024:
•The first Eutrosorb-G phosphorus treatment
occurred in May
•Aquatic weed harvesting will begin in August,
starting this week.
•The second Eutrosorb-G treatment is scheduled
to follow the aquatic weed harvest in the middle
of August
