AGENDA BILL CITY OF BREMERTON CITY COUNCIL SUBJECT: Study Session Date: March 27, 2024 Street Lighting Conservation Grant Agreement with Puget Sound Energy for LED Retrofit Phase 1 COUNCIL MEETING Date: April 3, 2024 Department: Public Works Presenter: G. Akramoff Phone: (360) 473-5333 SUMMARY: In 2022 Puget Sound Energy (PSE) and the City of Bremerton entered into an agreement for PSE to convert streetlights to LED lighting for the entire City. The project was broken into fifteen phases and originally planned to take up to fifteen years to complete. Due to a change in the Tariff agreement with PSE the costs have dramatically reduced. This grant agreement is for Phase one which was completed in late 2023. The invoice from PSE for the project in phase one was $15,023.47. The grant will pay $11,725 for a net cost to the City of $3,298.53 for 84 lights or a cost of $39.27 per light, which is much less than the assumed cost of $143/light. Due to the reduced cost per light the payback timeline is reduced significantly as presented in the attached program cost summary. Phases two, three and four are expected to be completed in 2024. ATTACHMENTS: Street Lighting Conservation Grant Agreement #1 Project P1408177 Project Phase Spreadsheet Project Map FISCAL IMPACTS (Include Budgeted Amount): City of Bremerton funded amount is $70,000 per year from the Trans Cap funds that have been set aside for the project. Burris Date: 2022.08.03 12:12:53 -07'00' BMC 2.76.090 allows for the Public Works and Utilities Director to determine that requests for bids may be waived when equipment involves special facilities or services, and a bid would not be in the City’s best interests but rather a purchase may be best established by direct negotiation. A power outage caused by extreme weather such as wind and ice and other circumstances is the most common emergency faced by the Bremerton drinking water and wastewater treatment systems. It is critical that these systems continue to provide service, particularly in emergencies. Highly dependable backup power supplies are critical. The Water Utility developed an emergency power plan to identify critical facilities in need of on -site backup power to ensure a reliable supply of water during emergencies. In the 1990’s, the utility purchased generators from multiple manufacturers, first Generac, then Kohler. However, since 2000, the utility switched to Cummins (Onan) generators, due to their superior performance and dependability. The utility has eight (8) backup generators installed so far and intends to install approximately eight (8) more to complete emergency power plan implementation by 2024. The Wastewater Utility currently has 23 stationary emergency generators and three portable units. The newer units are Cummins, with the remainder being a mix of Kohler, Cummins, Caterpillar, Olympian, etc. The wastewater utility plans to install another six (6) generators over the next six years. Reason for standardizing to Cummins generators: Generator manufacturers use proprietary software to interface with generator controls in order to troubleshoot, repair and perform maintenance. If the Water Utility and WWTP must utilize the bid process and accept lowest bid, this may result in multiple brands of generators requiring multiple service contracts to conduct annual testing and maintenance and on -call troubleshooting. This would result in disparate testing and maintenance schedules, higher costs and less than ideal dependability and customer service, particularly if needed during an emergency. Reason for standardizing to Cummins generator services: Cummins is the only provider of testing, maintenance, and on -call troubleshooting services that is able to service all of the Water and Wastewater Utility’s generators, including the Generac and Kohler. As such, the City has a long history of working with Cummins who has proven itself to be highly dependable and a superior customer service entity. Further, standardization on Cummins generator services results in reduced costs as we are purchasing “in bulk” and all annual maintenance is accomplished at the same time, causing less disruption of work and redirection of staff resources. For the reasons above we recommend standardization of both Cummins generators and Cummins generator services for Bremerton’s drinking water and wastewater utilities. Knuckey/S. Weber Phone: X2376/x2354 SUMMARY: On August 2, 2023, the City Council approved Resolution 3363 which adopted Alternative X as the Preferred Alternative for Design of Multimodal Improvements for the Warren Avenue Bridge. Alternative X includes a 12-ft clear width Shared Use Path on the east side of the bridge, and an 8-ft (minimum) shared use path on the west side of the bridge. In October 2023, WSDOT