The Contractor shall construct, furnish equipment and materials, and perform all work as necessary or required to complete the Change Order Items. The increase or decrease in contract price shown below includes any applicable taxes. Overall contract time is not increased. Nothing in this Change Order shall limit the City’s right to bring a claim for past performance. The undersigned Contractor approves the foregoing Change Order as to the changes, if any, in the contract price specified for each item, including any and all supervision costs and other miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for completion of the entire work due to said Change Order. This project experienced a minor delay being awarded and has experienced a slight delay obtaining right-of-way agreements, which has prevented us to complete that portion on time. As of today, we have used 71 of the 100 calendar days granted within the contract and see no issue completing the remaining substantial work within this time restraint. Pape & Sons is requesting an extension on this deadline to complete the HMA restoration requirements, including the overlay portion of the project. This work will be completed in coordination with the city as appropriate weather conditions allow. Pape & Sons will continue working diligently to complete this project. We appreciate the help and cooperation we have received working with the city and look forward to working together.
