In accordance with Section B.4, Future Rate Adjustments, the purpose of this planned modification is to incorporate rate adjustments for Contract Line Items (CLIN’s) 0001, 0002, 0003, and 0004 for rate period three (3) under the subject contract as further detailed herein. This modification incorporates the City of Bremerton’s methodology for adjustment of water and wastewater rates, provided 06 January 2023, under Attachment J.2. Attachment J.2 dated 06 January 2023 supersedes and replaces Attachment J.2 which was incorporated at award of the subject contract, and is applicable to CLINs 0001 and 0002, summarized as follows: CLIN 0001 (Potable Water): $ 95,029/month and volumetric charge of $1.91/hundred cubic feet (hcf) CLIN 0002 (Sewage Services): $113,830/month and volumetric charge of $4.88/hundred cubic feet (hcf) This modification incorporates the City of Bremerton’s Ordinance No. 5461 “Exhibit A-Assessments, Rates, Fees, and Changes,” effective 01 January 2023, under Attachment J.3. Attachment J.3 effective 01 January 2023 supersedes and replaces Attachment J.3 which was incorporated at award of the subject contract, and is applicable to CLINs 0003 and 0004, summarized as follows: CLIN 0003 (Water and Sewer‐Bldg 981): Water $33.36/month (2‐inch, within city limits) and volumetric charge of $2.39/hcf (Non‐Residential, Within City Limits); Sewer: $57.10/month (Commercial I, Within City Limits), and $5.34/hcf (Commercial I, Within City Limits). CLIN 0004 (Storm Water Service, Montgomery Ave): $5,375/month ($21.50/month * 250 ISU's (Commercial I within City Limits) As a result of this modification, the aforementioned rates shall be in effect for the period of 01 January 2023 to 31 December 2023. 2. The contract completion date remains unchanged. 3. Acceptance of this modification by the Utility Provider constitutes an accord and satisfaction and represents payment in full for both time and money and for any and all costs, impact effect, and for delays and disruptions arising out of, or incidental to, the work as herein revised. 4.