completed field testing of the bridge to determine the capabilities of their under-bridge inspection trucks (UBIT) to define inspection requirements. The results of their analysis was provided to the City’s consultant who prepared the March 2024 update to the Warren Avenue Bridge Pedestrian Improvements memorandum which is available from the project webpage https://www.warrenavebridgeproject.com/. This memorandum established a cost estimate for Alternative X and identified that the cost of this alternative exceeds available grant funds for the project. Given concerns regarding the fiscal status of the project, Director’s Knuckey and Riley jointly signed the attached letter outlining their concerns with moving forward an alternative that exceeds available budget. Note that this letter includes the handout from the March 13, 2024, Study Session that outlines the budget status of all alternatives that are included in the March 2024 update memorandum. At its April 17, 2024 City Council meeting, staff will present alternate Resolutions for Council’s consideration; a resolution reaffirming Alternative X as the Preferred Alternative which acknowledges it’s over-budget status, and two alternative resolutions establishing a new Preferred Alternative which is within budget; either Alternative 1 which has 8-ft walkways with two bump-outs on both sides of the bridge, or Alternative 7 which has a 12-ft shared use path on the east side of the bridge and a 5-ft walkway on the west side of the bridge. The purpose of this Agenda item is to obtain public input on the Preferred Alternative. March 26, 2024 Bremerton City Council 345 6th Street Bremerton, WA 98837 Subject: Warren Avenue Bridge Multimodal Project – Preferred Alternative Dear City Council: As presented in the March 2024 update to the Warren Avenue Bridge Pedestrian Improvements memorandum which is available on the project website (https://www.warrenavebridgeproject.com/documents), given direction from WSDOT from their field testing, the estimated cost of the Preferred Alternative (Alternative X) now exceeds the project budget. As discussed at the March 13th City Council Study Session, we have grave concerns with moving this project forward where estimated costs exceed our budget and have outlined these concerns below for Council’s consideration. The State legislature has authorized $27M to the City’s bridge project, and $500K of this is design funding that is unsecured as it is contingent on failure of Initiative 2117 that State voters will consider this fall. Due to its unsecured nature, those funds are not included in the project budget, and so the budget is $26.5M; with $1.5M for design and permitting, and $25M for construction. Note that in addition to developing the cost estimate for Alternative X, the March 2024 memorandum additionally updated the feasibility evaluation and cost estimates for the other improvement alternatives. From that effort, only two alternatives to improve pedestrian accessibility on the bridge are within the existing budget. These alternatives, along with Alternative X and another alternative that passed the feasibility screening were presented in a document that was included in the March 13th Council packet and attached to this letter. This document presents the difference between secured funding and estimated project costs for all alternatives. In considering this information, please note that while the bridge itself is a WSDOT-owned structure, the City will be responsible for all cost over-runs on our pedestrian improvement project. ________________________________________________________________________________ Public Works & Utilities Ň Oyster Bay Ave. N., Bremerton, WA * Phone ( - * Fax ( - Working for and with our residents to establish Bremerton as Puget Sound’s most beautiful and livable waterfront city! The total amount of secured funding is $26.5M; $1.5M for design and $25M for construction. Note that there is $500K in Climate Commitment Act (CCA) Funds secured for the project in the Legislature’s 2023-2025 Budget. However, the CCA is at risk of being repealed by Initiative 2117 this fall. If the CCA is not repealed, this funding would be available in January 2025. ______________________________________________________________________________ CITY COUNCIL 345 6th Street, Suite 100, Bremerton, WA 98337  Phone (360) 473-5280 I am Jennifer Chamberlin, Bremerton City Council President. I have written this letter to help provide context for the physical packet we are providing to the public today and to make a special ask of those of you who are here for Public Comment. Today we are opening up more public comment under Item 6A regarding the Warren Ave Bridge Multimodal Improvements Project Preferred Alternative. Attached you will find