PROJECT: Oyster Bay Beach Sewer Upgrades CONSULTANT: Parametrix, Inc. DATE: April 5, 2022 THIS CONTRACT MODIFICATION AGREEMENT SPECIFICALLY AMENDS THE Oyster Bay Beach Sewer Upgrades AGREEMENT (the "Contract") entered into between the City of Bremerton and Parametrix, Inc. on August 13, 2019). All provisions in the Contract shall remain in full force and effect except as expressly modified by this document. For valuable consideration and by mutual consent of the parties, the modifications to the Contract are as follows: I. Section I. Scope , is modified as follows: See Amendment 4 Scope of Work attached as Exhibit A. Section II. Term , is modified as follows: The term of the contract is not changed. Section III. Compensation , is modified as follows: The original contract amount was $437,006. Contract Modification No. 1 increased the contract amount by $164,490.96, resulting in an amended contract amount of $601,496.96. Contract Modification No. 2 increased the contract amount by $71,210, resulting in a revised contract amount of $672,706.96. Contract Modification No. 3 increased the contract amount by $49,711.71, resulting in a revised contract amount of $722,418.67. This current Contract Modification No. 4 increases the contract amount by $22,862.90, resulting in a revised contract amount of $745,281.57. Exhibit B shows the increased fees for the respective tasks. II. Consultant accepts all requirements of this Contract Modification by endorsing below. Consultant further agrees that this Contract Modification constitutes full and final settlement of all of the Consultant’s claims for contract time and for all costs of any kind, including without limitation, costs of delays related to any work either covered or affected by this Contract Modification, claims related to on-site or home office overhead, or lost profits. This Contract Modification does not limit the City’s right to bring a claim for past performance. This document will become a supplement of the contract and all provisions will apply hereto. It is understood that this Contract Modification shall be effective when approved by the City of Bremerton. The parties whose names appear below warrant that they are authorized to enter into a contract modification that is binding on the parties of this contract. In addition, Consultant warrants that it has or will inform the surety of this change, and shall take appropriate action to modify any bonds required under the contract to address this change. The overall goal of the project is to reduce the fecal coliform bacteria pollution and other pollution associated with sewage in Oyster Bay by moving the wastewater collection system out of marine waters and into an upland system. This project is funded by an SRF loan for $3,800,000 from the Department of Ecology that expires on December 31, 2022. The City is anticipated to receive additional funding from Department of Ecology once bids are received. This amendment is a supplement to existing Task 8, Services During Construction. The scope of work (SOW) includes services to be executed during the construction phase of this project and outlines additional task objectives, activities, assumptions, and exclusions. The complete project SOW includes the following tasks, with additional budget and scope added to Task 8 as presented in this Amendment: Task 1: Alternatives Analysis Task 2: Survey Task 3: Preliminary Design Task 4: Detailed Design Task 5: Outreach Task 6: Environmental Analysis and Permitting Task 7: Bidding Assistance Task 8: Services During Construction Task 9: Project Management Task 10: Management Reserve Task 11: Geotechnical Support Task 12: Electrical Support Task 13: Force Main Design and Support AMENDMENT 4 - DETAILED WORK BREAKDOWN Task 8: Services During Construction Subtask 8.1: Services During Construction Provide support to the City’s Project Manager and staff during the construction phase of the project. Activities • Revise CADD drawings to conform with markups kept by the Contractor during construction. Assumptions • Parametrix will not verify completeness and accuracy of the Contractor’s marked up drawing set. • This task will be started after Contractor has provided a complete marked up drawing set. • No other record documents besides the Record Drawings will be provided. Deliverables • One 22”x34” mylar and two 11”x17” bond hardcopy sets of the Record Drawings. • CADD files for the project, including sheets and base files (x references), submitted via cloud-based file transfer site of City’s choice. • PDF copies of the Record Drawings submitted via cloud-based file transfer site of City’s choice.
