L. Compliance with Laws: Consultant shall comply with all applicable Federal, State,
and local laws in performing its obligations under this Agreement.
M. Choice of Law and Venue: This Agreement shall be interpreted according to the
laws of the State of Washington. Any judicial action to resolve disputes arising out of this

acts of God, fires, floods, strikes, or weather of unusual severity. PROVIDED, HOWEVER, that
the Consultant must promptly notify the City within ten (10) calendar days in writing of the cause
of the delay. If, on the basis of the facts and the terms of this Agreement, the delay is properly
excusable, the City shall, in writing, extend the time for completing the work for a period of time
commensurate with the period of excusable delay.

SUBJECT: HUD REGULATED INSURANCE POOL
Housing Authorities Risk Retention Pool (HARRP) is a Governmental Risk Sharing
Group made up of 91 west coast housing authorities. HARRP has been in operation since
1987, insuring the risks of housing authorities. We are not an insurance company and
therefore not rated by A.M. Best. However, we are regulated by the U.S. Department of
Housing and Urban Development (HUD) which recognizes that "HARRP is substantially
equivalent to a financially sound and responsible insurance company capable of
providing coverages required by the {HUD} Annual Contributions Contract." HARRP is
also approved by Fannie Mae; lenders should call their insurance compliance desk in
order to verify HARRP's approval.
Furthermore, HARRP operates under authority of state law allowing government entities
to self -insure its risk of property and casualty losses with other public entities under the
following statute:
The Revised Code of Washington Chapters 39.34 and 48.62 which provides authority
for Washington public agencies to enter into intergovernmental cooperation agreements.
Oregon Revised Statutes Sections 190.003 to 190.250, which provides authority for
Oregon public agencies to enter into intergovernmental cooperation agreements.
California Government Code Section 6500, et seq., provides authority for California
public agencies to enter into intergovernmental cooperation agreements.
Nevada Revised Statutes Chapter 277 which provides authority for Nevada public
agencies to enter into intergovernmental cooperation agreements.
Finally, we operate in accordance with an IRS Private Letter Ruling which states:
"Participation of the governmental entities in the group is an activity within the function
of the sovereign to conduct, because the governmental entities must take steps to protect
their financial security with liability protection. Thus the group [HARRP] is performing
an essential governmental function which is within the scope of section 115 of the Code."
Enclosed for your review are audited financial statements from HARRP's annual report.