these documents that will help inform public comment: • Cover letter prepared by the Council President • Agenda Bill prepared by Public Works • Letter written to Bremerton City Council from Directors of Public Works Tom Knuckey and Director Mike Riley • Addendum of Alternatives prepared by Managing Engineer Shane Weber • An FAQ prepared by Councilor Jeff Coughlin with feedback from Director Knuckey incorporated • An email exchange between Director Knuckey and Councilor Coughlin re: catwalks On August 2, 2023 Bremerton City Council voted 4-2 (1 abstention) for “Alternative X” that allowed for construction of a 12-foot eastside and 8-foot westside sidewalks. This vote in support of Alternative X was made after a wide showing of public support. I want to in particular thank the West Sound Cycling Club and members of the Facebook group “StreetSmart Bremerton - SSB” for their efforts. At the close of this year’s legislative session we received the phenomenal news that the state has prioritized our bridge project for the next two fiscal biennia to the tune of approximately 27 million ($500k is contingent on voter retention of the Climate Commitment Act). Alternative X is projected to cost just over $30.2 million to design and construct. This means we have a budget shortfall of a little over $3.2 million dollars to see Alternative X to fruition. In the letter from Directors Knuckey and Riley you will find bulleted concerns regarding the budget shortfall. Councilor Coughlin, Public Works Chair Jane Rebelowski and others have reached out to our state legislators to request communication with WSDOT to examine way to lower project cost or other methods to implement the preferred alternative. The attached FAQ per Councilor Coughlin. It is my understanding that conversations at the top level are happening but there is no update yet on how those are going. During the March 19 Public Works Committee meeting an agreement of April 17th was made as a hard deadline to consider alternatives for bridge design that fall within budget and/or to receive support from WSDOT to lower City of Bremerton cost burden. Here’s where we are, folks; We need to consider a back-up plan. We are receiving public comment on alternatives for the next two city council meetings. The goal of public comment today is to eliminate either an 8’x8’ (Alternative 1) or 12’x5’ (Alternative 7) option as a back-up alternative. These alternatives are outlined in the attachment from Shane Weber. Both of these are within our budget and any shortfall is easily mitigated. What we need from you is to provide feedback on which alternative you don’t like so we can eliminate it for consideration. As fiduciary agents of the City of Bremerton it is our responsibility to act with care and logic on behalf of taxpayers. It is also our job to fight for the will of our citizens and work within the confines of our powers to support efforts to bring programs and resources that improve the quality of life for Bremertonians. While we are still fighting hard for a 12’x8’ foot option we want to know what the next best alternative is. Thank you for your love for Bremerton, advocacy for an option that provides for a more walkable/bikeable lifestyle and assertion that we “deserve nice things”. Three new catwalks, spanning the entire 606 foot span, is 3*606*$770 = $1.4 million. If WSDOT were to realign their requirements with their physical justification, only 3*200*$770 = $462k is needed, a reduction of ~$1 million. In addition, contradictory information is given for the justification of the center catwalk, and if it is not truly needed, c ost is even further reduced. And potential compounding cost savings from not needing to compensate for the added weight of so much additional catwalk. With all information presently available to me, I believe the "on the order of $1 million" is as well justified as the $2 million for the UBIT cost. WSDOT has the final say on both, but both still have possible avenues of change at the moment. If you need to attach a separate response or addendum for this item though, I understand. I appreciate all the other mutual understanding achieved on the many other items. ** SCJ lists a unit price of $220 per square foot (SF) for new catwalk, with a total SF of 2,121 for the whole 606 foot span. $220*2122/606 = $770 per linear foot. I’ve not had any conversations or seen anything from the Consultant PM, City PM or WSDOT that would quantify potential cost reductions related to the catwalks. It’s very fair to say that the estimated construction cost could reduce as the project design moves forward, but I have no basis to support a dollar figure, particularly since WSDOT will have final say on this issue. I propose striking the words “on the order of $1 million” from