MEMORANDUM
DATE: October 20, 2021
TO: 6th Street Pavement Preservation Phase 2 File
FROM: Chris Dimmitt, P.E., Project Manager
SUBJECT: 6th Street ¾” Water Service materials and installation and 2” water
service tap - Change Order #001
In September, Miles Resources Inc. brought several issues to the City’s attention through
a letter of protest. The issues brought forward that are being resolved with Change Order
#001 are: 6th Street ¾” Water Service materials and installation and 2” water service tap.
On September 20, 2021, Miles Resources notified the City of contradictions in the project
plans and documents via letter of protest. Had virtual meeting on September 22, 2021
with Bryson Dunlap and Shane Weber to discuss the merits of the protest. After
discussing the issue and order of precedence, the City agreed with the contractor that a
contradiction of the project documents existed.
On September 22, 2021 Chris Dimmitt verbally directed the contractor to procure the
necessary materials as listed in the COB Standard Plan 5001 and 5003. Contractor is to
provide proposed costs for additional materials and work.
On September 27, 2021, City formally responded to Miles Resources letter of protest
indicating that a change order would be processed to resolve the discrepancy.
On October 6th, 2021, Consultant Designer and Project Engineer preformed independent
cost estimate.
On October 13th, 2021, City received pricing from Miles Resources for additional materials
and work.
On October 14th, 2021, Chris Dimmitt and Bryson Dunlap negotiated on cost and amount
of contract days for additional work. City agreed to cost proposal but not to any additional
traffic control costs as traffic control would be necessary regardless of party to perform
service connections.
