RESOLUTION NO. 3384
A RESOLUTION of the City Council of the City of
Bremerton, Washington, on the subject of repealing Resolution No.
3345 and establishing a Small Public Works Roster process to award
public works contracts and a consulting services roster for
architectural, engineering and other professional services.
WHEREAS, RCW 39.04.155 and other laws regarding contracting for public
works by municipalities, will expire on July 1, 2024 and will be replaced by RCW 39.04.151 and
RCW 39.04.152, and other laws which will allow certain contracts to be awarded by a Small
Works Roster process; and
WHEREAS, in order to be able to implement the Small Works Roster processes,
the City is required to adopt a resolution establishing specific procedures; and
WHEREAS, RCW 39.80.030 requires that an agency publish in advance that
agency’s requirement for professional services and that one of the ways to accomplish that
notification is to announce generally to the public its projected requirements for any category or
type of professional services and request qualification statements to be kept on file with the
agency; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF BREMERTON, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Resolution No. 3345 is hereby repealed and replaced with this
Resolution.
SECTION 2. MRSC Rosters. The City currently contracts with the Municipal
Research and Services Center of Washington (MRSC) to adopt for City use of those statewide
electronic databases for small public works roster, consulting services and supplier roster
services developed and maintained by MRSC. In addition, paper and/or electronic rosters may
be kept on file by appropriate City departments. The City hereby elects to use the statewide
small works roster established under RCW 39.04.151(2) and administered by the MRSC.
SECTION 3. Small Public Works Roster. The following Small Works Roster
procedures are established for use by the City pursuant to RCW 39.04.151 and RCW 39.04.152:
1. Cost. The City need not comply with formal sealed bidding procedures for the
construction, building, renovation, remodeling, alteration, repair, or improvement
of real property where the estimated cost does not exceed the limits as set forth in
RCW 39.04.152, as currently enacted and hereafter amended, which includes the
costs of labor, material, equipment and sales and/or use taxes as applicable.
Instead, the City may use the Small Public Works Roster procedures for public
works projects as set forth in RCW 39.04.151-152. The breaking of any project
Page 2 of 4
Resolution
Rev. 10/2019
into units or accomplishing any projects by phases is prohibited if it is done for
the purpose of avoiding the maximum dollar amount of a contract that may be let
using the Small Works Roster process.
2. Publication. At least twice a year, on behalf of the City, MRSC shall publish in a
newspaper of general circulation within the jurisdiction a notice of the existence
of the roster or rosters and solicit the names of contractors for such roster.
Responsible contractors shall be added to appropriate MRSC Roster(s) at any
time that they submit a written request and necessary records. The City may
require master contracts to be signed that become effective when a specific award
is made using a Small Works Roster.
3. Telephone, Electronic or Written Quotations. The City shall obtain
telephone, written or electronic quotations for public works contracts from
contractors on the appropriate Small Works Roster to assure that a competitive
price is established and to award contracts to a contractor who meets the
mandatory bidder responsibility criteria in RCW 39.04.350(1) and may
establish supplementary bidder criteria under RCW 39.04.350(2).
a. A contract awarded from a Small Works Roster need not be advertised.
Invitations for quotations shall include an estimate of the scope and nature of
the work to be performed as well as materials and equipment to be furnished.
However, detailed plans and specifications need not be included in the
invitation.
b. Quotations may be invited from all appropriate contractors and vendors on
the appropriate Small Works Roster Category. All requirements to invite and
notify vendors on the small works roster as set forth in RCW 39.04.152 as
currently enacted and hereafter amended shall be followed. The City has the
sole option of determining whether notification to the appropriate amount of
remaining contractors is made by:
i. Publishing notice in a legal newspaper in general circulation in the area
where the work is to be done;
ii. Mailing a written notice to these contractors; or
iii. Sending a written notice to these contractors by electronic method,
facsimile or email.
c. City representatives shall not inform any contractor of the terms or amount of
any other bids for the same project until the project has been officially
awarded.
d. A written record shall be made by the City representative of each contractor’s
bid on the project and of any conditions imposed on the bid. Immediately after
an award is made, the bid quotations obtained shall be recorded, open to
public inspection, and available by telephone inquiry.
Resolution
Rev. 10/2019
4. Award. All of the bids or quotations shall be collected by the Department
Director or his designee. Awarding and modification of the public works contracts
shall follow the limits and approval procedures set forth in BMC 2.76.100 and
BMC 2.76.110.
SECTION 3. Services and Supplier Rosters
1. Services. Consulting services are professional services that have a primarily
intellectual output or product and include architectural and engineering services
as defined in RCW 39.80.020. Architectural and Engineering, Consulting
Services, Purchased and Personal Services may utilize Contract awards via the
MRSC Roster and publication services in accordance with the processes outlined
in BMC 2.76.
2. Goods and Supplier Roster. Goods and Supply vendors are included in the
MRSC Roster services and may utilize Contract awards via the MRSC Roster
and in accordance the processes as outlined in with BMC 2.76, RCW 39.04.190
and RCW 57.08.050.
3. Publication. At least twice a year, on behalf of the City, MRSC shall publish in a
newspaper of general circulation within the jurisdiction a notice of the existence
of the consulting services roster or rosters and solicit statements of qualifications
from firms providing consulting services. Such advertisements will include
information on how to find the address and telephone number of a representative
of the City who can provide further details as to the City’s projected needs for
consulting services. Firms or persons providing consulting services shall be added
to appropriate MRSC roster or rosters at any time that they submit a written
request and necessary records. The City may require master contracts to be signed
that become effective when a specific award is made using a consulting services
roster.
Professional Architectural and Engineering Services. The MRSC Rosters will
distinguish between professional architectural and engineering services as defined
in RCW 39.80.020 and other consulting services and will announce generally to
the public the City’s projected requirements for any category or type of
professional or other consulting services. The City reserves the right to publish an
announcement on each occasion when professional services or other consulting
services are required by the agency and to use paper and/or other electronic
rosters that may be kept on file by appropriate City departments.
SECTION 4. Severability. If any one or more sections, subsections, or
sentences of this Resolution are held to be unconstitutional or invalid, such decision shall not
affect the validity of the remaining portion of this Resolution and the same shall remain in full
force and effect.
SECTION 5. Effective Date. This Resolution shall take effect and be in force
immediately upon its passage.

Re: Utility Easement Relinquishment – Sinclair Ridge Phase 1
Request: Relinquishment of the Water Easement recorded under AFN 200209190155 to the City
of Bremerton from the grantor – Northwest Corporate Campus, LLC in September 2002. The
property was subsequently sold to Century Communities who initiated the Sinclair Ridge
Development. The Sinclair Ridge development provided a revised location for water utilities
within the subdivision. The water main installed is in the Right -of-Way that has been dedicated
to the City with the final subdivision. The easement was originally intended to provide a corridor
for a water transmission main that was constructed on a different alignment in Anderson Hill
Road. The easement recorded in 2002 is no longer needed and will not be utilized by the City
(see Exhibit 1 Site Map).
City Council’s Decision: in accordance with the Revised Code of Washington (RCW) 35.94.040 ,
the release request must be determined by a resolution of the legislative authority after a public
hearing. Therefore, the relinquishment requires the approval and adoption of resolution by the
City Council.