that bullet. Warren Avenue Bridge Multimodal Project FAQ April 3,2024 What is the history of this project? ●February 2019:City submitted an application to Senator Hobbs for $1.5M in grant funding to design the bridge multimodal improvements. ●September 2019:The City accepts a $1.5M grant from the State for engineering and permitting of pedestrian and bicycle improvements on the Warren Bridge, deck resurfacing, and multimodal improvements to the north and south. ●April 7,2021:The City approves a contract with WSDOT to widen one or both sides of the bridge to obtain a desirable shared-use path width of 12 feet in accordance with WSDOT design standards. At this time,WSDOT has several standard bridge inspection trucks to perform a biennial inspection and it is known that an enhanced version of the inspection truck will be needed to inspect a 12 foot path. ●August 4,2021:The City approves a $256k contract with SCJ Alliance (later amended several times)to study many alternative configurations, including those that only widen one side of the bridge. ●Spring 2022:The State awards $25M for construction of the project. ●December 2022:WSDOT procures a new standard model bridge inspection truck,in lieu of the enhanced version, after being requested by a project stakeholder to purchase the enhanced model. ●May 2023:WSDOT notifies the city for the first time that they will not allow alternatives that do not improve both sides of the bridge. ●August 2,2023:The City selects a preferred alternative of 12’on the East side and 8’on the West side with overlooks after hearing from over 500 people via public survey and comment. ●October 2023:WSDOT performs the first live test of its standard inspection truck on the bridge with a simulated widened path. ●February 2024:WSDOT notifies the city that they learned from their live test that there are existing catwalks under the bridge that do not allow inspectors to reach all fracture critical members as required for inspection. The structural engineer has determined that the least cost approach to address this issue is to fabricate new catwalks off-site and replace the existing catwalks, rather than modify the existing catwalks under the bridge.WSDOT advises this work is required along the entire length of the steel span of the bridge. As well,WSDOT requires the cost to purchase and operate the enhanced bridge inspection truck to come out of the project budget. ●March 2024:The State provides an extra $500k for design —contingent on the non-repeal of the Climate Commitment Act (CCA)in Fall 2024 —and re-allocates the construction funds with $15M of the $25M available in 2025–2027,and the remaining $10M available in the 2027–2029.A 75-page memo is provided to the City by SCJ Alliance documenting current project costs taking into account WSDOT’s new requirements from the month prior. What is the current status of the project? ●The preferred alternative has a total cost of $30,200,328.42 compared to an available budget of $27.0 million (noting that $500k of this budget is only available if the CCA is not repealed in Fall 2024.)This means the project is over-budget by ~$3.2 million or ~$3.7 million if the CCA is repealed in the Fall. Specifically this is a shortfall of $300k for design (or $800k if CCA is repealed),and a shortfall of ~$2.9M for construction. ●The current schedule is to begin engineering as soon as possible, with construction in 2027–2028. Delays in starting design and permitting will result in delays in starting construction which will increase project costs due to inflation. What is the breakdown in cost of the preferred alternative? ●The breakdown of the $30,200,328.42 million (M)is as follows, sorted from most expensive to least: $17.2M -Construction costs (not including catwalks). $4.1M -Contingency funds. $2.8M -Management and Inspection costs. $2.3M -Engineering and Permitting. $2.0M -Purchase of enhanced bridge inspection truck and two years of operations costs. $1.8M -Removal of existing catwalks and installation of new catwalks. What are contingency funds? ●Costs used to cover potential events or changes that are not specifically accounted for in a preliminary cost estimate. The contingency costs for this project are estimated by assuming 25%of construction costs. Can the city choose to proceed with the preferred alternative under the current circumstances? ●Yes,the city could proceed, with the hope that current cost estimates are accurate, and no unforeseen events or changes occur, and thus no contingency funds are actually needed. However, this is not recommended since the City will be on the hook if there is any shortfall in funds. If a significant amount of the contingency funds are needed, the City does not have ~$3 million available, and it is very unlikely that