MEMORANDUM
DATE: August 13, 2021
TO: Project File FROM: Andrea Archer-Parsons, P.E., Engineering Project Manager SUBJECT: Kitsap Way (SR 310) and Warren Ave (SR 303) Traffic Signal and
Multimodal Safety Project City Project No. 315023 Fed. Aid No. HSIP-000S(525) On July 21, 2021, City Council approved to award a contract to ACI, Inc. for construction
of the above referenced project. The award consisted of a Base Bid plus Alternative 1
with a total cost of $2,488,573.00. This award, as described in the agenda bill, was contingent on WSDOT’s concurrence to award the project, which is a requirement of accepting federal funding per the Local Agency Guidelines Manual (LAG).
After Council award, the City submitted to WSDOT a request for concurrence to award
the project. The request was for base Bid plus Alternative 1, as approved by City Council. WSDOT responded back and informed the City that they would concur with base bid only since this was the scope of the project subject to federal aid approval and requested the City award to base bid and execute a change order to add Alternative 1 into the contract.
Staff reached out to Legal for a verification that WSDOT’s course of action was consistent with Council’s award of the Contract. The City Attorney verified that the proposal from WSDOT was in line with the award by Council and that staff can move forward with WSDOT’s requirement to award base bid and add alternative 1 as a change order.
The second issue that came up with the WSDOT proposal is what would be the award amount used to determine the Mayor’s change order authority as per BMC 2.76.110(a)(4). Specifically, should the Mayor’s Change Order authority be based on the award of the base bid or the base bid plus alternative 1. The City Attorney’s opinion was that the
amount awarded by Council at the July 21, 2021 Council Meeting for Base Bid plus Alternate 1 was the amount that should be used to determine the Mayor’s change order authority. The amount to use for awarded amount would then be $2,488,573.00 for base bid plus alternative 1.
