Bremerton Community Farmer's Market Agreement - Second Amendment

SECOND AMENDMENT TO THE LICENSE AGREEMENT
BETWEEN THE CITY OF BREMERTON AND
BREMERTON COMMUNITY FARMER’S MARKET
This Second Amendment to the License Agreement between the City of Bremerton, a Washington
municipal corporation ("City") and Bremerton Community Farmer's Market ("License") specifically
amends the License Agreement entered into between the parties on March 23, 2018 and as amended
June 20, 2020 collectively referred to hereinafter as ("Agreement").
WHEREAS, the City has agreed to amend the Agreement to extend the term of the Agreement and
update compensation.
NOW, THEREFORE, in consideration of the foregoing recitals which are incorporated herein by
reference, and the amended terms and conditions set forth below, the parties agree as follows:
1. Term. The term of this Agreement shall be extended for an additional period of two (2) years
from date of execution. However, the parties shall have the option to terminate this
Agreement for any reason at any time with thirty (30) days written notice to the other party.
2. Compensation. No payment is due during the first year of this term extension. However,
effective the second annual anniversary of this term extension, licensee shall make a payment
to City in the amount of $275.00. Such payment shall be made prior to April 15th of any term
for which this Agreement is in effect.
3. Premises. This City hereby grants to Licensee this Agreement for the use of a portion of
Evergreen Rotary Park identified in Exhibit A as attached to this amendment and a portion of
Pendergast Regional Park identified in Exhibit B as attached to Amendment No. 1 of this
Agreement for the use and purpose described herein. City is the legal owner of the properties
identified in Exhibits A and B.
4. Safety. Licensee agrees to adhere to all federal, state and local laws and regulations as well as
to their COVID-19 Safety Plan incorporated into this agreement as Exhibit C.
5. Counterparts. This License may be executed in two (2) or more counterparts, any of which
shall be deemed an original but all of which together shall constitute one and the same
instrument. All other terms of this agreement as amended shall remain in full force and
effect.

last date signed below.