the State would cover a shortfall. ●The City could attempt to secure additional state grants while proceeding, but there is no guarantee of success in receiving them, and they would not be available to fund other needed city projects, including those to build connectors to the bridge, which are not included in the current preferred alternative. ●Debt borrowing to make up a budget shortfall on this project is not recommended for this project since the Warren Avenue Bridge is not owned by the City. ●Proceeding while over-budget and/or with a significantly under-funded contingency puts the project under increased scrutiny and chance of being delayed or canceled by the State in the event of future State funding shortfalls. Are there ways to reduce the cost of the project with the current preferred alternative? ●The cost could be reduced by up to $2 million if WSDOT would agree to purchase an enhanced bridge inspection truck and incorporate it into its fleet for use on other bridges, not requiring the project to pay for purchase and operations. ○The potential to rent an enhanced inspection truck has been discussed with WSDOT,but they rejected this option given concerns over safety, and the possible need for emergency inspections. ●WSDOT has stated,in an email from Structural Design Unit Supervisor Richard Zeldenrust,“Wider sidewalks installed on both sides of the bridge will require a deck centerline catwalk, full length of the steel spans. For estimating purposes,I think that widened catwalks should also be assumed along the inside faces of both steel girders, for the full length of the steel spans.”This requirement to have catwalks along the entire steel span has not been well justified, and a more thorough examination could result in significantly less catwalk required, and thus lower costs,on the order of ~$1 million. What is the current preferred alternative and what are the other options? ●The current preferred alternative approved by the City on Aug.2,2023,“Alt X”,widens the East side to 12 feet and the West side to 8 feet with overlooks. The other options within budget recently studied: ○“Alt 7”:Widen the East side to 12 feet and the West side to 5 feet at a cost of $24.8 million. ○“Alt 1”:Widen both sides to 8 feet at a cost of $26.0 million. ●Widening only the East side to 12 feet, and leaving the West side as-is,would cost ~$21 million, but is not currently allowed by WSDOT,citing ADA requirements. What happens if there is money left over? ●Unspent funds could go towards a prioritized list of connectors to the bridge. Some connectors studied during the project include a path through Roto Vista Park,a tunnel under the south end of the bridge, and a NE connection to Juniper and Lebo, but exact prioritization would be determined by the City in the future. Published for April 3 Council Meeting ITEM 6A – Public Comments To the City Council, Testimony for Public Recognition, April 3, 2024 My name is Charlie Michel. I am a retired Professional Engineer formerly licensed in the State of Alaska, now living in Bremerton. Regarding the Warren Avenue Bridge active transportation design and cost estimate, I have these comments.  A 25% cost contingency seems very high. The bridge has been studied quite a bit already. I contrast that with my former company developing oil fields where we carried a 10-15% contingency. We know far more about a bridge that we can see with our own eyes, than an oil reservoir two miles in the ground. Closer to home, the Poulsbo roundabout and tunnel project carried a 10% contingency. After looking around, it appears WSDOT’s normal contingency on projects is 4%.  WSDOT requiring us to pay so much for an A62T is egregious. There will be more state bridges where it can be used. Oregon DOT has an A62T and likes it. At most, we might pay the difference for an A-62. If WSDOT continues to be unreasonable, we should instead rent an A62T from the firm in Springfield, Oregon when inspections are needed.  I believe the Public Works Committee should meet with WSDOT in person to review the estimate and negotiate over items like the UBIT. We should challenge them on their inherent inconsistencies in their own analyses.  The eight and eight shared use path option should knocked on the head and eliminated. It is unsafe for everyone. Cyclists moving southbound will have some speed due to the incline, and 12 ft is a minimum safe width. I’ve experienced this myself on the 10’ wide I-90 bridge, and contrast this with the 14’ wide 520 bridges. Most cyclists will be encouraged to use the east side on our bridge. Let’s work this through and get around the table, in person, with WSDOT, where we can show them inconsistencies within their own documents on things like the catwalk that are artificially escalating costs.
